PREFACE TO THE AMERICAN EDITION.

THE nature and object of the author's treatise is such, that any extended additions either to the text or notes would be inconsistent with the original design. The editor has, therefore, confined himself to noting some of the differences supposed to exist between the English and the American law, and referring to some leading and interesting cases upon some new or specially important principle discussed by the author. For the careful reading of the proof-sheets, and the verification of the authorities cited, the editor is much indebted to his friend and pupil, Mr. John Elliott Wetherbee.
