KING'S BENCH ACT

Amendments to the Rules of Court

The Court of King's Bench, by virtue of the powers conferred upon it by Section 53 of "The King's Bench Act" and with the concurrence of a majority of the Judges thereof present at a meeting held this day for that purpose, hereby makes the following Amendments to the Rules of Court:

Rule 166 is hereby repealed and the following substituted therefor:

166. Sittings of the Court will be held at the Law Courts at the City of Winnipeg, except during vacation, as follows:

(a) Monday for the trial of causes, matters and issues with
or without jury;

(b) Tuesday, Divorce Petitions and Matrimonial causes;
(c) Wednesday, for the hearing of such motions and matters
other than the trial of actions or issues as may be
brought before a single Judge sitting in Court;

(d) On Monday and Thursday a Judge will sit in Chambers
for the despatch of all business that may be brought
before a Judge sitting in Chambers.

If the business is not disposed of on the day appointed for the sitting, the sitting may be continued from day to day, or the same or any Judge may take up the business so undisposed of on the following or upon any subsequent day.

Rule 203 is amended by striking out all the words after "may" in the second line thereof down to and including the word "order" in the fourth line thereof.

Rule 301, sub-rule (c), is hereby amended by striking out the word "ten" where it occurs in the third line thereof and substituting the word "twenty" and by inserting after the word "claim" in the last line thereof the words "within sixteen days after service."

Form 36 is hereby amended by striking out the words "$10" where it occurs in the last paragraph of said form and substituting therefor "$20," and by inserting after the word "claim" the words "within sixteen days after service."

305. All of Rule 305 down to and including the word "but" in the seventh line thereof is hereby repealed.

Rule 320 is hereby repealed and the following substituted therefor:

320 (1) Except as mentioned in Rules 311, 312, 313 and 314, the only pleadings in an action shall be a
