INNER TEMPLE.-JULY EXAMINATION, 1890.

ON the subjects in which instruction has been given by the tutors of the Inn, the Masters of the Bench have awarded_pupil_scholarships of 100 guineas each to the undermentioned students: Common Law, E. Acton; Equity, W. H. B. Hope; Real Property Law, C. F. Lloyd.

Mr. GEORGE SMITH, Q C., has been appointed a Member of the Executive Council of the island of St. Vincent.

Mr. DAN SUTCLIFFE, of the firm of Messrs. Eastwoods and Sutcliffes, solicitors, Todmorden, has been appointed Clerk to the Todmorden Local Board, in succession to Mr. T. W. Eastwood, resigned.

Mr. ROBERT EDINGTON, of 35, Bridge-street, Newport, Mon., has been appointed a Commissioner to administer Oaths. Mr. Edington was admitted in April 1884.

Mr. E. GISSING SKELTON, of 29, Lincoln's-inn-fields, and Wembly, near Harrow, has been appointed a Commissioner to administer Oaths. Mr. WILLIAM ASHFORD has been appointed a Commissioner to administer Oaths.

Mr. ALFRED PROCTER, of York, has been appointed a Notary Public to practise in that city and within ten miles thereof.

Mr. EDWARD FARRIES, of 1 and 2, Temple-chambers, Temple-avenue, E.C., has been appointed Legal Auditor to the Sheffield and Midland Railway Companies Committee in succession to the late G. Scanes, Esq., deceased.

G. HORSEY, Esq.-The late George Horsey, Esq., barrister-at-law, of Southampton-buildings, Chancery-lane, and of Colne Villa, New Southgate, Middlesex, whose death occurred at his residence on the 16th Sept. Last, in the seventieth year of his age, was the fourth son of the late Charles Horsey, Esq., of London, and was born on the 29th Sept. 1819. He was entered as a student of Gray's-inn in April 1847, where he was lecturer's prizeman in 1849, and was called to the bar in the May of the year following. He chose the side of equity, and practised for many years as an equity draftsman and conveyancer; but his career was quite uneventful. He was the author of three professional works-one on "The Trustee Act of 1850," another on "The Probate Act of 1857," and another on The Law of Property Act of 1859." Mr. Horsey married, in 1841, Miss Sarah K. M. Chaser, eldest daughter of Mr. James Mather H. Chaser, of London.

H. DYNE, ESQ.-The late Henry Dyne, Esq., solicitor, of Bruton, Somerset, who died at his residence at Bruton, on the 6th Feb., in the seventy-sixth year of his age, was the third son and tenth child of the late Edward Dyne, of Bruton, solicitor, by his marriage with Fanny,

daughter of Moulton Messiter, Esq., of Wincanton, in the same county, He was born at Bruton, on the 28th April 1814, and educated at the King's School, Bruton, under the head-mastership of the late Rev. J. H. Abrahall. He was admitted a solicitor in 1836. For many years Mr. Henry Dyne carried on first, in partnership with his late father, a large and extensive practice. He was well known and highly respected, and had the reputation of being an able and experienced lawyer. He held for many years in succession to his father the offices of clerk to the justices of the Shepton Mallet Petty Sessional Division, and clerk to the Commissioners of Taxes. He was also, to within a short period of his decease, clerk to the Shepton Mallet Highway Board, and held other honorary offices. Some few years since he took into partnership his relative Mr. William Muller, when he gradually relinquished all active participation in the business, Mr. Muller succeeding to the various appointments. Mr. Dyne was the senior member of the Somersetshire Law Society. He married, in 1852, Susan Sarah, second daughter of the late Col. Muller, formerly Lieut.-Col. of the 1st Royals and Ceylon Rifles, and secretary to the late Duke of Kent, but has left no issue. His remains were interred at Bruton on the 11th Feb. G. H. BURNHAM, Esq.-The late George Hodson Burnham, Esq., solicitor, of Wellingborongh, Northamptonshire, who died at his residence there on the 22nd March, in the sixty-second year of his age, was the eldest son of the late Mr. George Burnham, of Wellingborough, also a solicitor, by his marriage with Charlotte, daughter of Charles Harvey Hodson, Esq., of the same town. He was born at Wellingborough in the year 1828, and was educated at Rugby School. He was articled in his father's office, and was admitted a solicitor in 1850. He was a strong Conservative in politics, and was for some years churchwarden of St. Luke's. He also took an active part in the local volunteer corps from its commencement. He held the following appointments: Registrar of the County Court, clerk to the justices, clerk to Commissioners of Taxes, steward of the manors of Wellingborough, &c., and the Crown manors of Raunds, Rushden, Irchester, Chelveston, and Higham Ferrers, clerk to the burial board, and clerk to the Governors of the Wellingborough Grammar Schools; he was also a commissioner to administer oaths.

