A reply was received from the senior registrar, stating that at present there is in certain cases a delay of two days beyond the prescribed time for the issue of grants; that applications, as is usual at this time of year, are above the average number; and that, when the work has reached its normal level, any arrears that have accrued will be automatically cleared off..

PAYMENT OF COUNSEL'S FEES.

At a recent meeting of the committee constituted under the Solicitors Acts 1888 and 1919 the committee put once more upon record the views which they had expressed on previous occasions, that they strongly deprecate the idea that payment of counsel's fees may be delayed until the amount has been received by the solicitor, or that, as between solicitor and barrister, it is other than improper conduct in a solicitor not to pay counsel's fees, marked or incurred, after request has been made for payment, whether the amount of the fees has been received by the solicitor or not. SOLICITORS' BENEVOLENT ASSOCIATION. THE monthly meeting of the directors was held at the Law Society's Hall, Chancery-lane, London, on the 9th inst., Mr. R. W. Poole in the chair. The other directors present were Messrs. E. R. Cook, T. S. Curtis, W. E. Gillett, E. B. Knight, P. J. Skelton (Manchester), M. A. Tweedie and A. B. Urmston (Maidstone). £870 was distributed in grants of relief, sixty-six new members were admitted, and other general business transacted. Mr. H. A. H. Newington was elected to a vacancy on the board.

on "The Vocation of a Public Teacher of Law." He pointed out that public teachers of law were a comparatively new branch of the Legal Profession, and that this new branch needed its own organisation for the discussion of its problems.

For the ensuing year Professor Brierly (Oxford) was elected president and Professor Buckland (Cambridge) vice-president ; Dr. Winfield was re-elected treasurer and Dr. Burgin honorary secretary.

At an afternoon meeting an address was given by Lord Justice Atkin on "The Future Development of English Law," and a paper was read by Professor Levy-Ullmann, of the University of Paris, on "The Teaching of Comparative Law." Lord Justice Atkin emphasised that the law was still capable of development, and considered that the society was peculiarly well-fitted to advise and assist in this task. He pointed out how essential it was to maintain the reign of law and how necessary it was in consequence to clear up ambiguities and inconsistencies and any points upon which a layman might be tempted to criticise the existing system.

In the evening members of the society were entertained at dinner in All Soul's College Hall by the members of the Faculty of Law. Among those present were the Warden of All Soul's College Lord Justice Atkin, Mr. Justice Tomlin, Mr. R. A. Wright, K.C., Mr. C. Robertson Dunlop, K.C., the Master of Trinity Hall, Cambridge, and a large number of teachers of law from all the teaching centres of England and Wales.

THE LAW SOCIETY

THE Council of the Law Society have appointed Mr. E. Leslie Burgin, LL.D., solicitor of the Supreme Court, as principal and director of Legal Studies of the society, to fill the vacancy caused by the resignation of the present principal, and Mr. Emlyn C. S. Wade, B.A., LL.B., barrister-at-law, as vice-principal and deputy director.

Dr. Burgin has for some years been the senior member of the society's teaching staff. He graduated at the University of London with first-class honours, and was awarded a University Scholarship in 1908, and took his degree of Doctor of Laws in 1913. He is the author of a work entitled The Administration of Foreign Estates, and is a member of a well-known firm (Messrs. Denton, Hall, and Burgin) which enjoys a large practice in matters of international commerce. Mr. Wade, who graduated at Cambridge with firstclass honours in 1920, and was awarded the Whewell University Scholarship in International Law in 1922, read in the chambers of Mr. Dighton Pollock, junior equity counsel to the Treasury, and has acted as lecturer in law at Armstrong College, Newcastle-uponTyne, during the last twelve months.

THE Council, acting on the recommendation of the Legal Education Committee, has made the following award of Studentships, of the annual value of £40 each, renewable at the discretion of the council, subject to the conditions prescribed in the regulations:

Class A. Candidates under 19, having certain educational qualifications.-Mr. Francis Cedric Brasher. Mr. Brasher was educated at Clifton College, and is articled with Mr. W. R. Cæsar, of London; Mr. Robert Crossman Hodgins. Mr. Hodgins was educated at Wellington College, and is articled with Mr. J. D. Wheldon, of London.

