An Act to amend the "Coal and Petroleum Act

Relief Act."

[Assented to 21st December, 1923.]

IS MAJESTY, by and with the advice and consent of the
Legislative Assembly of the Province of British Columbia,

enacts as follows:

1922, c. 49.

1. This Act may be cited as the "Coal and Petroleum Act Relief Short title. Act Amendment Act, 1923."

(1) of s. 2.

2. Subsection (1) of section 2 of the "Coal and Petroleum Act Amends subsec. Relief Act," being chapter 49 of the Statutes of 1922, is amended by striking out the figures "1923" in the last line, and substituting therefor the figures "1924."

(1) of s. 3.

3. Subsection (1) of section 3 of said chapter 49 is amended by Amends subsec. striking out the figures "1923" in the ninth line, and substituting therefor the figures "1924."

An Act to amend the "Coal-mines Regulation Act."

IS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1921, c. 39.

1. This Act may be cited as the "Coal-mines Regulation Act Short title. Amendment Act, 1923."

2. Section 63 of the "Coal-mines Regulation Act," being chapter Amends s. 63. 160 of the "Revised Statutes of British Columbia, 1911," is amended by inserting between the eighth and ninth lines thereof the following words: or where in or about any mine an occurrence within any of the following classes takes place, whether personal injury or disablement is caused or not:

"(c.) All cases of ignition of gas or dust underground, other than ignitions of gas in a safety-lamp:

"(d.) All cases of fire underground:

"(e.) All cases of breakage of ropes, chains, or other gear by

which men are lowered or raised:

"(f.) All cases of overwinding cages:

"(g.) All cases of inrush of water from old workings; or

"(h.) Any other dangerous occurrence."

3. Said chapter 160 is amended by inserting therein the following Enacts s. 108A. as section 108A:

"108A. Every person who knowingly makes any false statement in any report or entry required under this Act to be recorded in any book kept at a mine shall be liable, on summary conviction, to imprisonment, with or without hard labour, for a term not exceeding two years."

Re-enacts s. 109.

4. Section 109 of said chapter 160 is repealed, and the following is substituted therefor:-

"109. Every person who is guilty of any offence against this Act shall, if no other penalty is prescribed elsewhere in this Act, be liable to a penalty not exceeding, if he is an owner, agent, or manager, one thousand dollars, or if he is any other person, one hundred dollars for each offence; and if the Inspector has given written notice of any such offence, then in case of an owner, agent, or manager to a further penalty not exceeding one thousand dollars and not less than one hundred dollars for every day after such notice that the offence continues to be committed, and in cases of other persons, to a further penalty not exceeding fifty dollars for every day after such notice that the offence continues to be committed."