H. S. CHINN, Esq.-The late Henry Sinclair Chinn, Esq., solicitor, of Lichfield, who died at his residence in the Cathedral close of that city on the 11th Jan., in the fifty-sixth year of his age, was the eldest son of the late Thomas Butler Chinn, Esq., proctor, of Lichfield, by his marriage with Miss Eliza Tippett Nelson, daughter of Richard Alexander Nelson, Esq., of Somerset-place, London, formerly secretary to the Navy Board. He was born at Lichfield in the year 1834, and was educated at Winchester. He was admitted a proctor in 1856, and a solicitor after the passing of the Act in 1857. He held several local public appointments, but his career was uneventful. He was for several years in partnership with Mr. Sinkler Chinn. He married, in 1864, Frances Alice Griffith, daughter of John Delane Griffith, Esq., by whom he has left three sons and a daughter. His remains were interred at the Cathedral close on the 15th Jan.

W. G. TAYLOR, ESQ.-The late William Grimwood Taylor, Esq., solicitor, of Derby, who died at 83, Friar-gate, in that borough, on the 11th Feb., in the eightieth year of his age, after a short illness, from an attack of bronchitis, was the eldest son of the late Samuel Taylor, solicitor, of John-street, Bedford-row, London, by his marriage with Miss Rose Barnard, of Kirby, Essex. He was born at his father's house in John-street, in the year 1810. He was admitted a solicitor in 1832, and practised in London until 1857, when he went to Derby and joined Mr. J. J. Simpson in the business formerly carried on under the style of Simpson and Frear. Subsequently he was joined by his only son, Mr. A. Grimwood Taylor, M.A., who now is the sole survivor in the business. Mr. Taylor was a leading member of the Derby Law Society, of which he acted as president last year. His loss is much regretted throughout Derby and the neighbourhood. He married, in 1847, Miss Anne Whitear, daughter of the Rev. William Whitear, of Starston, Norfolk, by whom he has left issue, in addition to his son, one daughter. His remains were interred at the Nottingham-road Cemetery, Derby, on the 15th Feb., the preliminary portion of the service having previously been read at St. Werburgh's parish church.

W. MARSHALL, ESQ.-The late William Marshall, Esq., solicitor, of Ely, Cambridgeshire, who died at his residence, Hill House, in that city, on the 4th Feb. last, in the seventy-fifth year of his age, was the eldest son of the late William Marshall, Esq., also a solicitor of the same place, by his marriage with Ann, daughter of John Crossley, Esq., of Ely, sister of the present James Crossley, Esq., J.P. He was born at his father's residence in the year 1815, and was educated at a private school at Allingham, Norfolk, He was admitted a solicitor in Michaelmas Term 1836, and was one of the last survivors of those who entered the Profession before the accession of Her Majesty. He was appointed, in 1845, whilst still a young man, coroner for the Isle of Ely, which post he resigned only a short time ago, having held it for forty-four years. He was a perpetual commissioner for oaths, and for many years held many offices, being clerk to the Local Board of Health for the entire Isle of Ely. His knowledge of the system of drainage of the Fens was unique; and it was he who, with the late Dean Peacock, pressed forward the sanitary improvements in the city of Ely, which was a pioneer city in such matters. He was also one of the eldest members of the Solicitors' Benevolent Association. Mr. Marshall married, first, in 1844, Miss Phoebe Andrews Cropley, daughter of Edward Cropley, Esq., who died in 1849; and secondly, in 1853, Julia, daughter of the Rev. Phillip Durham, Vicar of Witchford, and minor canon of Ely Cathedral, who died in 1883. He leaves no issue by either union. His remains were interred at the Cemetery, Ely, on the 8th Feb.

