Queen's Bench Judges' Chambers on Tuesday, the 5th Jan. On other days, within the above period, applications in urgent Chancery matters may be made to his Lordship by post or personally, in which latter case the applicant should proceed to Sutton by the London, Brighton, and South Coast Railway, and thence by cab to Woodmansterne.

In any case of great urgency, the brief of counsel may be sent to the judge by book post, or parcel, prepaid, accompanied by office copies of the affidavits in support of the application, and also by a minute, on a separate sheet of paper, signed by counsel, of the order he may consider the applicant entitled to, and also an envelope capable of receiving the papers, addressed as follows:-" Chancery Official Letter: To the Registrar in Vacation, Chancery Registrars' Chambers, Royal Courts of Justice, London, W.C."

On applications for injunctions, in addition to the above, a copy of the writ, and a certificate of writ issued, must also be sent.

The papers sent to the judge will be returned to the Registrar. The address of the judge for the time being acting as Vacation Judge can be obtained on application at Chancery Registrars' Chambers, Room 136.

The chambers of Mr. Justice North will be open for Vacation Business only, from eleven to two on Thursday, the 24th Dec.; Tuesday, the 29th Dec. The Law and the Lawyers.

FROM Newfoundland comes the news of the resignation of Mr. Justice WINTER. The resignation of a judge is quite a novelty to us in England, and the causes of this learned judge's retirement are remarkable. The salaries of the Newfoundland judges have been reduced. "There had been," said the judge, "interference in the vested and established rights of the Bench, accompanied by circumstances that could not be described in a milder term than indignity." "He had entertained the hope that he might have been enabled, with the co-operation of others, to effect some desirable and very necessary improvements in the conduct of judicial business. It was with the greatest reluctance he found himself constrained he might say compelled-to abandon that hope." But most singular statement of all-he referred to "the continuous and undisguised hostility of the Government of this colony in their individual and collective capacity-a hostility which was violent and malignant, and aimed at the Bench collectively and personally." And the reason of all this it is certainly barely credible, but the learned judge affirms that this treatment is due "to the course which the court had been compelled to take in relation to matters which came before them, and directly affecting those individuals who were in power at the present time." This is a most discreditable state of affairs.

SIR JOHN WINTER returns to his practice at the Bar, but it is difficult to believe that such a damaging attack upon the Executive Government as his valedictory judicial address will fail to cause an inquiry into the grievances of the Bench.

SOME remarkable statements were made by the Rev. W. D. MORRISON and Master MACDONELL at the meeting of the Royal Statistical Society on Tuesday. The former said that no two nations classify crime in the same manner, or have the same criminal law or method of administration. He also stated that the number of habitual criminals is steadily on the increase," because penal law and administration usually aggravate the conditions which had originally made the criminal." It is satisfactory to learn from Master MACDONELL that serious crime has largely decreased of late; but it is unsatisfactory to find that there has been a large increase of statutory offences. Wickedness is dying out, but criminals are being manufactured by Parliament.

So long as there is no definite rule as to venue, cases of hardship and even injustice will arise concerning the discreIn two cases tion which the judges have regarding costs. coming before Mr. Justice HAWKINS on Tuesday last, the need of some fixed rule became painfully apparent. In the first, judgment was given for the plaintiff, but only such costs were allowed as would have been incurred had the case been tried in Carlisle. In the second, one of serious slander, counsel

for the plaintiff announced that the defendant had offered an apology and agreed to pay costs, and asked that it might be struck out of the list. The judge insisted that the jury should be sworn, and to bring the case to an end a juror had to be withdrawn. On the application for a certificate for the special jury, Mr. Justice HAWKINS refused, saying that the case ought to have been tried at Northampton, that a Middlesex special jury was a luxury, and that the plaintiff should pay for it. The imposition of a penalty for what the law allows is a little too much.

THE press criticisms upon the verdict of the jury in Stiven v. Welsford condemn it. This is bold at least a somewhat questionable course, a stay being granted. Twelve men, quite competent to take a patient's view, heard evidence for seven days, and came to a unanimous conclusion in half an hour in favour of the doctor. Armchair critics who saw none of the witnesses cannot pretend to have the necessary means of forming an opinion. If the "twelve reasonable men" rule continues to prevail in the Court of Appeal, the verdict must stand.

THE Hardwicke Society was to debate the desirability of fixing a period for judicial retirement last (Friday) evening. This old debating society is coming up abreast of the times with a rush.

