CHAPTER 55

An Act to amend The Chattel Mortgage Act.

IS Majesty, by and with the advice and consent of the
Legislative Assembly of Saskatchewan, enacts as

follows:

Sections 2,

1. Sections 2, 3, 4, 5 and 6 of The Chattel Mortgage Act, con4, 5 and 6 being chapter 144 of The Revised Statutes of Saskatchewan, substituted. 1909, and section 2a of the said Act as enacted by section 24 of chapter 43 of the statutes of 1915, are repealed and the following substituted therefor:

"2. In the application of this Act, the word 'creditors' "Creditors" where it occurs shall extend to creditors of the mortgagor or bargainor suing on behalf of themselves and other creditors and to an assignee for the general benefit of creditors, within the meaning of The Assignments Act, as well as to creditors having executions against the goods and chattels of the mortgagor or bargainor in the hands of the sheriff.

"(a) on Sundays and holidays the office shall be closed; and

"(b) on Saturdays and during the period of vacation prescribed by The King's Bench Act and the rules of court the office shall be closed at one o'clock in the afternoon.

"(2) Registration shall be made during office hours only.

'6a. No registration clerk, deputy registration clerk, or clerk in the office of the registration clerk shall draw or prepare any document or conveyance which may be filed or registered in such office under the provisions of this or any other Act.

In the event of the establishment of a new judicial district all chattel mortgages relating to property within such district shall continue to be as valid and effectual in all respects as they would have been if the new district had not been established, and no chattel mortgage in force and filed at the date of the establishment of such new district shall lose its priority by reason of its not being filed in the office of the registration clerk of such new district prior to its renewal.

"(2) In the event of a renewal of any such chattel mortgages after the establishment of the new district the renewal statement shall be filed in the office of the registration clerk of such new district together with a certified copy of the chattel mortgage to which such renewal statement relates and of any renewals thereof under the hand of the registration clerk in whose office the same were filed."

2. (1) Subsection (3) of section 8 is amended by striking out the word "mortgage" in the fourth line and substituting "incorporated."

(2) Subsection (4) of the said section 8 is amended by inserting the words "bonds or" before "debentures" in the second and also in the third line.

3. The following section is inserted after section 11: "11a. Where a mortgage or conveyance intended to operate as a mortgage of goods and chattels, or any sale, assignment or transfer of goods and chattels, book debts, accounts or debts to be incurred, is made in favour of His Majesty, it shall not be necessary for the mortgagee

or bargainee or his agent to make the affidavit of bona fides required by this Act, and the provisions of this Act with respect to renewal shall not apply to such mortgages or conveyances."

4. Section 19 of the said Act is amended by striking Section 19 out the words "where the property is then situate in the thirteenth line and substituting therefor the words "where the mortgage is filed."

5. Section 21 of the said Act is amended by striking Section 21 out the first six lines and substituting therefor the following:

"21. Another statement in the form provided in section 20 hereof duly verified as required by that section shall be filed in the office of the registration clerk of the district where the mortgage is filed within thirty days next preceding the expiration of the term of one year from the day of filing the statement required by section 19."

6. The said Act is further amended by inserting New section therein as section 21a the following:

7. This Act shall come into force on the first day of Coming May, 1920, save as to the provisions relating to mortgages and conveyances in favour of His Majesty which provisions shall come into force upon this Act being assented to.

An Act respecting the Bureau of Labour
and Industries.

[Assented to February 4, 1920.]

IS Majesty, by and with the advice and consent of the
Legislative Assembly of Saskatchewan, enacts as

follows:

SHORT TITLE.

1. This Act may be cited as The Bureau of Labour Short title and Industries Act." New.

INTERPRETATION.

2. In this Act, unless the context otherwise requires, Interpretation the expression:

1. "Bureau" shall mean the bureau of labour and "Bureau" industries established by this Act;

2. "Commissioner" means the commissioner of the "Commisbureau appointed under the provisions of this Act;

3.-(1) There shall be a permanent bureau under the Establishment minister to be called the bureau of labour and industries appointment and the Lieutenant Governor in Council may appoint commissioner hereto a chief officer to be called the commissioner of labour and industries and such other officers, clerks and employees as may be necessary for the proper conduct of the bureau.

(2) The persons so appointed shall, under the direction of the minister, carry out the provisions of this Act and perform such other duties as may be assigned to them by the Lieutenant Governor in Council. New.

4. The salaries of the commissioner and all other Salaries of officials and the expenses of the bureau may be paid out of such moneys as may from time to time be appropriated by the Legislature for the purpose. New.