J. C. DOHERTY, ESQ.-The late John Canning Doherty, Esq., of Vernon House, Weston Park, Bath, who died at the Burlington Hotel, Corkstreet, London, on the 22nd Jan. last, was the eldest son of the late Right Hon. John Doherty, sometime Lord Chief Justice of the Common Pleas in Ireland, by his marriage with Elizabeth Lucy, daughter of the late J. W. Wall, Esq., of Coolnamuck Court, co. Waterford. He must have been born about the year 1826, as he was admitted a student of the Middle Temple in 1847, and was called to the bar by that society in Michaelmas Term 1850. He held for many years the post of district registrar of the local Court of Probate for Warwickshire, when he resided at Fox Lydiate Park, near Redditch. He was also a magistrate for Worcestershire, and he assumed the additional name of Canning for a property. He was a strong Conservative in politics, and a member of the Carlton Club, and of the Kildare-street Club, Dublin, and of the Royal Yacht Squadron Club, Cowes.

C. E. ABBOTT, Esq.-The late Charles Edward Abbott, Esq., solicitor, died who at 166, Warwick-street, Pimlico, on the 9th Feb. last, in the sixtieth year of his age, was the second son of Edward Abbott, Esq., late

of Wretham and Weeting, in the county of Norfolk, and also of a solicitor in Essex. He was born in the year 1830. He was admitted 1852, Trinity Term, and practised for some years at 52, Lincoln's-innfields.

R. O'BYRNE, Esq.-The late Robert O'Byrne, Esq., barrister-at-law, of Lincoln's-inn, who died on the 12th Feb., in the sixty-fifth year of his age, was the second son of the late Robert O'Byrne, Esq., of Cabinteely, in the county of Dublin, by his marriage with Miss Martha Troughear Clark, daughter of the late Joseph Clark, Esq., of Norwich. He was born in the year 1825. He was educated at Trinity College, Dublin. He was entered as a student of Lincoln's-inn in 1856, and was called to the bar in Trinity Term of 1859. He married, in 1858, Elizabeth, second daughter of John Troughear Handy, Esq., of Malmesbury, by whom he has left a family.

A. B. TREVENEN, Esq.-The late Arthur Bingham Trevenen, Esq., solicitor, formerly of Chancery-lane, who died at 38, Holland Villas-road, Kensington, on the 8th Jan. 1890, in the fifty-sixth year of his age, was the youngest surviving son of the late James Trevenen, Esq., of Ford Park, Plymouth, in the county of Devon. He was born in the year 1835. He was admitted a solicitor in 1858, Easter Term, and having practised for some years alone in Spring Gardens, became a partner in the firm of Sandys and Trevenen, in Chancery-lane. He was also a commissioner for oaths. Mr. Trevenen, as may be gathered from his name, was connected by the ties of birth and family with the counties of Devon and Cornwall, for which his father was long a respected magistrate.

