[Assented to 19th December, 1925.] IS MAJESTY, by and with the advice and consent of the

Legislative Assembly of the Province of British Columbia, enacts as follows:

H ,

1. This Act may be cited as the “ Game Act Amendment Act, Short title. 1925."

2. Section 2 of the “ Game Act,” being chapter 98 of the “Revised Amends s. 2. Statutes of British Columbia, 1924,” is amended by striking out the words “Game Conservation Board” in the definition of “permit," and substituting therefor the words “ Provincial Game Warden.”

3. Section 3 of said chapter 98 is amended by striking out sub- Amends s. 3. section (3), and substituting therefor the following:

“(3.) Notwithstanding the provisions of this Act, any farmer or his permanent employee residing upon the land may shoot any pheasant which is found to be actually doing damage by feeding upon any land of the farmer then actually seeded to crop, or actually doing damage to the crop growing on any land of the farmer."

4. Section 4 of said chapter 98 is amended by striking out the Amends s. 4. word “loaded” in the second line of subsection (2); and by adding to said section the following subsection :

"(3.) No person shall discharge a firearm of any description either on or across any travelled road or highway within the boundaries of any municipality."

5. Section 7 of said chapter 98 is amended by striking out sub- Amends s. 7. section (2), and substituting therefor the following:

“(2.) No person shall have in his possession the carcass of any deer from which all evidences sufficient to indicate conclusively the

sex of the deer have been removed, unless the carcass has been transported to the place where it is proposed to consume the carcass.”

Amends s. 11.

6. (1.) Section 11 of said chapter 98 is amended by adding to subsection (1) the words “and no person shall at any time hunt or kill any of the game birds referred to in subclause (v) of clause (C) of section 9 between sunset and sunrise."

(2.) Said section 11 is further amended by striking out subsection (2), and substituting therefor the following:

"(2.) Any person found in the vicinity of any forest or woodland or in any locality where game is usually found with head-lights of any description and firearms in his possession, or found hunting game birds, deer, or fur-bearing animals with any pit-lamp, spotlight, or other light in his possession, shall be guilty of an offence against this Act, and shall be liable to immediate arrest without warrant by any Game Warden or constable."

Amends s. 12.

7. Section 12 of said chapter 98 is amended by inserting after the word “aforesaid," in the thirteenth line of subsection (1), the words " or land upon which in respect of any portion not enclosed by a fence, water, or other natural boundary there are posted at intervals not more than three hundred feet apart notices forbidding trespassing, hunting, or shooting.”

Enacts s. 13A.

8. Said chapter 98 is amended by inserting therein the following as section 13A:

“ 13a. Where any Game Warden or constable finds a cat running at large in any unfenced woods or lands where game birds are usually found, or in actual pursuit of game, he may shoot or otherwise destroy the cat."

Amends s. 14.

9. Section 14 of said chapter 98 is amended by inserting after the word "place," in the first line of clause (f) of subsection (1), the words " or have in possession."

Amends s. 16.

10. Section 16 of said chapter 98 is amended by striking out the words “ Game Conservation Board " in the seventh line of subsection (1), and substituting therefor the words " Provincial Game Warden"; and by adding to said section the following subsection :

“(3.) Every licensed trapper who neglects or refuses to give information when required so to do by any Game Warden or constable as to the location of his trap-line and the cabins on his trapline, or any other information in respect thereof, or who gives false information in respect thereof, shall be deemed to have committed an offence against this Act."

Amends s. 18.

11. Section 18 of said chapter 98 is amended by striking out the words“ Game Conservation Board " in the sixth, seventh, and ninth lines respectively of subsection (2), and by substituting therefor in each case the words “ Provincial Game Warden"; and by adding to subsection (5) the words “except that a person who carries on the business of breeding fur-bearing animals may, after obtaining a permit therefor, feed to fur-bearing animals kept by him the carcass of any fur-bearing animal which has been kept for breeding purposes."

12. Section 19 of said chapter 98 is amended by striking out the Amends s. 19. words “ Game Conservation Board” in the fourth and fifth lines of subsection (2), and substituting therefor the words "Provincial Game Warden."

13. Section 23 of said chapter 98 is amended by striking out sub- Amends s. 23. section (1), and substituting therefor the following:

“ 23. (1.) No person who is not a resident shall at any time hunt, trap, take, wound, or kill any game, or carry, except while travelling in a public conveyance either by land or water or while bona fide proceeding directly to or from any such public conveyance, any firearm of any description or trap or other device which can be used for trapping, hunting, killing, or taking any animal or bird, without first taking out a licence in that behalf.”

