An Act to provide for the Mortgaging of Institutes in certain cases, to validate existing Mortgages, and to provide for the Exemption of Institutes from Local Taxation.

[Assented to, December 23rd, 1898.]

E it Enacted by the Governor, with the advice and consent of the Parliament of South Australia, as follows:

BE

1. This Act may be cited as "The Institutes Mortgage Act, Short title and 1898," and shall be incorporated with the "Public Library, incorporation. Museum, and Art Gallery Act, 1883-4," "The Public Library, Museum, and Art Gallery Act, 1885," and "The Institutes Amendment Act, 1888."

2. In all cases where no express provision to the contrary is Power to raise funds contained in the trust deed of any institute, funds may be raised by by mortgage. mortgage of all or any part of the real estate of such institute for the purpose of erecting buildings on such land, or of making substantial and permanent additions to any buildings on such land, or of redeeming any mortgage thereon.

3. The mortgage shall be executed by the trustees of the Trustees to execute institute in whom such real estate is vested, and may be in such mortgage. form as shall be agreed, and the receipt of the mortgagors shall be a sufficient discharge for any money lent.

4. No mortgage pursuant to this Act shall be valid unless the Consent of Minister written consent of the Minister Controlling Education shall be Controlling Education indorsed

to be obtained.

indorsed on such mortgage prior to the advance of the mortgage money; and before any such consent shall be given the Minister shall be satisfied that a resolution approving the proposal to mortgage has been adopted at a meeting of subscribers called to consider the matter and of which reasonable notice has been given.

5. A copy of every mortgage given shall be deposited by the mortgagors with the Minister Controlling Education within one month after such mortgage is executed.

6. All mortgages of institutes executed before the first day of October, one thousand eight hundred and ninety-eight, with the consent of the Minister controlling Education and of a meeting of subscribers, are hereby validated.

7. For the purpose of exempting and continuing to exempt suburban and country institutes from payment of rates to any Corporations or District Councils section 6 of the District Councils Act, No. 419 of 1887, and section 6 of the Municipal Corporations Act, 497 of 1890, shall be read and construed as if at the time of the passing of the said Acts respectively, and at the end of the paragraphs in such sections respectively beginning "Ratable property," the following words were added-"Lands and buildings belonging to and used and occupied by any suburban or country institute, but so nevertheless that any land or building or part of any land or building belonging to any suburban or country institute which shall be let and cease to be in the occupation of any such institute shall not be included in this exemption.'

An Act relating to Workmen's Wages.

[Assented to, December 23rd, 1898.]

E it Enacted by the Governor, with the advice and consent of

the Parliament of South Australia, as follows:

1. This Act may be cited as "The Wages Attachment Act, 1898," Short title and and shall come into operation on the first day of January, one thousand eight hundred and ninety-nine.

2. After the commencement of this Act no order shall be issued No order to be made by any Court, Judge, or Justice for the attachment of the wages of any clerk, servant, laborer, or workman.

3. For the purposes of this Act the word " wages" includes Meaning of "wages" wages, salary, or payment by piece-work, and any money or thing had or contracted to be paid, delivered, or given as a recompense, reward, remuneration, or consideration for any service, work, or labor rendered or done, or to be rendered or done. "Workman" means any person in any manner engaged or employed in manual labor or in work of any kind, and whether his remuneration is to be according to time, or by piece-work, or at a fixed price, or otherwise.

4. The protection afforded by this Act shall not apply to any Not retrospective. debt due or amount owing at the commencement of the said Act.

An Act to authorise the Line of Railway between the
Grange and Henley Beach.

[Assented to, December 23rd, 1898.]

E it Enacted by the Governor, with the advice and consent of the Parliament of South Australia, as follows:

1. This Act may be cited as "The Grange and Henley Beach Short title. Railway Act, 1898."

2. In this Act the word "Commissioner" means the South Definition. Australian Railways Commissioner.

Beach.

3. The line of railway between the Grange and Henley Beach, Railway between the shown on the plan of the said railway deposited in the office of the Grange and Henley Surveyor-General in Adelaide, and signed "Alex. B. Moncrieff, Engineer-in-Chief," as already constructed, is hereby authorised and declared to have been lawfully constructed.

Commissioner.

4. The said line of railway and the buildings, sidings, platforms, Line to vest in and structures connected therewith shall vest in the Commissioner, and shall be maintained and kept by him in a proper state of efficiency; and he is hereby authorised to make and erect all such other buildings, sidings, platforms, and structures as he shall deem necessary in connection with the said line of railway.

5. Trains on the said line of railway may be drawn or propelled Limit of speed. by locomotive steam engines, such locomotives to be manned by not

less than two persons, or other mechanical power at a speed of not exceeding twenty miles an hour.