T. T. WEIGHTMAN, ESQ.-The late Thomas Turner Weightman, Esq., barrister-at-law, of the Inner Temple, who died in London on the 15th Jan. last, in the fiftieth year of his age, was the second son of the late William Weightman, Esq., of Leicester, and was born in the year 1840. He was educated at Magdalen Hall, Oxford, where he took the usual degrees; was entered as a student of the Inner Temple, in Michaelmas Term 1851, and was called to the bar by that honourable society in June 1864, when he joined the Midland Circuit. He attended for many years the Nottingham, Derby, and Lincoln Sessions, having at the same time London chambers in Hare-court, and afterwards in Harcourt-buildings, Temple. He was, however, best known professionally as the author of a work on the law and practice of the Bankruptcy Court, entitled "A Handbook of the Bankruptcy Act." He married, in 1874, Emma Sophia, only daughter and heiress of the late James Rawson, Esq., of Leicester.

C. F. M. MUNDY, Esq.-The late Charles Francis Miller Mundy, Esq., barrister-at-law, of the Inner Temple, who died at 187, High-street, Harlesden, Middlesex, on the 7th April last, in the thirty-sixth year of his age, was the only son of the late Lieut. Gen. Charles Fitzroy Miller Mundy, a member of the family of Mundy, of Shipley Hall, in the county of Derby. He was born in December 1854. He was educated at Trinity College, Cambridge, of which he was elected a scholar, and where he graduated B.A. in 1878, obtaining a second class in the Classical Tripos. He was entered as a student of the Inner Temple in November 1875, and was called to the har there in May 1882.

R. G. ARBUTHNOT, Esq.-The late Robert George Arbuthnot, Esq., barrister-at-law, of the Inner Temple, who died at 9, Hyde Park Gate, on the 19th March last, in the forty-seventh year of his age, was the fourth son of the late Archibald Francis Arbuthnot, of London (who died in 1879), by his marriage with the Hon. Gertrude Sophia Gough, daughter of F. M. Hugh, first Viscount Gough. He was born on the 1st May 1843, and was educated at Eton; he was elected to a Scholarship at Trinity College, Cambridge, where he obtained one of the Declamation Prizes, and graduated B.A. in 1865, in which year he was also entered as a student at Lincoln's-inn. He migrated, however, to the Inner Temple, where he was called to the bar in June 1868, and joined the South-Eastern Circuit. He had acted since 1879 as a revising barrister for Surrey; and he was known in the profession as joint editor of Smith's Leading Cases. He married, in 1884, Helen Mary, daughter of Sir William Muir, K.C.S.I., by whom he has left issue.

A. MYBURGH, Esq.-The late Alexander Myburgh, Esq., barrister-at law, of Shanghai, China, who died at Cliftonville, Kent, on the 30th July last, in the forty-second year of his age, was the sixth son of Mr. Francis Gerard Myburgh, a gentleman in high civil service employ at the Cape of Good Hope. He was born in July 1849, and took the degree of Bachelor of Laws at Trinity Hall, Cambridge, in 1870. entered as a student at the Inner Temple in May 1848, and was called to the bar by that society in May 1871. He went out to the East while still quite a young man, and practised for many years before the Supreme Court of China and Japan; after some years he was appointed Crown Advocate; and latterly had been chairman of the Municipal Council at Shanghai.

E. B. DAWSON, Esq.-The late Edgar Bennett Dawson, Esq., barristerat-law, whose death occurred on the 28th Feb. last, being lost in the wreck of the steamship Quetta, off Torres Straits, in the twenty-fifth year of his age, was the sixth son of William Hill Dawson, Esq., of St. Leonard's, Tooting, Surrey, and Mary his wife. He was born in 1865, and was educated at Trinity College, Cambridge, where he took his Bachelor's degree in 1887. He had been called to the bar little more than a year, and his death has carried off a young man of great early promise.

W. R. S. RALSTON.-The late William Ralston Shedden Ralston, Esq., barrister-at-law, of the Inner Temple, who died at 11, North-crescent, Chenies-street, Bloomsbury, on the 25th Aug. 1889, in the sixty-first year of his age, was the only son of the late William Patrick Ralston Shedden, Esq., of Brighton, and was born in the year 1828, and took his B.A. and M.A. degrees at Trinity College, Cambridge. In early life he held an appointment in the British Museum, but in Jan. 1850 entered himself as a student at Lincoln's-inn, but migrated to the Inner Temple, where he was called to the bar in Jan. 1862. He did not, however, actively follow his profession, but devoted himself to the study of art and literature, and he had gained some repute as a lecturer on the folklore of ancient peoples, and especially of foreign countries.

