William Jones was indicted for uttering counterfeit coin. After hearing the evidence and counsel, the jury returned a verdict of not guilty, and the prisoner was acquitted. The judge was Mr. A. F. Engelbach. On Thursday last the King's Bench action Marley v. Pickwick's Weekly was tried. Marley claims damages against Pickwick's Weekly in respect of the publication of a report that premises owned by her were haunted by a gbost. The future meetings are as follows :- May 11, County Court, Gummidge v. Rover Steumship Company: Application by widow and sole dependant of Daniel Gummidge, wbo is alleged to have fallen overboard from the steamship Zingari in Bremen Dock on the 3rd Nov. 1908 and been drowned. May 18, Cbapoery Division, Calderon v. Cald.ron : Originating summons to determine the rights the parties under a settlement created by will. May 25, King's Bich Division, Jones and Wife v. Gourmet Brothers : On the 8th Dec. 1910 Jones and his wife partook of supper at the defendants' restaurant. The wife a'terwards became very upwell, and her illness was diagnosed as ptomaine poisoning caused by eating unsound fish. Action for damages. June 1, King's Bench Division, Tighe v. Middlesex Education Committee : Tighe, a contractor for the erection of a school house, forwarded a tender to the board offering to erect a building for £1500. This was accepted." Progress payments were made from time to time, and these were, at the request of the plaintiff, sent by post. APPORTIONMENT OF INCOME -Mr. Chandler's vię w differs from that expressed in Buckley on Companies, 8th edit., at p. 582, where it is stated : • Inquiry as to the time when profita were earned by the company is immaterial as between tenant for life and remainderman, tbeir rights are determined by the time not at which the profits are earned by the company, but at wbich they are by the action of the company made divisible among the members. The adoption of Mr. Chandler's system would in many workvery unfairly; assume in the caso given that the tenant for life bad purchased the Great Western Guaranteed Stook on the 23rd Feb. and died on the following day, bis representatives would have been entitled to the whole of the divide d paid on the 27th Feb. and nearly a third of that paid in August, while the remainder. man would in effect have paid for the February dividend in the purchase price, the purchase being assumed to have taken place the day before the stock was examined. LAW STUDENTS' UNION.--The last of the “house dinners" for tho present Beagon was held on Thursday, the 27th ult., at the New Imperial Club. The chair was taken by Mr. Lanbam, of the Chartered Accountants' Students' Society. Thoro were also present a number of members of the union and of the Chartered Accountants' Students' Society. A very successful smoking concert was held after the dinner, to which members of both societies oontributod. LEGAL OBITUARY, Sir CHARLES ALPIONS PANTALÉON PELLETIER, K.C.M.G., P.C., Lieutenant-Governor of Quebeo, died in Ottawa on Monday. Sir Charles, wbo was born in 1837, was a younger son in an old FrenchCanadian fami.y. Called to the Bar io 1860, bo took silk in 1879, and in 1892 he was made Bâtonnier of the Queboo Bar. In 1896 be becamo Speaker of the Canadian Senate, of which he had been a member sinoo 1877. Abandoning politics in 1902, be was appointed a justice of the Supreme Court, and in 1908 he was transferred to the Lieutenant-Governorship of his native province. CXXXI.--No. 3554 All parties seem to be agreed as to the principle of the Insurance Bill introduced by the Chancellor of the Exchequer in the House of Commons, but a complex measure of this description, containing as it does, eighty-seven clauses and nine schedules, is bound to raise considerable difference of opinion as to detail. Naturally the success or . otherwise of a scheme of this description must depend largely upon actuarial considerations with which we cannot attempt to deal, and there is no doubt that in its course through Parliament many important amendments and alterations will be necessary before it can be placed upon the statute-book. The imposition of a compulsory system of thrift is undoubtedly for the good of the classes coming within the purview of the Bill, but, at the same time, although simplicity of collection is an excellent principle, care must be taken that too large a burden is not placed upon any particular class. It would seem that both parties are anxious that proposals of the nature contained in the Bill should pass into law, but it is only by careful and well-thought-out criticism that a fair and workable scheme will be obrained. |
