their trades (in this Act referred to as minimum timerates), and may also fix general minimum rates of wages for piecework for their trades (in this Act referred to as general minimum piece-rates) and those rates of wages (whether time or piece-rates) may be fixed so as to apply universally to the trade, or so as to apply to any special process in the work of the trade, or to any special class of workers in the trade, or to any special area.

If a Trade Board report to the Board of Trade that it is impracticable in any case to fix a minimum timerate in accordance with this section, the Board of Trade may so far as respects that case relieve the Trade Board of their duty.

(2) Before fixing any minimum time-rate or general minimum piece-rate, the Trade Board shall give notice of the rate which they propose to fix and consider any objections to the rate which may be lodged with them within three months.

(3) The Trade Board shall give notice of any minimum time-rate or general minimum piece-rate fixed by them. (4) A Trade Board may, if they think it expedient, cancel or vary any minimum time-rate or general minimum piece-rate fixed under this Act, and shall reconsider any such minimum rate if the Board of Trade direct them to do so, whether an application is made for the purpose or not;

Provided that the provisions of this section as to notice shall apply where it is proposed to cancel or vary the minimum rate fixed under the foregoing provisions in the same manner as they apply where it is proposed to fix a minimum rate.

And whereas by Section 5 of the said Act it is amongst other things provided:

(1) Until a minimum time-rate or general minimum piece

rate fixed by a Trade Board has been made obligatory by order of the Board of Trade under this section, the operation of the rate shall be limited as in this Act provided.

(2) Upon the expiration of six months from the date on which a Trade Board have given notice of any minimum time-rate or general minimum piece-rate fixed by them, the Board of Trade shall make an order (in this Act referred to as an obligatory order) making that minimum rate obligatory in cases in which it is applicable on all persons employing labour and on all persons employed, unless they are of opinion that the circumstances are such as to make it premature or otherwise undesirable to make an obligatory order, and in that case they shall make an order suspending the obligatory operation of the rate (in this Act referred to as an order of suspension).

And whereas by the New Ministries and Secretaries Act, 1916, (a) provision is made, amongst other things, for the transfer to the Minister of Labour of the powers and duties of the Board of Trade under the enactments mentioned in the Schedule to that Act;

And whereas the said Trade Boards Act is one of the enactments mentioned in the Schedule to the said New Ministries and Secretaries Act;

And whereas it is further provided by the said New Ministries and Secretaries Act that, where any powers and duties are transferred by virtue of the Act, the transfer is to take effect as from a date to be fixed by Order of His Majesty in Council, and that different dates may be fixed for different powers and duties;

And whereas it is provided by the Ministry of Labour (Transfer of Powers) Order, 1917, (b) that the transfer to the Minister of Labour by virtue of the said New Ministries and Secretaries Act of the powers and duties of the Board of Trade under the enactments mentioned in the Schedule to that Act shall take effect as from the 10th day of January, 1917;

And whereas a Trade Board was established by the Board of Trade under the said Act on 3rd January, 1910, for the making of Hammered and Dollied or Tommied Chain, and was constituted in accordance with the Regulations made by the Board of Trade under the said Act, and dated 25th November, 1909(c);

And whereas the said Trade Board gave notice on 22nd August, 1910, that they had fixed minimum time-rates for Handhammered Chainmaking and had also fixed general minimum piece-rates for making Short Link Hand-hammered Chain, and the rates fixed were made obligatory by order of the Board of Trade dated 23rd February, 1911(d);

And whereas the said Trade Board gave notice on 23rd November, 1910, that they had fixed general minimum piecerates for making Hand-hammered Chain (Country Branch), and the rates fixed were made obligatory by order of the Board of Trade dated 24th May, 1911(e);

And whereas the said Trade Board gave notice on 1st February, 1911, that they had fixed additional general minimum piece-rates for making Hand-hammered Chain (Country Branch), and had also fixed minimum time-rates for making Dollied or Tommied Chain and Hand-hammered Chain of the diameters more specifically set forth in the notice issued by the Trade Board and general minimum piece-rates for making Dollied and Tommied Short Link and Short Link Hand-hammered Chain of the diameters more specifically set forth in the notice issued by the Trade Board, and the rates fixed were made obligatory by orders of the Board of Trade dated 2nd August, 1911(f);

And whereas the term of office of the said Trade Board expired on 2nd January, 1913, and a new Trade Board was established in its place by the Board of Trade under the said Act on 14th February, 1913, for the said trade, and was constituted in accordance with the said Regulations, dated 25th November, 1909;(a)