14. Said chapter 98 is amended by inserting therein the following Enacts s. 23A. as section 23A:

“ 231. No person who is not a resident shall at any time angle (as the term is generally understood) for fish in any waters of the Province, or carry, except while travelling in a public conveyance either by land or water or while bona fide proceeding directly to or from any such public conveyance, any fishing-rods or any other device which can be used for catching any fish, without first taking out a licence in that behalf.”

15. Section 24 of said chapter 98 is amended by striking out the Amends s. 24. words "thirty-first day of May” in the second line of subsection (1), and substituting therefor the words "thirtieth day of June "; and by striking out clause (9) of said subsection; and by striking out the words one dollar per day up to ten days, or " in the second and third lines of clause (h) of said subsection.

16. Section 25 of said chapter 98 is amended by striking out the Amends s. 25. words Game Conservation Board” in the ninth line, and substituting therefor the words “ Provincial Game Warden"; and by striking out the words “a loaded shotgun or rifle" in the last line of said section, and substituting therefor the words “a shotgun or rifle containing live ammunition either in its breech or in its magazine."

17. Section 26 of said chapter 98 is amended by inserting after Amends s. 26. the word “ Agent,” in the fourth line, the words “ or Game Warden."

Amends s. 27.

18. Section 27 of said chapter 98 is amended by striking out the words “ Game Conservation Board " in the fourth line, and substituting therefor the words “ Provincial Game Warden.”

Amends s. 30.

19. (1.) Section 30 of said chapter 98 is amended by inserting after the word “record," in the third line of subsection (6), the words " in the English language.”

(2.) Said section 30 is further amended by inserting after the word “ animal,” in the first line of subsection (7), the words “ skunk, or bear"; and by inserting after the word “ animals,” in the fourth line of said subsection, the words “skunks, or bears."

(3.) Said section 30 is further amended by striking out subsection (9), and substituting therefor the following:

“(9.) The provisions of subsection (7) shall not apply to a licensed trapper with respect to the pelts or skins of fur-bearing animals, skunks, or bears actually trapped or taken by him, which pelts or skins are sold by him to a licensed fur-trader to whom clause (a) of subsection (2) applies; nor shall a licensed trapper who is a resident be required to make application for or obtain a fur-trader's licence in respect of pelts or skins of fur-bearing animals, skunks, or bears trapped or taken by him.”

(4.) Said section 30 is further amended by striking out subsection (12), and substituting therefor the following

“(12.) Where the business carried on by the fur-trader within the Province consists only of the buying of furs at wholesale from licensed fur-traders or at sales of furs at public auction, the Provincial Game Warden may by permit, in his discretion, authorize the fur-trader to carry on his business without obtaining a furtrader's licence."

Amends s. 31.

20. Section 31 of said chapter 98 is amended by inserting after the word “recorded," in the sixth line of subsection (2), the words “ in the English language."

Amends s. 33.

21. Section 33 of said chapter 98 is amended by striking out the words “but not to use, firearms belonging to any person for whom he is guide” in the first and second lines of subsection (2), and substituting therefor the words “ firearms, but not to use them for the purpose of securing trophies of game."

Re-enacts s. 35.

22. Section 35 of said chapter 98 is repealed, and the following is substituted therefor:

“35. (1.) No person shall have in his possession any game, whether alive or dead, or any part thereof during the close season : Provided this section shall not apply to trophies of game legally killed or to dressed furs; nor shall it apply to undressed pelts of fur-bearing animals in prime condition taken and had in possession north of the fifty-second degree of north latitude during the three months, and south of the fifty-second degree of north latitude during the two months, immediately following the end of the open season in any district, or during such further times as the Provincial Game Warden may by permit, in his discretion, allow such possession, or to game lawfully killed or obtained for personal use and had in possession during the fourteen days immediately following the end of any open season.

“(2.) In all cases under this section the burden of proof as to the time and place of killing or taking any game shall be upon the person in possession thereof."

23. Section 38 of said chapter 98 is amended by striking out the Amends s. 38. words “ Game Conservation Board” in the ninth and tenth lines, and substituting therefor the words “Provincial Game Warden.”

24. (1.) Section 40 of said chapter 98 is amended by striking out Amends s. 40. the first seven lines of subsection (1), and substituting therefor the following:

" 40. (1.) Notwithstanding anything in this Act, the Provincial Game Warden may, upon such conditions and within such periods and limits as he may think fit, and upon payment of the fees therefor fixed by regulations, issue permits in writing signed by him, or by any person authorized by him to sign permits, for any of the purposes following."

(2.) Said section 40 is further amended by striking out the word “ Board " in the seventh line of clause (k) of subsection (1), and substituting therefor the words “ Provincial Game Warden."

25. Section 57 of said chapter 98 is amended by inserting after Amends s. 57. the word "storehouse,” in the eighth line, the word "garage.”