C. WHITLAW, Esq.-The late Charles Whitlaw, Esq., barrister-at-law, of the Middle Temple, who died in London on the 13th April last, in the forty-ninth year of his age, was the eldest son of the late Charles Whitlaw of Taplow, in the county of Bucks. He was born in the year 1841, was entered as a student at the Middle Temple in Michaelmas Term 1863, and was called to the bar by that Inn in Jan. 1869.

C. R. BATE, Esq.-The late Mr. Charles Robert Bate, conveyancer, of Bridgwater, who died on Sunday the 23rd March, in the fifty-fifth year of his age, was the last surviving son of the late Mr. Robert Bate, of Hill Grove, Wemdon, Somerset, by his first marriage. He was educated first at Trinity College, Cambridge, and afterwards at Trinity College,

Dublin; he was also a member of Lincoln's-inn, but practised below the bar. He had a good and extensive conveyancing practice of old family standing, and was much respected. He was an able and zealous member of more than one Rifle Volunteer Corps, and an active member of the local Masonic body. He married, in 1866, Miss Kate Augusta Reed, daughter of the late Mr. Henry Reed, solicitor, by whom he has left a son, Mr. L. B. Bate, now of Exeter College, Oxford.. Mr. Bate's remains were interred in the churchyard of Wemdon, on the Thursday following his decease.

A. W. SIMPSON, Esq.-The late Alfred Walker Simpson, Esq., barristerat-law, of Lincoln's-inn, and Recorder of Scarborough, whose death occurred from a sudden attack of paralysis on the 5th April, at his residence in that town, was the second son of the late Alfred Simpson, Esq., solicitor, of New Malton, Yorkshire, and was born on the 6th April 1823, so that if he had lived to the following day, he would have completed his sixty-seventh year. He was educated at Jesus College, Cambridge, where he took the usual degree of Bachelor of Arts in 1846, when he won a first class in classics, being at the same time 26th wrangler. He was afterwards elected to a fellowship, and took his Master's degree in 1849. He had already, in 1846, entered himself as a student at Lincoln's-inn, but migrated thence to the Inner Temple, where he was called to the bar in Michaelmas Term 1849. He joined the North-Eastern Circuit, on which he soon obtained a good practice, especially at the North Riding and York City Sessions. He was appointed Recorder of Scarborough in 1872, and was elected a Bencher of the Inner Temple in 1881. He was a magistrate for the North Riding of Yorkshire.

W. R. DAVIES, Esq.-The late William Rees Davies, Esq., solicitor, of Frederick's-place, Old Jewry, who died at Bridgend, Glamorganshire, on the 28th April last, in the forty-first year of his age, was the only son of John Davies, Esq., J.P., of Brecknock Villa, Bridgend, by his marriage with Elizabeth, daughter of William Greathead, Esq., of Yarm, Yorkshire, and nephew of William Davies, Esq., M.P. for Pembrokeshire. He was born at Brecon in the year 1850, and was educated at New College, Clifton, under C. T. Hudson, Esq. He was admitted a solicitor in 1871, and was appointed, in 1875, a commissioner to administer oaths. He was for some years the indefatigable secretary of that excellent institution, the General Lying-in Hospital, Bridgend, which office he resigned some time before his death. Mr. Davies lived and died unmarried. His remains were interred at the Machpelah Cemetery, Haverfordwest, on the 3rd May.

