BLACKBURN AND DISTRICT.-On Tuesday, the 18th inst., the Blackburn law students held a joint debate with the Bolton law students, in the Grand Jury Room, Town Hall, Bolton. There was a large attendance of members of both societies. Mr. F. W. Coope, solicitor, Bolton, presided. The subject of the debate was as follows: "Mr. H., a business man, making by his personal exertions a large income, about fifty years of age, and in good general health, purchases at the shop of Mr. B. a dose of phenacitine, as a cure for headache. Within an hour of taking it he dies, poisoned by strychnine. The dose was served out of a bottle supplied to Mr. B. by Messrs. W., ordered as and labelled 'Phenacitine,' which is a harmless and non-poisonous drug. After Mr. H.'s death it was found that the contents of the bottle consisted of phenacitine mixed with about 30 per cent. of strychnine. Mr. B. had ordered at the same time, from Messrs. W., a bottle of strychnine for making up vermin killer; part of the contents of the bottle supplied in accordance with this order, and duly labelled 'Strychnine' and 'Poison,' were unused, and, on being analysed, were found to consist of phenacitine only. The contents of the two bottles had therefore somehow become mixed, but how was not very clear. Can Mr. H.'s executors sue either Mr. B., the chemist, or Messrs. W., the wholesale druggists, or both, for damages? The affirmative was taken · by the Blackburn Society, for whom Mr. F. Hindle, jun., and Mr. J. Sharples led. The Bolton Society took up the negative side of the question, and their leaders were Messrs. Stubbs and Greenhalgh. Five or six members on each side took part in the debate, and the Chairman gave his decision in favour of the Blackburn Society, holding that the retail chemist and the wholesale druggists were respectively responsible in damages. After the debate the Bolton Society entertained the Blackburn Society to dinner. In BRADFORD.-A meeting of this society was held on the 19th inst. the absence of an honorary member, Mr. J. Greaves presided. Mr. A. Maguiness moved: "That the clause in the prospectus of a company whereby sect. 38 of the Companies Act 1867, is waived is valid." He was supported by Mr. F. A. Mossman, and opposed by Messrs. H. Hammond and F. W. G. Bolton. Messrs. J. W. Barraclough, H. M. Dawson, W. Dunn, J.H. Heap, R. J. Last, and J. W. Perkins also spoke. The vote being five for and five against the motion, the Chairman gave his casting vote in its favour. LEEDS.-The fourteenth meeting of the session was held on Monday, the 24th inst., in the Law Institute, Albion-place, Leeds; Mr. John Bowling in the chair. Mr. R. A. Shepherd, M.A., B.C.L. (barrister-at-law), delivered the second of a series of three lectures on the law of Landlord and Tenant. He dealt in a most exhaustive manner with the following branches of the subject: covenants, assignments, attornment clauses, fixtures, and surrenders. The Chairman moved, and Mr. G. Whittington seconded, a vote of thanks to the lecturer, which was unanimously carried. Upon the motion of Mr. Shepherd, seconded by Mr. G. E. Foster, a similar compliment was paid to the chairman. NOTTINGHAM.-The annual dinner of this society was held at the George hotel, on the 18th inst., when Mr. J. T. Perry (the president) took the chair, There and Mr. J. C. Warren (the ex-president) occupied the vice-chair. were also present: The Sheriff of Nottingham (Councillor J. Wright), Mr. C. G. Hill, J.P., Mr. E. H. Fraser, J.P., and Messrs. J. W. Hind, Tinsley Lindley, J. A. Simpson, F. Berryman, J. B. Sharp, H. Hanson, C. A. Barker, O. W. Hind, E. W. Hendy, L. Bramley, Curzon, Popham, H. Smith, P. Wood, A. B. Littlewood (vice-president), P. J. Smith (hon. treasurer), and Frederick Allcock and E. B. Stocker (hon. secretaries).— The Chairman, in proposing the toast of "The Nottingham Law Students' Society," observed that the society was of great use to all members of the Profession if they would avail themselves of its advantages, and he would arge all solicitors and articled clerks who were not already members to become such as soon as possible.-The vice-president (Mr. A. B. Littlewood), in reply, said that the financial position of the society was very good indeed. Mr. L. Bramley proposed "The Nottingham Incorporated Law Society." The prizes kindly offered by the Incorporated Law Society to articled clerks who attained a certain position in the honours list must act as an incentive to all to do their best at the examinations and so reflect credit on that society.