A PROCLAMATION. To all to whom these presents shall come-GREETING. COLIN H. CAMPBELL WHEREAS it is provided by chapter 116 Attorney-General. of the Revised Statutes of Manitoba, 1902, being "The Municipal Act," that, in case it appears by a census return taken under the provisions of said Act, that an incorporated village contains over 1,500 inhabitants, the village may, by proclamation of the Lieutenant-Governor-in-Council, be erected into a town, provided that in the case of the Village of Carberry it shall be necessary only that the population exceed 1,000 in order to authorize its being made a town; And whereas, under the provisions aforesaid of said Act, the Village of Carberry has applied to be incorporated into a town corporation; And whereas the said Village of Carberry appears to possess over 1,000 inhabitants, and all the requirements of the said Act have been substantially complied with in order to entitle the said village to be and become a town corporation, and it is deemed expedient to give effect to the erection of the said village into a town corporation under the name of "The Town of Carberry," Now know ye that, by and with the advice and consent of the Executive Council of our said Province, and under and by virtue of authority of the said Act, and by any other power whatsoever in us vested in that behalf, we do by these our letters patent constitute the inhabitants of the locality hereinafter described, that is to say, commencing at a point on the eastern boundary of section thirty (30) in township ten (10) in range fourteen (14) west of the principal meridian, in the Province of Manitoba, where the southern boundary of the right-of-way of the Canadian Pacific Railway intersects in the said eastern boundary, thence north along the eastern boundary of sections thirty (30) and thirty-one (31), in the aforesaid township and range, to a point on said eastern boundary distant twelve hundred and sixty-one (1261) feet north of the south-east corner of section thirty-one (31) aforesaid; thence in a north-westerly direction, parallel with the said southern boundary of the right-of-way of the Canadian Pacific Railway, a distance of twenty-six hundred and fiftyfour (2654) feet to the centre of the municipal road running between the south-west quarter and the south-east quarter of said section thirty-one (31); thence south along centre of said road a distance of nine hundred and nine (909) feet to a point six hundred and twentyseven (627) feet north of the intersection of said municipal road with the south boundary of section thirty-one (31) aforesaid; thence west and parallel with the southern boundary of said section thirty-one (31) to a point in the eastern boundary of section thirty-six (36), in township ten (10), in range fifteen (15) west of the principal meridian, in the Province of Manitoba, distant six hundred and twenty-seven (627) feet from the south-east corner of said section thirty-six (36); thence west and parallel with the southern boundary of said section thirty-six (36) a distance of nine hundred and thirty-five (935) feet; thence south and parallel to the eastern boundary of sections thirty-six (36) and twenty-five (25), in township ten (10) and range fifteen (15) west of the principal meridian, to the southern boundary of the right-of-way of the Canadian Pacific Railway; thence in a south-easterly direction along the said southern boundary of the said right-of-way to the western boundary of said section thirty (30); thence south along the said western boundary of said section thirty (30) six hundred and fifty-eight (658) feet; thence in a south-easterly direction, parallel to the southern boundary of the said right-of-way, to the eastern boundary of said section thirty (30); thence north to the place of beginning, containing by an admeasurement four hundred and eighty (480) acres, be the same more or less, a town corporation under the name of The Town of Carberry," with all the powers, and subject to all the restrictions, conferred and imposed upon town corporations by the said "The Municipal Act"; And we do further direct as follows:-(1) That the council to be elected for the said Town of Carberry shall consist of a mayor, who shall be the head thereof, and four councillors, two of which shall be elected in each ward by the duly qualified electors of the wards. hereinafter mentioned and described; (2) that a meeting for the nomination for mayor and councillors, to comprise the first council of the said Town of Carberry, shall be held in what is known as the Municipal Hall, Town of Carberry, on the fifteenth day of August, A.D. 1905, at the hour of 12 o'clock noon; (3) that should a vote be required to elect the said mayor and councillors, or any of them, the said vote be had and taken at such place or places within the said Town of Carberry as may be determined by the returning officer on Tuesday, the twenty-second day of August, A.D. 1905, between the hours of 9 o'clock in the forenoon and 5 o'clock in the evening; (4) that the voters' list to be used at the said election shall be the last revised voters' list of the Village of Carberry and the Municipality of North Cypress, applicable to the limits of the said Town of Carberry, hereinbefore described; (5) that the returning officer shall give at least ten days' previous notice, in the manner prescribed by "The Municipal Act," of the time and place for the holding of the nomination of candidates for mayor and councillors of the said town; (6) that the said election shall be conducted by ballot, in accordance with the provisions in that behalf contained in "The Municipal Act"; (7) that Mr. R. A. Garland be the returning officer for the purpose of holding the said nomination