39. The officers of any agricultural society may, by their Gambling and rules, prohibit and prevent all kinds of gambling, theatrical, formances circus or mountebank performances, and also regulate or may be prevent huckstering or trafficking in fruits, goods, wares or merchandise, on the exhibition grounds or within five hundred yards thereof; and any person who, after due notice of such rules and regulations, violates the same shall be liable to be removed by the officers or constables of such society, and be subject to the penalty prescribed by the next preceding section. 43. CHAPTER 3.

An Act respecting the Encouragement of Agriculture.

WHEREAS HIS MAJESTY, by and with the advice Preamble.

and consent of the Senate and House of Commons of Canada, has empowered the Governor-in-Council to grant to any Province certain sums of money, by way of subsidy for the encouragement of agriculture, and empowered the Minister of Agriculture, with the authority of the Governorin-Council, to enter into an agreement with the Government of any Province, setting forth the terms upon which such subsidy is to be granted and prescribing the conditions under which and the purposes for which it shall be expended,

Therefore His Majesty, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as follows:

An Act respecting the Department of Agriculture and
Immigration.

SHORT TITLE.

1. This Act may be cited as "The Agriculture and Immigration Act." R.S.M. c. 2, s. 1.

INTERPRETATION.

2. In this Act, unless the context otherwise requires(a) the expression "Department" means the Department of Agriculture and Immigration;

(b) the expression "Minister" means the Minister of Agriculture and Immigration;

(c) the expression "inspector" means the inspector of agriculture, statistics and health;

(d) the expression "officers," when applied to the officers of agricultural societies, includes the president, vice-president, directors and secretary-treasurer of any such society. R.S.M. c. 2, s. 2.

ORGANIZATION, OFFICERS AND FUNCTIONS OF DEPARTMENT.

3. There shall be a Department of the civil service of Manitoba, to be called the Department of Agriculture and Immigration, over which the Minister of Agriculture and Immigration for the time being, appointed by the LieutenantGovernor under the great seal of the Province, shall preside; and the Minister shall hold office during pleasure, and shall have the management and direction of the Department. 7. The Lieutenant-Governor-in-Council may appoint an Inspector, his officer to be known as the inspector of agriculture, statistics and health, whose duty it shall be to inspect public hospitals and other institutions receiving aid under "The Charity Aid Act," or any amendments thereto, the offices of municipal clerks, of secretary-treasurers of agricultural societies, of joint stock companies, and of other persons and corporations required to make returns to the Department; to see that they keep the books required by law and that they discharge the duties imposed upon them; and, generally, to see to the observance of the provisions of the statutes relating to matters under the control of the Department. The inspector shall have the power to subpoena witnesses, to take evidence upon oath in regard to such inspection, and to demand and enforce the production of any books or papers necessary to enable him to pursue his investigations; and any person refusing to obey such subpoena or demand shall be liable to a fine of one hundred dollars. 8. The Lieutenant-Governor-in-Council may at any time Other officers. appoint such other officers, clerks or servants as may be required to carry on the business of the Department, all of whom shall hold office during pleasure; and the salaries to be paid them shall be fixed by order-in-council.
