An Act to refer to the Parliament of the Commonwealth certain matters in connection with Air Navigation.

HEREAS it is Enacted by the Constitution of the Common- Preamble. wealth of Australia that the Parliament of the Commonwealth shall, subject to the Constitution, have power to make laws for the peace order and good government of the Commonwealth with respect to matters referred to the Parliament of the Commonwealth by the Parliament or Parliaments of any State or States, but so that the law shall extend only to States by whose Parliaments the matter is referred or which afterwards adopt the law: And whereas a Convention (in this Act referred to as "the Convention") for determining by a common agreement certain uniform rules with respect to international air navigation was signed on behalf of His Majesty in Paris on the thirteenth day of October, one thousand nine hundred and nineteen: And whereas it is expedient that provision should be made by the Parliament of the Commonwealth of Australia for any matter necessary or proper for performing the obligations of the Commonwealth towards the other contracting parties arising under the Convention (including every Annex thereto) or arising under any modification or amendment of the Convention. which may be made under Article thirty-four thereof, and for intercourse by aerial navigation between the State of South Australia and any other country or any State of the Commonwealth: whereas at a conference of the Premiers of the States held in May, one thousand nine hundred and twenty, it was resolved that it was desirable that each of the Parliaments of the States should refer to the Parliament of the Commonwealth the matter of the control of air navigation, subject to the retention by each of the States of certain

rights and powers specified in the resolution: And whereas in order to facilitate the carrying out of the objects of the said resolution it is expedient to provide that the matters hereinafter specified should be referred to the Parliament of the Commonwealth

Be it therefore Enacted by the Governor of the State of South Australia, with the advice and consent of the Parliament thereof, as follows:

1. This Act may be cited as the "Commonwealth Powers (Air Navigation) Act, 1921."

2. This Act shall come into operation on a day to be fixed by proclamation.

3. The following matters are hereby referred to the Parliament

1. Any matter necessary or proper for performing the obligations of the Commonwealth towards the other contracting parties arising under the International Convention for the Regulation of Aerial Navigation signed at Paris on the thirteenth day of October, one thousand nine hundred and nineteen (including every Annex thereto), or arising under any modification or amendment of the Convention which may be made under Article thirty-four thereof; and

II. Intercourse by aerial navigation between the State of South Australia and any other country or any State of the Commonwealth.

An Act to authorise the Corporation of the Town of Port Pirie to Lease as a Site for a Drill Hall a certain other Portion of the Park Lands at Port Pirie in lieu of the Portion authorised to be Leased by the Port Pirie Drill Hall Site Act, 1905, and for purposes incidental thereto.

E it Enacted by the Governor of the State of South Australia,
with the advice and consent of the Parliament thereof, as

follows:

1. This Act may be cited as the "Port Pirie Drill Hall Site Act, Short title. 1921."

2. The Port Pirie Drill Hall Site Act, 1905, is hereby repealed.

3. (1) Notwithstanding the provisions of the Municipal Corporations Act, 1890, or any other Act or law to the contrary, the hall. Corporation of the Town of Port Pirie is hereby authorised to No. 497 of 1890. lease to the Minister for Defence of the Commonwealth of Australia, for the purpose of its being used as a site for a drill hall and upon the terms and conditions hereinafter referred to, that piece of land, being portion of the Port Pirie Park Lands, described in the Schedule hereto and delineated in the plan contained in the said Schedule and therein hatched in black and marked "A."

(2) Upon the granting of a lease under this section, any lease granted under the Port Pirie Drill Hall Site Act, 1905, and in No. 893 of 1905. existence at the passing of this Act, shall expire and determine,
