Hotel accommodation in Sheffield is in demand, and intending visitors should engage rooms as soon as possible. Arrangements have been made with the undermentioned hotels for a limited number of rooms to be available for members who apply prior to the 15th Aug. for rooms reserved by the Sheffield District Incorporated Law Society: Royal Victoria Hotel (adjoining L. & N.E. railway station); Grand Hotel, Leopold-street; King's Head Hotel, High-street.

Particular attention is called to the request that members will notify the hon. secretary of the Sheffield District Incorporated Law Society of their intention to attend the meeting on or before the 15th Aug. next, in order that programmes may be sent to them.

LAW ASSOCIATION

THE usual monthly meeting of the directors was held at the Law Society's Hall on Thursday, the 9th inst., Mr. J. R. H. Molony in the chair. The other directors present were Mr. J. D. Arthur, Mr. E. B. V. Christian, Mr. P. E. Marshall, Mr. A. E. Pridham, and Mr. Wm. Winterbotham and the secretary (Mr. E. E. Barron). Mr. J. D. Arthur was appointed chairman of the board for the current year, and the finance committee was re-appointed. A sum of £1149 was voted in continuance of grants to cases regularly assisted by the association, with some increases; and other general business was transacted.

SOLICITORS' BENEVOLENT ASSOCIATION THE monthly meeting of the directors was held on the 8th inst. at the Law Society's Hall, Chancery-lane, London, the Rt. Hon. Sir William Bull, Bart., M.P., in the chair, the other directors present being Messrs. F. E. F. Barham, C. E. Barry (Bristol), E. R. Cook, W. E. Cunliffe, T. S. Curtis, E. F. Dent, A. G. Gibson, R. Inland Revenue shown the annuity as £250 gross, i.e., £200 payable to the widow and £50 the present rate of tax. The Inland Revenue authorities now change their policy and they assert that £200 should be paid to the widow, but that £50 tax should not be included inasmuch as the widow is not liable to suffer tax-she is seventy-five years of age. The tax authorities now contend that in spite of the provisions contained in the settlement as to the annuity being paid free from all deductions the trustees should now deduct the appropriate tax from the £200 annuity and let the annuitant recover the tax as best she can this having the effect, therefore, of over-riding the settlement. The view of the Inland Revenue authorities is correct. Where an annual sum is payable "clear of all deductions" this does not mean free of income tax. The annuity has to bear this tax : (see Halsbury's Laws of England, vol. 24, at p. 502). The tax being paid, the annuitant can recover it. A.

162.-RENT RESTRICTION-SANITARY AUTHORITY-CERTIFICATE -INCREASE OF RENT.-With reference to sect. 5 of the Rent Restrictions Act 1923 the certificate of the sanitary authority was served on the landlord on the 18th May last, the rent being paid quarterly. Can the increases of rent under the Act for the whole quarter be deducted from the next quarter's rent due on the 24th June? If not, can an apportionment be deducted, or has the tenant to wait till the 29th Sept. before he can deduct the increases. R. AND H.

The Rent Restrictions Act 1923, s. 5 (1), expressly provides where a certificate from the sanitary authorities has been served, that the tenant shall not be liable for increases of rent in respect of any “subsequent rental period." This must, I think, mean that the deductions can be made in respect of rent accruing due and payable after the notice has been served, but that rent payable before the notice is not affected. Rent normally accrues from day to day, and the increased rent presumably accrues in the same way. I think, therefore, that after the 18th May the tenant can make the authorised deductions. The increased rent should be apportioned, and the landlord only paid in respect of the period prior to the 18th. A.

163. PRECEDENTS JOINT TENANCIES.-Can any of your readers refer me to (a) A precedent of a notice by a joint tenant who was a joint tenant at the date of coming into operation of the Law of Property Act 1925 terminating the joint tenancy in the property and converting his interest in the proceeds of sale thereof into a tenancy in common. (b) A precedent of an agreement between two or more persons who have purchased freeholds under a conveyance made to them as joint tenants simpliciter setting out their respective shares in the property, rents and proceeds of sale when sold. (c) A precedent of a conveyance to two or more joint tenants of freeholds with clauses varying the statutory trusts. What advantages can be gained by varying the implied trusts over relying upon them as set out in the Law of Property Act 1925 ? The Encyclopædia of Forms and Precedents relies upon the implied trusts, but, I believe, Key and Elphinstone and other precedents set these out in two or three clauses which seem unnecessary. (d) A precedent of a deed of covenant by a purchaser of an equity of redemption in freeholds covenanting with the mortgagee (who did not join in the conveyance of the equity) to pay principal and interest. (a) There does not appear to be a precedent of a notice severing a joint tenancy in any of the precedent books, but as sect. 36 of the Law of Property Act 1925 only requires the notice to be in writing, if the meaning is clear the form is immaterial. (b) See the Encyclopædia of Forms and Precedents, 2nd edit., vol. 18, p. 65. (c) Both Key and Elphinstone, at vol. 1, p. 624, and Prideaux vol. 1, p. 653, in a conveyance to co-owners insert additional trusts to those set out in the statutory trusts. This is not necessary, but where the trustees for sale are also beneficiaries it is sometimes useful to enlarge their powers so that they shall be able to exercise the powers of absolute owners. For example, trustees for sale can only mortgage for certain and specified purposes, and they can only grant leases for a limited number of years. Where the trustees wish, in these matters, to have the same powers as beneficial owners, the powers have to be inserted in the deed. If this is not done, when the trustees wish to go beyond their statutory powers, the beneficial title has to be disclosed. 164. MORTGAGE CONVEYANCE. J. C., on the 5th May 1891, mortgaged a freehold farm for £2000 to J. H. L., J. G. Í., and J. E. L. (trustees), the two latter being dead, and on the 30th May 1891 charged the same to the said J. H. L. with a further sum of £1000. On the 10th March 1905 J. C. died, and his will was proved by the two executors (W. C., a son, and R. E. S., his sonin-law) in the Principal Registry on the 31st Dec. 1907. Testator devised all his real estate (subject to payment of his debts) to his five children, now all living, including the said W. C. W. C. has been in occupation of the property since the date of the death of his father and has paid all the debts, including a promissory note for £700, which together exceed the total value of the above real estate. The said sums of £2000 and £1000 are still owing. It is estimated the property is not worth more than £3000, and the remaining four children wish to convey their respective share to