House of Lords, deferred making a speech upon it, reserving what he had to say until the day before yesterday (Thursday). Lord ESHER rightly appreciates the position. He has probably read with attention all that has been said about the abuses of our judicial system, and we are glad that it should have been reserved for him to expose them to the public eye in the august Chamber, where the law receives its final interpretation. There

is no living judge to whom the Profession owes more than it owes to Lord ESHER; there is no other judge to whom it could look with greater confidence in the critical time through which it is now passing.

LORD ESHER announced his intention of moving for a special commission to investigate abuses, with a view to the application of the appropriate remedies. It may confidently be expected that both Lord HALSBURY and Lord HERSCHELL will support this proposal. We have already pointed out that this is the only course to be adopted; the whole truth cannot be known without it. The LORD CHANCELLOR gave his hearty approval to Mr. FINLAY'S Bill. That is not enough, because the Bill in its present form is a very small measure of reform. We shall watch with some interest, the course taken by Lord COLERIDGE, upon whose shoulders has rested for some years the whole responsibility of regulating business in the Queen's Bench Division.

WITH regard to a paragraph that appeared in our last week's number, in which we referred to a case tried at Worcester Assizes, when Mr. Justice CAVE allowed a prisoner who had pleaded guilty to a charge of rape, and had been sentenced, to withdraw his plea and plead not guilty, the result being that he was acquitted, we have received a communication from a correspondent, who states he was present at Chester Assizes some few years ago, where a somewhat similar state of things occurred. A prisoner was tried before Mr. Justice STEPHEN for embezzlement, and, after a careful defence by counsel, was found guilty and sentenced to eighteen months' imprisonment. As the prisoner was being removed to the cells, he called out that he wished to ask one of the witnesses certain questions. Mr. Justice STEPHEN allowed the prisoner to stand back. The witnesses were recalled and cross-examined by the prisoner himself as to certain facts which were not present to the mind of his counsel, and Mr. Justice STEPHEN then asked the jury if their previous verdict of guilty was correct or not. The jury came to the conclusion that their verdict was incorrect, and the prisoner was acquitted. The above facts appeared shortly afterwards in an article in the Nineteenth Century by Mr. Justice STEPHEN, on the subject of prisoners being allowed to give evidence in their own defence.

THE Trustee Appointment Bill is remarkable among the Bills of the present session by its having a good prospect of becoming law. It was read a third time and passed the House of Lords on June 30, and it was read a second time in the House of Commons on July 7. Its main purpose is to apply the Act of 1850 (13 & 14 Vict. c. 28), the object of which is "to render more simple and effectual the titles by which congregations and societies for purposes of religious worship or education in England and Ireland hold property," to any land acquired by trustees in connection with any society or body of persons comprising several congregations or other sections or divisions or component parts associated together for any religious purpose. The land must be held in trust for one of six purposes, these being (1) a place for religious worship; (2) an endowment or provision for the maintenance of a place of religious worship or the minister thereof, or provision for expenses connected therewith; (3) a burial ground; (4) a place for education and training of students, whether for the ministry or for any other purposes; (5) a school-house for a Sunday school, day school, or other school; and (6) a residence for a minister or schoolmaster, or for the caretaker of a place of religious worship, or of a school-house or a meeting-house, or offices or other buildings for or in connection with religious or educational purposes. To all cases within the Acts of 1850 and 1869 (32 & 33 Vict. c. 26), and within the Bill of 1890, the statutory powers to appoint trustees will be made applicable, and the vesting clause of the Act of 1850 will be extended. We wish the promoters of the Bill the success which their perseverance deserves, and we hope that their Bill will become an Act, and remove an admitted difficulty.

Now that the liability of directors and promoters of joint-stock companies is under the consideration of the Legislature, it would be very advantageous if, by way of set off against the increased responsibility which seems likely to be cast upon them, steps could be taken to remove the unnecessary difficulties caused by the obscure provisions of sect. 38 of the Companies Act 1867 as to the disclosure of contracts. What are the contracts which must be disclosed in a prospectus or "notice inviting persons to subscribe for shares"? Where is the line to be drawn between contracts which must, and contracts which need not be disclosed;