THE Bar Council on Monday declared emphatically in favour of the resolutions of the Council being published. Anything like the secrecy which asphyxiates the Benchers-or, as it may be put, renders them unpopular-would have been equally fatal to the Council. Happily a far higher and wider view of the position of the Council was taken, and the Profession will be kept informed in the fullest manner of all the conclusions at which the Council from time to time arrives.

A MOTION to suspend for three months the operation of professional rules made by the Council was negatived, it being left to members to move that any particular rule should not come into operation for a definite period. Such suspension may be wise in the case of any new rule, but it is wholly unnecessary where an existing rule is declared to have the sanction of the Council.

ONE of the best instances of the absurd operation of the splitting up of the administration of the affairs of the Bar is afforded by a complaint made by several barristers to the Bar Council of their inability to use the library nearest their chambers. A member of Gray's-inn, say, has chambers in King's Bench Walk. He has no right to use any library but that of his own Inn, which is a mile away, whilst both the Temple libraries are close at hand. The complaint is referred to a committee, but why do not the Benchers of the four Inns put their heads together-if they can be collected and brought into reasonable compass within the next twelve months-and suggest a remedy?

THERE are twenty-eight trustees and members of the Committee of Management of the Barristers' Benevolent Association, and two honorary secretaries and two auditors. That makes thirty-two. If every two agreed together to raise £100 in the year, that would give £1600. Get the Inns to

give £250 apiece. Make the annual subscriptions and the donations reach £2000-little enough-and there would be a total of nearly £5000. Then the Bar need no longer blush for its benevolent funds.

LORD ROSEBERY's account, in his speech at Edinburgh, on Thursday last week, of the infinite pains taken by Mr. STEVENSON in the elaboration of his works may render it of interest to know that the novelist, although he was himself an advocate at the Scotch Bar, when gathering materials for his last work, "Weir of Hermiston," entered largely into communications with Mr. GRAHAM-MURRAY, Q.C., the present Lord Advocate, who had been his old and intimate friend, with a view of rendering his picture of the Scotch Bar and Bench, as represented by the "Lord Justice Clerk," an accurate portrayal of these institutions at the period to which the novel related.

THE utter ignorance of ordinary writers of fiction of the very first principles of jurisprudence is very striking, and might be illustrated at length. In a recently published novel by a highly distinguished author, the widow of a Duke, who is accordingly a Peeress in her own right and entitled to trial by the House of Lords on a charge of felony, is tried for murder before a judge and jury at the Old Bailey, and of course triumphantly acquitted through the exertions of a young barrister whom she subsequently married. The extraordinary knowledge evinced by SHAKESPEARE of the forms of law, and his accurate acquaintance with what Lord CAMPBELL once termed our free-masonry," form in themselves the main foundation of the theory attributing to Lord BACON the authorship of the works known as SHAKESPEARE'S

THE enormously increased facilities for rapid travelling have rendered their effects somewhat startling on the Irish Bench. Thus, Lord ASHBOURNE, the Irish Lord Chancellor, sat in Dublin on Wednesday last week as President of the Court of Appeal; was present at the meeting of the Cabinet held in London on Thursday; and was back in Dublin in his place in the Court of Appeal on Friday morning. When, at the time of the Union, the Irish Lord Chancellor, JOHN FITZGIBBON, Earl of Clare, was made a Peer of the United Kingdom, the Irish Mastership of the Rolls was made a judicial office, which it had ceased to be for half a century, merely with a view of providing an Equity Court, to render the delay in judicial proceedings, occasioned by the absence of the Lord Chancellor in England, less grievous to suitors. The union of the office of Irish Chancellor with a seat in the English House of Lords, attendance in that House at the hearing of appeals and a seat in the Imperial Cabinet, the duties appertaining to each of these positions being efficiently discharged, would only a few years ago have been a physical impossibility.

IN the proceedings before the Select Committee to inquire into the JAMESON Raid evidence will be undoubtedly adduced in support of the allegation that the soldiers participating in that raid acted under superior orders. It is noteworthy that the question how far superior orders would justify the conduct of soldiers or sailors has never been brought before the courts in such a manner as to be fully considered and determined. In the trials last July arising out of the JAMESON Raid, the ATTORNEY-GENERAL refrained distinctly on this ground from further proceedings against the rank and file of Dr. JAMESON'S force.
