B.) 91 THE LAW AND THE LAWYERS The Courts and Legal Business ON Thursday last the Supreme Court closed its door until the 13th Oct., the position being even worse than that which obtained a year ago. In the Court of Appeal, Chancery matters are well up to date, and the King's Bench Final and New Trial list has been disposed of up to the end of April. But in the King's Bench the business is in a lamentable state. In addition to some forty special jury actions, which have stood over for one cause or another, that list dates back to March, and both the common jury and the non-jury list to February. One of the chief reasons for the diminution of common law business is the interminable delay and uncertainty in the trial of actions. Neither litigants nor their advisers can gauge, even approximately, when their disputes will be heard, and at the present time six to seven months seems to be the minimum period from setting down. For this state of affairs Parliament is to blame, for although lavish in expenditure for vote-catching schemes, it has always persistently starved the Law. At the present time, the Bench is hopelessly undermanned, and the only proper remedies are the permanent appointment of the two additional judges and the curtailment of the Long Vacation by the days in October. No greater impetus could be given to legal businsss than by clearing the lists so that all causes would be tried within two months of setting down. LICENSED PREMISES AND THE RENT ACTS It becomes apparent from a consideration of such cases as Brakspear v. Barton (157 L. T. Jour. 325) and Glossop v. Ashley (125 L. T. Rep. 842; (1922) 1 K.B. 1) that the application of the Rent Restriction Acts to public-houses and other licensed premises may in several instances prove inequitable. In Westminster and General Properties and Investment Company v. Simmons (35 Times L. Rep. 669), which was a decision under the earlier Acts, it was decided that a public-house, part of which was used for residential purposes, was a dwelling-house, and the broad principle laid down in that case, that a dwellinghouse may be controlled notwithstanding the fact that part is used for business purposes, was subsequently given statutory confirmation by sect. 12, 2 (ii.) of the Act of 1920, which provided that "the application of the Act to any house or part of a house shall not be excluded by reason only that part of the premises is used as a shop or office, or for business, trade, or professional purposes." Such a provision was no doubt necessary in order to bring within the scope of the Acts the numerous shop-dwellings situate throughout the country. But, on the other hand, it was unfortunate that licensed premises were not treated on a different footing. Thus in Glossop v. Ashley a public-house was let in Aug, 1911 to a brewery company at a rent of £130 per annum, Subsequently the brewery company sublet the premises, the rental payable to them by their sub-tenants on the 3rd Aug. 1914 being £24 per annum. This rent of £24, however, was a tied-house rent. The court held that the rent payable by the persons in actual occupation of the premises was to be considered for the purpose of arriving at the standard rent, |