And whereas the said new Trade Board gave notice on 19th January, 1914, that they had varied certain of the minimum time-rates for Hand-hammered Chain making fixed on 22nd August, 1910, and certain of the general minimum piece-rates for Hand-hammered Chain making fixed on 22nd August, 1910; 23rd November, 1910; and 1st February, 1911, and also certain of the minimum time-rates for making Dollied or Tommied and Hand-hammered Chain and certain of the general minimum piece-rates for making Dollied or Tommied Short Link and Short link Hand-hammered Chain fixed on 1st February, 1911, and the rates as varied were made obligatory by order of the Board of Trade dated 20th July, 1914. (b)

And whereas the term of office of the said Trade Board expired on 14th February, 1916, and a new Trade Board was established in its place by the Minister of Labour under the said Act on 3rd April, 1917, for the period of four years and thereafter until dissolved by order of the Minister of Labour, and was constituted in accordance with the Regulations, dated 22nd September, 1916, (c) made by the Board of Trade in substitution for those dated 25th November, 1909.

And whereas the said new Trade Board gave notice on 22nd October, 1917, that they proposed to vary the minimum timerates for Hand-hammered Chain making fixed on 22nd August, 1910; and varied on 19th January, 1914, and the general minimum piece-rates for Hand-hammered Chain making fixed on 22nd August, 1910; 23rd November, 1910; and 1st February, 1911, and varied on 19th January, 1914, and also the minimum time-rates for making Dollied or Tommied Hand-hammered Chain and the general minimum piece-rates for making Dollied or Tommied Short Link and Short Ling Hand-hammered Chain fixed on 1st February, 1911, and varied on 19th January, 1914.

And whereas, after considering the objections lodged with them, the said Trade Board gave notice on 1st March, 1918, that they had varied the minimum time-rates and the general minimum piece-rates fixed for the said trade, and the rates as varied are set out in the Schedule hereto;

Now, therefore, I, the Right Honourable G. H. Roberts, M.P., Minister of Labour, in pursuance of the powers in me vested, as before recited, do by this Order make the said minimum timerates and the said general minimum piece-rates, as varied by the said Trade Board and set out in the said Schedule hereto, obligatory in cases in which they are applicable on all persons

employing labour and on all persons employed in the said branches of the trade.

Schedule.

I.—MINIMUM RATES, AS VARIED, FOR MAKING HANDHAMMERED CHAIN UP TO AND INCLUDING 1-INCH DIAMETER.

(i) MINIMUM TIME RATES.

Section I.-The minimum or lowest time-rate for making from iron supplied by the employer Hand-Hammered Chain up to and including inch, shall be as follows, clear of all deductions:(a) Where the employer provides (in addi

LEARNERS.

Section II.-(a) In lieu of the above rates "learners" (as hereinafter defined) who are in the first six months or the second six months of employment as learners (and no other persons) shall receive the following minimum or lowest time rates clear of all deductions, that is to say:

(1) During the first six months of employment... 5 10 (2) During the second six months of employment 8 0 (b) For the purposes of the above rates learners are persons

who:

(1) Are definitely and effectively employed in the practical learning of the trade under an agreement in writing and have not been definitely employed in learning the trade more than two years;

(2) Are under 17 years of age;

(3) Are working on the terms of having the workshop and
the tools and the fuel provided by the employer;
(4) Hold a certificate from the Trade Board issued on an
application made prior to the commencement of the

employment or within such period thereafter as the Trade Board may in any case or class of cases allow. Provided always that in granting or withholding such certificate the Trade Board may take into consideration whether, having regard to the number of learners employed in any factory or workshop or under any journeyman or worker, the learner proposed to be certificated has a reasonable prospect of receiving due instruction. Provided also that any certificate may be withdrawn if the Trade Board consider that the conditions of employment have ceased to be such as would have originally justified the grant thereof.

(ii) GENERAL MINIMUM PIECE RATES.

The General Minimum Piece Rates for making Hand-hammered Chain shall be as follows:

For Making Hand-hammered Chain from iron supplied by employers, the minimum rates shall be for every cwt. of such chain as follows, clear of all deductions, that is to say:

In the case of Commonest quality Hammered Chain, if the number of links per foot is one or two less than is specified in column 2 of the above Table, the rate as for Short Link Chain shall apply, except that Commonest Chain of Sizes Nos. 9 or 10 containing 25 links or more per foot shall be paid for as Short Link.

B.-COUNTRY BRANCH.

The piece-rates as specified below for this Branch are on the basis of chain of "commonest " finish or workmanship. Chain of "common" finish or workmanship in Sections I, II, and IV, shall be paid for at a rate 10 per cent. higher. The general minimum piece-rates in this Branch do not apply to qualities higher than common."
