CHAPTER 15

An Act to amend The Land Titles Act.

[Assented to February 4, 1920.]

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts

as follows:

1. The Land Titles Act, 1917, is amended in the manner 1917 (sess. 2), hereinafter set forth.

2. Subsection (14) of section 80 is repealed.

3. Section 100 is amended by adding thereto the Section 100 following subsection:

"(4) Where a mortgage has been filed against a purchased homestead or pre-emption prior to the issue of the grant, and proof is furnished to the registrar by affidavit that the mortgage money has been applied in discharge of the price and interest of the purchased homestead or pre-emption, or in discharge of Crown liens or both, and that any balance of the mortgage moneys remaining has been applied in order of priority upon executions or incumbrances filed before the mortgage, the mortgage shall take priority over such filed executions and incumbrances:

"Provided that this subsection shall not apply to any mortgage by the terms of which any part of the principal moneys secured are repayable in less than three years from the date of execution of the mortgage instrument."

4. Subsection (1) of section 153 is amended by insert- Section 153 ing after the word "owner" in the fourth line the words "and to all persons subsequent in interest to the execution creditor."

CHAPTER 16

An Act to amend The King's Bench Act.

[Assented to February 4, 1920.]

IS Majesty, by and with the advice and consent of the

cats as follows:

1. The King's Bench Act, being chapter 10 of the statutes of 1915, is amended as hereinafter set forth.

2. Section 12 is amended by adding thereto the following Section 12 subsection:

"(3) In respect of the jurisdiction and powers of the Lieutenant Governor as visitor of corporations, conferred by statute or otherwise, the court shall, upon the direction of the Lieutenant Governor, have and exercise the jurisdiction and powers which in England, prior to the passing of The Supreme Court of Judicature Act 1873, were vested in, or capable of being exercised by, the Lord High Chancellor representing the Crown as visitor of corporations."

CHAPTER 17

An Act to amend The Surrogate Courts Act.

[Assented to February 4, 1920.]

IS Majesty, by and with the advice and consent of the Legislative Assembly of Saskatchewan, enacts as follows:

1. Section 84 of The Surrogate Courts Act, being Section 84 chapter 54 of The Revised Statutes of Saskatchewan 1909, as amended by chapter 21 of the statutes of 1912, is further amended by striking out the character and figures "$1,000" where they occur therein and substituting therefor the character and figures "$1,500."

2. The provisions of the foregoing section shall be Retrospective deemed to have been in force on, from and after the first day of May, 1919.
