(2) The minister may at any time require such additional bond to be given as he deems necessary.

5. (1) Upon the approval of the bond and upon payment of a license fee of ten dollars, the minister shall issue a license authorising the applicant to carry on the business of produce commission merchant until the expiration of the current license year.

(2) The license shall be in such form as may be prescribed by the Lieutenant Governor in Council.

6. Every license issued under this Act shall expire on the thirtieth day of April following the date of issue, and shall be renewable from year to year on payment of a fee of $10 and on compliance with the provisions of this Act and of any regulations made thereunder.

7. If at any time the minister considers that it is in the public interest that a license under this Act should be suspended or revoked, he may so recommend to the Lieutenant Governor in Council, who may suspend or revoke the same.

8. No person who is not the holder of a valid and subsisting license shall act or engage in business within Saskatchewan as a produce commission merchant.

DUTIES OF PRODUCE COMMISSION MERCHANT.

9.-(1) Every produce commission merchant shall, upon the receipt of a consignment of produce and as he handles and disposes of the same, make a record in a book to be kept for the purpose, of all transactions relating thereto.

(2) Such record shall specify the name and address of the consignor, the date of receipt of the consignment, the kind and quantity of produce received, the date of sale, the quantity sold, the selling price thereof and the expenses connected therewith.

(3) A report of the sale containing the particulars mentioned in the preceding subsection, shall, together with the balance due to the consignor, be mailed to him within five days after the sale of such consignment has been completed. The names and addresses of purchasers shall be furnished by the produce commission merchant when demanded by the consignor.

(4) Such report shall be in the form set out in form 1 of the schedule to this Act or to the like effect.

(5) Whenever any produce commission merchant buys for himself any produce consigned to him the report of the sale shall contain a statement that he has purchased for himself the produce therein mentioned.

10. (1) A consignor, who has not received a report Complaint of the sale of a consignment and payment of the balance due to him within the time limited by the preceding section and has made a demand therefor, or, having received such report, is dissatisfied therewith, may make a complaint in writing to the minister verified by affidavit or statutory declaration.

(2) Upon receipt of such complaint the minister shall cause an investigation to be made, and may for the purposes of the investigation compel the produce commission merchant to produce his books, records or other documents and to give all information in his possession regarding the matter of the complaint.

(3) Upon completion of the investigation the minister shall render to the complainant a written report of the results thereof, which report shall be prima facie evidence of the facts found as stated therein.

11. Every person who violates any of the provisions Offences and of this Act or any rule or regulation made thereunder shall be guilty of an offence and, in addition to any other punishment prescribed by law, shall, upon summary conviction, be liable to a penalty of not more than one thousand dollars and to imprisonment for not more than one year.

(a) does or omits any act for the purpose of aiding
any person to commit the offence; or

(b) abets any person in commission of the offence;

(c) counsels or procures any person to commit the

CHAPTER 52

An Act respecting the Purchase and Sale of Eggs.

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1. This Act may be cited as "The Egg Marketing Act, Short 1920."

2. In this Act, unless the context otherwise requires, Interpretation the expression:

1. "Candling" means the careful examination of the "Candling" whole egg by means of a strong light in a partially dark room or place, the apparatus and method used to be such as shall be approved by the minister;

2. "Inspector" means any officer appointed for the "Inspector" purpose of carrying out the provisions of this Act;

3. "Minister" means the minister of agriculture;

4. candling records as may be required by the minister, which records shall be open at all reasonable times for examination by the minister or an inspector.

6. There shall be placed on the top flat of every case of candled eggs by the person candling the same a record in a printed form on a card or sheet of paper not smaller in size than two and three-eighths inches by four and onequarter inches, which shall give under the word "Saskatchewan" the license number of the person for whom the eggs were candled, the name, initial or other distinguishing mark of the person by whom they were candled, and the date of candling.

7. No person who is not the holder of a valid and subsisting license shall receive or buy eggs from producers for sale on consignment or for resale, except those retailers who do not buy direct from producers, and do not sell in lots greater than one case.

8. The minister may, upon receipt of an application in such form as he may prescribe, issue to the applicant a license to buy or sell, deal in or trade in eggs and such license shall remain in force until cancelled or suspended by the minister. Such licenses shall be numbered consecutively in the order of their issue.

9. The minister may make regulations regarding the issuing and use of stamps containing numbers or other distinguishing marks for marking of eggs by producers.

10. Any person failing to comply with any of the requirements or violating any of the provisions of this Act or of any regulations made hereunder shall be guilty of an offence and liable on summary conviction, to a penalty of not less than $5 nor more than $50; and his license may, in the discretion of the minister, be cancelled or be suspended for a limited time.

11. This Act shall come into force on the first day of June, 1920.