Class B.-Articled clerks having at least three years to serve.-Mr. Kenneth Herbert Bain. Mr. Bain was educated at Blundell's School, and is articled with Mr. F. J. Press, of Bristol.

Each of the above studentships is awarded on condition that the holder proceeds and continues to pursue a course of studies for a degree in law.

ELDON LAW SCHOLARSHIPS

THE trustees will meet on the 14th Nov. to consider applications for two Eldon Law Scholarships. The scholarships are of the value of £200 a year. Mr. WILLIAM STACKHOUSE HOLDEN, solicitor, of Liverpool, has been appointed to be a Commissioner of the High Court of Southern Rhodesia. Mr. Holden was admitted in 1874, and is a member of the firm of Messrs. Cleaver, Holden, and Cleaver, of Liverpool.

6. ADMINISTRATION-POWER OF SURETIES.-Daughter of intestate widow had sureties on grant of letters of administration. She had no solicitor, and they only consented to act on her signing agreement that their solicitor should act and that the administration should not be withdrawn from him. All other children as next of kin are minors. Estate all personalty and is being wasted by administratrix and her husband, who desire that all assets and papers be handed to her. Solicitor and sureties desire to protect minors. What is the position of the various parties? YORKS. 7. APPEAL COSTS.-At borough petty sessions defendant consented on small felony charge to justices deciding case, and pleaded not guilty. Conviction with three months' hard labour. The owner of the goods alleged to be stolen was informant and prosecutor and re-examined his own witnesses and cross-examined those for the defence. Notice of appeal was duly given to clerk to justices and informant under the Summary Jurisdiction Act 1879, s. 31, and defendant liberated. Informant did not wish to be further troubled and instructed no solicitor. The high constable instructed solicitor, who issued a subpoena for informant to attend as witness, and at quarter sessions counsel appeared on behalf of the high constable. No one appeared for justices or informant as respondent. Objection was taken on part of appellant that the high constable had no locus standi, but recorder overruled it. The conviction was affirmed, but sentence quashed and appellant bound over. He was ordered to pay costs of high constable on the appeal, and this was formally objected to. Had counsel for the high constable any locus standi or the recorder any authority to direct appellant to pay his costs? It is submitted that his power was limited to the costs (if any) of the informant as respondent, he being "other party" to the appeal. YORKS.

ANSWERS

(Q. 1.) CONVEYANCE-WILL-TITLE.-A husband cannot dispose of his wife's gavelkind lands by will. He has an estate by the curtesy in a moiety of those lands for life or until re-marriage, whether B. had issue or not. (Robinson on Gavelkind 3rd edit., pp. 178-9.) C.'s marriage to D. was valid for sect. 1 of the Deceased Wife's Sister's Marriage Act 1907 is retrospective. Nor did C. lose his estate by the curtesy by this second marriage (sect. 2). So he was tenant by the curtesy until his death, and then the property

descended to B.'s three sons equally as co-parceners, for the descent of gavelkind lands in the right line is among the males. Females only take by representation. (Robinson on Gavelkind 3rd edit., p. 113.) G. O. S.

In answering this query last week, I did not realise that C. had married his deceased wife's sister, which I now see is plainly stated. Consequently, C.'s estate by the curtesy in a moiety of the property would continue till his death in 1919, for, while the Deceased Wife's Sister's Marriage Act of 1907 made all such marriages (past and future) valid, no rights in property were to be disturbed. (Sect. 2, and see in Re Whitfield (deceased); Hill v. Mathie, 103 L. T. Rep. 878; (1911) 1 Ch. 310; Re Crosby's Trusts, Smith v. Metherell, 147 L. T. Jour. 66; Re Springfield; Davies v. Springfield, 153 L. T. Jour. 84 ; (1922) 38 T. L. Rep. 263. The other moiety C. never had any interest in, so that my first reply still applies to that. JOHN BOYD.

(Q. 2.) EXECUTOR-SET-OFF.-It appears to me that the executor cannot set-off unless he can show that he was carrying on the business for the benefit of the creditors of the testator at his death, at the request of the creditors and under such circumstances that they undertook to indemnify him for so doing. (Re Millard, 72 L. T. Rep. 823; Re Oxley, 110 L. T. Rep. 626 (1914) 1 Ch. 604.) G. O. S.