their brother, W. C., for a nominal consideration. How and by what documents should this be carried out? EBOR.

The executors of J. C. do not appear to have assented to the devise of real estate contained in his will. This being so, I think it is within the power of W. C. and R. E. S. to assent in writing to the property in question vesting in W. C., subject to the mortgage. Sect. 36 of the Administration of Estates Act 1925 is retrospective in operation, consequently under sub-sect. (7) an assent is, in favour of a purchaser, evidence that the person in whose favour the assent was given was the person entitled to the legal estate. If it is desired that all the children should join in vesting the property in W. C., this can be effected by a conveyance by the executors, the children being parties to give their consent. The conveyance in this case should contain full recitals showing the beneficial title and the fact that the property is not worth substantially more than the debts W. C. has paid or undertaken to pay. Whether the property is vested in W. C. by assent or conveyance, he will get an equally good title.

165. WILL CONSTRUCTION.-A testator by his will, which is a home-made one, leaves to his wife, who predeceased him, a life estate, and after leaving specific legacies to his three sons, the only children he had, and one of whom predeceased him, and a bequest to a grandchild, the will goes on to say: "At the decease of father and mother the whole of the estate to be sold by auction and the proceeds thereof to be equally distributed after all the funerals and other expenses of the said father and mother likewise the personal expenses of the executors on the said will." How should this paragraph be construed, and amongst whom is the estate to be "equally distributed ”? Would there be an intestacy so far as the residuary estate is concerned? SUBSCRIBERS.

This residuary gift is, I think, void for uncertainty. The testator bequeaths his property to a class, but there is no indication of whom the class is composed. In such a case there is an intestacy and the next of kin take: (see Doe v. Joinville, 1802, 3 East. 172). Probably the next of kin and the persons who claim under the residuary gift are the same persons; if they are not, the executors should not distribute without either the consent of any persons who might claim, or an order of the court. A.

166. TRUST FOR SALE-POWER TO POSTPONE-SALE.—A. died in 1918 having by his will appointed his widow and one C. to be executors and trustees thereof. A. gave devised and bequeathed all his property unto his trustees upon trust to sell and collect in and invest the proceeds of the sale and collection, the income of which to be paid to the widow for her life and afterwards to a daughter who is now of full age. The will contains the usual clause giving power to the trustees to postpone the sale and conversion. Grant of probate of the will was made to the widow, C. having renounced. No part of the estate was sold. The widow is now desirous of selling part of the real property. What steps should be taken to secure this end? The property is small and it is desired that the least expense possible should be incurred. W. D.

Presumably the widow had assented before 1926 to the devise on trust for sale and now holds the property as trustee for sale; if she has not so assented she can sell as personal representative. If she has assented, she should appoint a co-trustee under the power conferred by sect. 36 of the Trustee Act 1925 to act with her; then she and the additional trustee can sell and give a purchaser a good receipt for the purchase money in accordance with the provisions of sect. 27 of the Law of Property Act 1925. OBITUARY

Mr. MERWANJI RUSTOMJI BOYCE, barrister-at-law, died recently. Mr. Boyce, who practised for many years in Zanzibar, was called by Lincoln's Inn in 1899.

Mr. WILLIAM FREDERICK BARRY, barrister-at-law, died on the 12th June, at the age of seventy-five. Mr. Barry, who was called by the Inner Temple in 1877, was for many years a member of the law reporting staff of The Times, and was from 1900 to 1908 editor of the Times Law Reports, when he joined the staff of the Law Reports from which he retired a few years ago. Mr. Barry was very popular with his colleagues at the Bar, and did much for law reporting.

Mr. JAMES BARnard Hargreave, solicitor, of Birmingham, died suddenly on the 5th June. Mr. Hargreave, who was a member of the firm of Messrs. Brooks, Monk, and Hargreave, was admitted in 1914.

Mr. REGINALD ERIC WATSON, solicitor, died recently. Mr. Watson, who was a member of the firm of Messrs. Watson, Sons, and Room, was admitted in 1900.

Mr. ARTHUR ERNEST STOTT, solicitor, of Leeds, died recently. Mr. Stott, who was admitted in 1881, had practised in Leeds for forty-five years.

Mr. Herbert Porritt Cain, solicitor of Ramsbottom, Lancashire, left estate of the gross value of £22,154 (net personalty, £20,096).
