RENEWAL OF PRACTISING THE following notice has been posted at the Hall of the Law Society: The council having been requested to express an opinion as to the renewal of the practising certificates of solicitors serving in His Majesty's Forces, they desire to state: (1) That the certificate duty, having been imposed by statute, must be paid in the absence of new legislation to the contrary; (2) that any solicitor taking any profits from his business or from the business of his firm must take out a practising certificate; (3) that the name of any solicitor not taking out a certificate to practise cannot be entered in the Law List. The council have for some time been in communication with the Chancellor of the Exchequer with a view to the total or partial remission of the duty, and hope that their efforts may be successful, but at present no definite arrangement has been arrived at. THE LAW ASSOCIATION. THE usual monthly meeting of the directors was held at the Law Society's Hall on the 5th inst., Mr. Percy E. Marshall in the chair. The other directors present were Mr. T. H. Gardiner Mr. W. P. Richardson, Mr. Mark Waters, Mr. Nugent Chaplin, and the secretary, Mr. E. E. Barron. A sum of £107 10s. was voted in relief of deserving cases and other general business transacted. UNITED LAW SOCIETY. A MEETING was held on Monday, the 9th inst., at 3, King's Bench-walk, Temple, E.C. UNIVERSITY OF LONDON-INTER COLLEGIATE LAW STUDENTS' SOCIETY. At a meeting held on Tuesday, the 10th inst., at University College (Mr. R. F. Levy in the chair), the subject for debate was: "That secret diplomacy should no longer be permitted between States." Mr. A. Carreras opened in the affirmative, and Mr. E. W. Goodale in the negative. WORKMEN'S COMPENSATION.-I send the following which I have copied from my notebook: Where a workman is incapacitated for work by reason of an accident arising out of and in the course of his employment, the liability of the employer to pay compensation will remain notwithstanding that the continuance of such incapacity is caused by a supervening physical disability-e.g., heart disease, scarlet fever, lunacy, imbecility following on old age, or detention in prison of the workman: (Harwood v. Wyken Colliery Company, 108 L. T. Rep. 283; Brown 7. Kent Limited, 109 L. T. Rep. 293; McNally V. Furniss, v. 109 L. T. Rep. 270). LEGAL OBITUARY. Sir HENRY THOBY PRINSEP died in London on Sunday, aged seventy-eight. He was the eldest son of the late Henry Thoby Prinsep, member of the Council for India, and was educated at Harrow and Haileybury. He entered the Bengal Civil Service in 1855, and during the Mutiny he served with the troops, for which he was awarded the Mutiny medal. In 1878 he was appointed a judge of the High Court, Calcutta, and in 1897-8 served as an additional member of the Viceroy's Council. In 1894 he received the honour of knighthood, and on his retirement from the Bench in 1904 was created K.C.I E. Mr. WILLIAM CARTER, solicitor, of the firm of Carter and Bell, died at Worthing on the 2nd inst., aged eighty-six. He was educated at the City of London School, and at the time of his death was the oldest member of the John Carpenter Club. Mr. Carter was admitted in 1853 and was a freeman of the City of London and a member of the Farriers' Company, having filled the master's chair in 1880. Mr. Carter was also a member of the Sclicitors' Benevolent Association. He retired from practice four years ago. Mr. IVOR EVANS, solicitor, Cardigan, of the firm of Asa and Ivor Evans and Stephens, died recently, aged sixty-five. Mr. Evans was admitted in 1872, at the early age of twenty-one, having been articled to his late father, Mr. Asa Evans. He was coroner for North Pembrokeshire, had been mayor of Cardigan on two occasions, first in 1894 and then in 1911, and was a county and borough magistrate. Mr. SAMUEL THOMAS NICHOLLS, solicitor, of the firm of Messrs. Nicholls and Taylor, died at his residence, Pailors Hall, Bridgnorth, on the 8th inst., aged seventy-five. Mr. Nicholls was mayor of Bridgnorth as long ago as 1873, and was clerk of the peace for the borough for the last thirty-one years. Mr. Nicholls was admitted in 1861, and was a member of the Solicitors' Benevolent Association. Mr. CONRAD FITCH, solicitor, died at Lis residence, Rutland House, 14, Highbury New Park, on the 3rd inst., aged sixty. Mr. Fitch was admitted in 1877. ON Thursday the full Court of Appeal, consisting of the Master of the Rolls, the five Lords Justices, and presided over by the Lord Chief Justice, sat to consider some points that have arisen with regard to alien enemies and It is eminently essential that proceedings in the courts. all questions arising out of the war and the emergency legislation should be disposed of by all the judges of the Court of Appeal sitting together, and that as soon as We cannot possible after the appeals are set down. recollect a previous instance where a special court of seven judges has been formed, but in certain cases a court of six has sat for dealing with matters of more than usual importance. The last instance was in May 1912, in Scott v. Scott (107 L. T. Rep. 211), where the right to hear nullity suits in camera, and questions as to con"criminal cause or tempt of court and appeal in a matter," were discussed. Solicitors' Certificates. MR. JUSTICE ASTBURY had an interesting question raised before him this week with reference to a solicitor's certificate. The plaintiff's solicitor held a country certificate, but his address on the writ was given in London, and it was contended that under the circumstances the proceedings were void and the action should be dismissed. It is not surprising that the learned judge refused to accede to this request and merely adjourned the case, so that the plaintiff could take steps to regularise his position, following the opinion of Vice-Chancellor WOOD that "it would be most mischievous indeed if |