C. had a claim to be paid out of A.'s estate a sum of £50. A.'s executor has a claim against C. for £90. The executor's right is rather to pay out of a fund in hand what is due from C. up to the amount of C.'s claim in that fund than a right to set-off. The rule, which is of general application, is that where a fund is being distributed, a party cannot take anything out of it until he has made good what he owes to the fund. (Re Rhodesian Goldfields, 102 L. T. Rep. 126; (1910) 1 Ch. 239; Re Jewell, 121 L. T. Rep. 207; (1919) 2 Ch. 161.) JOHN BOYD.

(Q. 3.) Conveyance-Sale bY PERSONAL REPRESENTATIVE— DUTY.-Presumably B., the executor of A.'s will, proved the same, and if this were so it seems that C., the executor of B.'s will, could sell as executor of executor in continuation of the chain of executorship. It appears that another point arises herein as to whether B. had assented to the devise to A.'s widow, and if in fact A.'s widow was in receipt of the rents and profits from 1914 to 1921 the fact would clearly point to an assent and the power of a personal representative to sell as such would have gone : (Whitburn v. Wise, 130 L. T. Rep. 655). Succession duty would appear to be payable on the widow's death as the exemption of estates under £1000 is limited to lineals, husband or wife of a testator. X. Y. Z.

Unless C. had assented to the devise to the testator's brothers the conveyance appears to be in order, if the two wills were duly proved. No estate or succession duty was payable on the death of the widow. (Finance Act 1894, s. 1; Finance Act 1894, s. 5 (2) as amended by Finance Act 1898, s. 13; Finance Act 1914, s. 14.) G. O. S.

If the personal representative of A. assented to the devise to the widow for life, either expressly or by implication (and if the widow had possession up to the time of her death that would I think be sufficient to imply assent), the purchaser has not got a good title. (See Thorne v. Thorne, 69 L.T. Rep. 378; (1893), 3 Ch. 196; Wise v. Whitburn, 130 L. T. Rep. 655; (1924) 1 Ch. 460.) The defect could be rectified by the two brothers confirming the conveyance. No estate duty is payable on the death of the widow. (Finance Act 1894, s. 14.), and the estate being under £1000, succession duty was never payable (Finance Act 1894, s. 12 (3).

(Q. 4.) COMPANY-AGREEMENT WITH EMPLOYEE-LIQUIDATION. -Apparently the agreement to pay interest was to last as long as the employment. The employment ceased on the date of the order for winding up (Chapman's case 1 Eq. 346). But if the winding-up was voluntary the resolution for that purpose does not have the same effect. (Midland Counties District Bank, 92 L. T. Rep. 360; (1905) 1 Ch. 357.) In that case I suppose the employee could look to the guarantors till the date of dissolution. G. O. S.

It may be that the liquidation of the company relieves the directors from further liability for interest. They would, I take it, covenant to pay interest on the debt due from the company, and this debt ceases on liquidation (Re Moss; Ex parte Hallet, 92 L. T. Rep. 777; (1905) 2 K. B. 307, but compare Fitz George; Re Ex parte Robson, 92 L. T. Rep. 206; (1905) 1 K. B. 462). JOHN BOYD.

Mr. George Crombie, solicitor, of Bootham and of Stonegate, York, a past president of the Yorkshire Law Society, who died on the 10th May, left estate of the gross value of £28,303.

OBITUARY

Mr. WILLIAM AUGUSTUS CASSON, barrister-at-law, died recently at Acton. Mr. Casson was called by the Middle Temple in 1893 and went the South-Eastern Circuit. He was seventy-one years old at the time of his death.

Mr. ARTHUR NEWMAN, solicitor, of Whalley Range, died there recently. Mr. Newman was admitted in 1878 and was for many years a partner in the firm of Messrs. Grundy, Kershaw, Samson, and Co., of Manchester, in which city he was well known for his professional ability.

Mr. EDWARD MORGAN UNDERWOOD, solicitor, of Hereford, died recently at the age of eighty-four years.. Mr. Underwood was admitted in 1862, and was senior partner in the firm of Messrs. Underwood and Steel. He was Dean's Registrar and Chapter Clerk to Hereford Cathedral for many years. Mr. Underwood was a member of the Law Society, of the Solicitors' Benevolent Association, and of the Society of Provincial Notaries Public of England and Wales.
