such matter as might fairly be regarded as out of date, but nothing has been omitted without careful consideration, and all the cases reported down to August, 1891, which were deemed to be of practical utility, have been referred to.

In order to make the present Volume more immediately useful, an index has been added which, it is confidently hoped, will merit and receive as much approval as did that of the fourth Edition. And to this index a table of the principal Rules and Orders referred to in the Volume has been prefixed. When the second Volume, which is in a forward state of preparation, is published, a similar index and table for the whole Work will be substituted.

In referring to the series of the authorized Law Reports which was concluded in the year 1890, the cases decided in the Court of Appeal have been distinguished by the use of the abbreviations "Ch. Div.," "Q. B. Div.," and "P. Div.," in lieu of "Ch. D.," "Q. B. D.," and "P. D."; and in referring to the reports of such cases in the current series of the Law Reports, the letters "C. A.” have been inserted for the like purpose of distinction.

The revision and preparation of the notes throughout the Work (with the exception of Chapters XII., XIV., and XVI., which relate more particularly to matters under the immediate cognizance of the Registrars), and the collection and selection of the points of law which it was deemed right to notice, have been the special charge of Mr. Dale, while Mr. Clowes has undertaken the duty of collecting and preparing the Forms for the press, and has also prepared the notes in the three Chapters above referred to. Each of the Editors, however, has throughout assisted the other to the utmost of his ability, and they, therefore, accept a joint responsibility.

In several Sections in the Chapter on "Injunctions," the Editors have gladly availed themselves of very useful work done by the late Mr. F. G. A. Williams, and their thanks are due to Mr. Eastwick of the Chancery Bar (who has carefully perused the greater portion of the proof-sheets), and to Mr. Ashton Cross of the Chancery Bar, for many suggestions of great value.

In the collection and preparation of the Forms, Mr. Clowes has derived great assistance from Mr. W. E. Church of the Registrar's Office who has spared no pains in searching the Records of the

Court, in testing the accuracy of the numerous references to them. contained in this Volume, and in verifying the precise wording of those Forms which it has been considered useful to insert.

The Editors desire to express their grateful acknowledgments to Mr. Charles Burney, the Chief Clerk, for many important suggestions made after perusing the proofs of Chapters XVIII. and XIX., and to Mr. Henry Skipper Ryland, the Taxing Master, for similar services rendered with respect to Chapter XVII. They are also indebted to Mr. Carrington and Mr. Lavie, Chancery Registrars, for many valuable Forms, notes, and suggestions.

Although the Editors have done their utmost to maintain the high reputation of "Seton," they cannot but be apprehensive, having regard to the extensive character of the Work and the arduous labour which it involves, that faults both of omission and of commission will be found. They trust, however, that that kind consideration which has, on previous occasions, been so freely accorded to the work of former Editors, may now be justly extended to their own.