and election; (8) that the time and place of holding the first meeting of the council to be elected shall be on Wednesday, the twentythird day of August, A.D. 1905, at the Municipal Hall, Town of Carberry, at the hour of 12 o'clock noon; (9) that the said returning officer shall act as clerk of the corporation until the council shall elect a clerk; (10) that all the expenses of the returning officer for holding the said nomination and election, and incidental thereto, shall be borne and paid by the council of the said town; (11) that until a mayor and coun cillors shall have been elected, under the provisions hereof, the mayor and councillors of the Village of Carberry, as at present constituted, shall continue and prevail, and have full power and authority to deal with all matters affecting the said corporation in the meantime; (12) that the said Town of Carberry shall be divided into two wards, to be known and designated as Ward one and Ward two, the dividing line between said wards to be a line drawn commencing from the point of intersection of the most northerly boundary of the land above described with the centre line of the said municipal road, thence south along the centre of the said municipal road to the centre of First avenue, thence east along the centre of First avenue to the centre of Main street, thence south along the centre of Main street and the said centre line of Main street produced to the southern boundary of the lands above described; (13) Ward one shall include all the land above described lying east of the said dividing line; (14) Ward two shall include all the land above described lying west of the said dividing line. WHEREAS a petition has been presented to us, signed by not less than seventyfive freeholders and householders of the locality herein described, of whom not fewer than one-half are freeholders, praying that letters patent, under the great seal of the Province of Manitoba, be issued, incorporating the freeholders and householders of the said locality as a village corporation, under the provisions of "The Municipal Act"; And whereas the provisions of the said Act have been substantially complied with in the premises, and it is expedient to grant the prayer of the petitioners, Now know ye that, by and with the advice and consent of the Executive Council of our said Province, and under and by virtue of authority of the said Act, and of any other power whatsoever in us vested in that behalf, we do by these our letters patent constitute the inhabitants of the locality herein described, that is to say, the north-east quarter of section thirty-three (33) and the north-west quarter of section thirty-four (34), both in township eleven (11) and range twenty-eight (28), and the south-east quarter of section four (4) and the south-west quarter of section three (3), both in township twelve (12) and range twenty-eight (28), all west of the principal meridian, in the said Province of Manitoba; ; And we further direct that a meeting, for the nomination of mayor and councillors to be elected to compose the first council of the said village, shall be held at MacLeod's Hall, Ekhorn, on Tuesday, the twelfth day of December, A.D. 1905, at the hour of 12 o'clock noon, and, should a vote be required to elect the said mayor and council, or any of them, that the said vote be had and taken, at such place or places in the said Village of Elkhorn as may be determined by the returning officer, on Tuesday, the nineteenth day of December, A.D. 1905, between the hours of 9 o'clock in the forenoon and 5 o'clock in the afternoon; that the voters' list to be used at the said election shall be the last revised voters' list of the Rural Municipality of Wallace, applicable to the territory comprising the limits and extent of the said Village of Elkhorn hereinbefore described; that the returning officer for the said election shall be Charles Frederick Travis, agent, of the said Village of Elkhorn; that the time and place for holding the first meeting of the council-elect shall be Tuesday, the second day of January, A.D. 1906, at the hour of 10 o'clock in the forenoon, at MacLeod's Hall; that, prior to the holding of the nomination for mayor and councillors of the said village, the returning officer shall give at least ten days' previous notice of the time and place for holding the same, by printed notices posted in conspicuous places in the Village of Elkhorn, as required by "The Municipal Act"; that the council of the said village shall consist of a mayor, who shall be the head thereof, and four councillors, to be elected by the whole of the duly qualified electors of the said Village of Elkhorn, whose names appear on the last revised voters' list of the Rural Municipality of Wallace, as aforesaid; that the said election shall be conducted by ballot, in accordance with the provisions in that behalf contained in "The Municipal Act"; that the said returning officer shall act as clerk of the corporation until the council shall elect a clerk; that al expenses in connection with the holding of the said nomination and election, and incidental thereto, shall be borne and paid by the council of the said Village of Elkhorn; that the said returning officer shall preside as clerk at the first meeting of the council-elect, and, for the purpose of so presiding, shall have and possess all the powers of a clerk of a municipality under the provisions of The Municipal Act"; that the said council, at the first meeting thereof, shall appoint all necessary and proper officials for the conduct of the affairs of the corporation. 66 In testimony whereof we have caused these our letters to be made patent and the great seal of our Province of Manitoba to be hereunto affixed.
