LONDON, APRIL 5, 1845.

We have in two former Numbers of THE JURIST given to our readers some account of the plans proposed by Captain Maconochie for improving the management of criminals in our penal colonies. We have reason to believe that those plans are receiving the serious consideration of the Executive Government, and, should they ultimately receive its sanction, many points invelved in them will require the assistance of the Legislature before they can be carried into effect.

Two propositions in particular are made by the promoter of these improvements, which are of some novelty, and one of which involves a considerable change of the law. We will state them in the words of the author himself, in a resumé of his views lately published, and then offer a few observations upon them. "The following," says Captain Maconochie," are the leading points of apparatus, which, with much practical experience on the subject, I earnestly recommend to attention. But I repeat, it is to the principle that I really attached.

"1. Transported criminals should come under two tences, banishment for a given time, according to the fence, from the country where it has been committed with hard labour in a penal settlement until discharged der its regulations. The two clauses should have no ecessary connexion with each other. The termination of the sentence of banishment should not necessaily discharge from the penal settlement, nor vice versa. The expatriation should be considered as imposed to protect the society that has been injured, from the early return of one who has shewn himself weak amidst the temptations incident to it; but the discipline of the penal settlement should be maintained until weakness On the Management of Transported Criminals, by Captain Maconochie, R. is converted into strength before it is allowed to go anywhere. A patient convicted of moral disease, and received as such into hospital, should be there retained not for a given term, but until cured; and, from my intimate knowlege of prisoners, I feel assured that nothing would so much subdue both themselves and the profligate companions whom they leave behind,-nothing, in a word, would prove more effective as example,-than such a regulation.

"7. Married women convicted of felonies should either not be transported at all, or they should be divorced, or have the same privilege granted to them as the men, provided their husbands are willing to follow them. Women in a penal settlement fettered with distant ties are in a position in which vice is inevitable, and nothing can justify deliberately placing them in it."

Now, first, on the subject of banishment. Exile or banishment is very distinguishable from transportation, in the sense in which the latter term is used, in reference to it as a punishment by act of law; the former being simply exclusion from this realm, without any obligation upon the party to reside in any particular place other than this realm; while the word "transportation" is always used in our penal statutes, as indicating and directing the compulsory residence of the party transported, in the particular place to which he is, under the statute, removed. But though banishment is not, and has not been, for a very long period, used as a punishment, and although it is not known as such to the common law, yet it is not wholly unknown to the statutory law of England.

The 39 Eliz. c. 4, for punishment of rogues, vagabonds, and sturdy beggars, enacted, that "such rogues as were dangerous to the inferior people should be banished the realm," or adjudged to the galleys. (Statutes at Large, vol. 2, p. 687; and see 1 Black., 21st edit., p. 137, notes). And that law continued in force till 12