-Mr. J. C. Warren, in reply, said that it might not be known to all that the Nottingham Incorporated Law Society was the child of the Law Students' Society, and he was pleased to see both parent and child in so prosperous a condition and on such good terms as they were at present.--" The Bench and the Bar " was proposed by Mr. E. B. Stocker (hon. secretary), who remarked that they were to be congratulated on having in Nottingham so able a County Court judge as the society's honorary president, Judge Masterman. Mr. Tinsley Lindley responded.Mr. Frederick Allcock proposed "The Town and Trade of Nottingham," coupling with it the name of the Sheriff.-The Sheriff, in reply, said that undoubtedly they were all proud of their old town, and for his part, although he had some time ago gratified what was the great ambition of his early days and has visited the "City of the Caesars," he greatly preferred Nottingham to Rome as a residential town. He was, as they all knew, a builder, and he did think that at present the building trade was about as flourishing as any trade in Nottingham. He was afraid that even this prosperity had its drawbacks, but trusted that the good feeling which should exist between masters and men would remain undisturbed. The lace trade had, in his opinion, been rather a curse than a blessing to the town, as the high wages once paid in that trade had aroused jealousy and dissatisfaction in the workpeople generally, and had often resulted in annecessary strikes not only in the lace trade but in other branches of industry. Mr. E. H. Fraser, J.P., proposed "The health of the chairman and vice-chairman," who acknowledged the compliment.-Other toasts followed.-The Waring Glee Quartette were engaged to sing, and Mr. J. B. Lyddon to accompany, and Messrs. J. A. Simpson, E. W. Hendy, and E. B. Stocker also entertained the company with songs, &c. v. CARDIFF Reg. Lewis (Stipendiary Bassano v. London: HORACE COX, Windsor House, Bream's-buildings, E.C. The Law and the Lawyers. THE rumour prevalent in Court and official circles that Princess BEATRICE Will in the near future be elevated to the Peerage as DUCHESS of KENT, calls attention to the fact that no political privilege whatever attaches to the younger children of the Sovereign, whose legal status is merely that of commoners. "As the law of England," writes Mr. FREEMAN, "knows no classes of men except peers and commoners, it follows that the younger children of the King -the eldest is born Duke of Cornwall-are in strictness of speech commoners, unless they are personally raised to the peerage. I am not aware that either case has ever arisen, but I conceive there is nothing to hinder a king's son, not being a peer, from voting at an election or from being chosen to the House of Commons, and I conceive that, if he committed a crime, he would be tried by a jury. Mere precedence and titles have nothing to do with the matter, though probably a good deal of confusion arises from the very modern fashion-one might almost say the modern vulgarism -of calling all the children of the king or queen 'princes and 'princesses'' (Freeman's Growth of the English Constitution, p. 198, note.) 15 1876 1891 Re BOWES: EARL OF STRATHMORE v. AN unambitious, but most necessary, bit of legislation is It is a Bill brought forward by the LORD CHANCELLOR. designed to stop the publication of evidence involving indecent details in trials in legal tribunals. A power is proposed to be given to the presiding judge to prohibit publication, and disobedience of his order is to be a contempt of court. The Daily Chronicle doubts whether this project will work. Judges doubtless may differ in their views as to what is fit for publication. This is of no consequence. There is a risk that they may shrink from putting such a law into operation. We fail to see how the Press can complain in any view, for, prohibited or not, the indecency ought not to appear in print. MR. JUSTICE CHARLES, in his charge to the grand jury at the Westmorland Spring Assizes 1895, said they should consider the question whether some means might be devised for obviating the necessity of the attendance of grand jurors and petty jurors at assizes when there was nothing to do.. |
