An Act respecting the Titles to certain Foreshores and
Lands covered by the Waters of False Creek, in the
City of Vancouver.

[Assented to 21st December, 1923.]

HEREAS by grant under the Great Seal, dated the third day Preamble. of March, 1902, pursuant to chapter 42 of the Statutes of 1900, a grant was made by the Crown in right of the Province to the City of Vancouver and its successors, covering certain foreshore of False Creek, in the City of Vancouver, and land covered by the waters of the said creek, as therein described, and known as Lot 2037, Group 1, New Westminster District:

And whereas by grant under the Great Seal, dated the seventh day of October, 1902, pursuant to chapter 68 of the Statutes of 1902, a grant was made by the Crown in right of the Province to the City of Vancouver and its successors, covering certain other foreshore of said False Creek and land covered by the waters of said creek, as therein described, and known as Lot 2064, Group 1, New Westminster District:

And whereas each of the said grants contained certain restrictions by way of a proviso as follows: "Provided, also, that the hereditaments hereby granted shall be used for park, industrial, or business purposes only, and may be leased by the City of Vancouver, for a term not to exceed forty years, to any person or corporation to enable them to carry on industrial, manufacturing, or business enterprises, but shall not be granted in fee":

And whereas the title to certain portions of said Lot 2037 has been registered in private owners under the respective certificates of title hereinafter mentioned, and it is advisable that title in feesimple to the said portions be confirmed according to the respective registrations thereof, freed from the said restrictions:

And whereas it is desirable that provision be made for vesting in the City of Vancouver the title to a portion of Lot 2037 and all of Lot 2064 freed from the said restrictions:

Therefore, His Majesty, by and with the advice and consent of the Legislative Assembly of the Province of British Columbia, enacts as follows:

1. This Act may be cited as the "False Creek Titles Confirmation Act."

2. (1.) The Lieutenant-Governor in Council is hereby authorized Vancouver free from and empowered to convey, by one or more grants under the Great Seal, to the City of Vancouver in fee-simple, free from the restrictions recited in the preamble, but subject to such other terms and conditions as he may see fit, all or any portion of Lot 2064, Group 1, New Westminster District, and all or any portion of that part of Lot 2037, Group 1, New Westminster District, granted by the Crown in the right of the Province to the City of Vancouver under grant dated March third, 1902, referred to in the preamble, lying west of Main Street (formerly Westminster Avenue), excepting thereout and therefrom the following parcels:

Confirmation of titles under certain registrations.

(a.) That portion of said Lot 2037 registered in the Land Registry Office of the Vancouver Land Registration District under Certificate of Title No. 64106-I:

(b.) That portion of said Lot 2037 registered in the Land Registry Office of the Vancouver Land Registration District under Certificate of Title No. 29700-I:

(c.) That portion of said Lot 2037 registered in the Land Registry Office of the Vancouver Land Registration District under Certificate of Title No. 31170-I.

(2.) The City of Vancouver is hereby authorized and empowered, contemporaneously with the issue of a Crown grant, or after a Crown grant has been issued under this section, to convey in feesimple or lease the lands comprised in the Crown grant, and it shall not be necessary for any by-law providing for the disposition of the lands to receive the assent of the electors as provided in the “Vancouver Incorporation Act, 1921."

3. The title to the several portions of said Lot 2037 referred to in clauses (a), (b), and (c) of subsection (1) of section 2, as registered under Certificates of Title Nos. 64106-I, 29700-I, and 31170-I, respectively, shall for all purposes be deemed to have vested, as of the dates of the respective registrations, in fee-simple, free from the restrictions recited in the preamble, but otherwise in accordance with the said registrations and the terms of the said certificates of title respectively.

An Act respecting the Hours of Labour of Employees of certain Municipal Fire Departments.

[Assented to 21st December, 1923.]

IS MAJESTY, by and with the advice and consent of the
Legislative Assembly of the Province of British Columbia,

enacts as follows:

1. This Act may be cited as the "Fire Departments Hours of short title. Labour Act."

2. This Act shall apply to the following municipalities: City of Application Vancouver, The Corporation of the City of Victoria, The Corporation of the City of New Westminster, Corporation of Point Grey, and The Corporation of the District of South Vancouver.

4. The provisions of this Act shall have effect notwithstanding the provisions of any general or special Act, or of any by-laws of the municipality relating to its fire department.

7. Notwithstanding the other provisions of this Act, in case of a conflagration for the control of which the attendance of all officers. and employees of the fire department is in the opinion of the Fire Chief or officer in charge of the fire department necessary, the Fire Chief or officer in charge of the fire department may require the attendance of all the officers and employees for work during the con tinuance of the conflagration.
