expressly guarded themselves against pronouncing any opinion as to whether the testator was in fact the father of the child. Accordingly it became unnecessary to adjudicate upon the point decided below, that upon a question of disputed paternity evidence of personal resemblance between the child and his alleged father was admissible: " (L. DOCUMENTARY EVIDENCE-ANCIENT MAPS AND DEEDS.

THE Supreme Judicial Court of Massachusetts in the case of Whitman v. Shaw (44 N. E. Rep.), has decided an interesting question as to ancient maps and deeds and the general status of such maps and deeds in respect to documentary evidence. The holding of the court may be briefly summarised as follows:

1. In an action for the recovery of real estate, a map purporting to describe, among others, the tracts in dispute, was offered in evidence. The map was not dated or signed by the surveyor who made it, but from field notes and other evidence it was shown to have been made in 1818 by a well-known and skilful surveyor, long since dead. Other surveyors testified that they had used and tested the map in their own surveys, and that it was the earliest known survey of the district it purported to describe. It also appeared that it related to an actual transaction, having been made to show the abutting owners along a proposed new road. Held, that the map was admissible as an ancient map.

2. Deeds executed shortly after the map was made, conveying the tracts described therein to the corporation building the new road, were admissible as ancient deeds, for the purpose of showing that the map was made in an actual transaction.

3. The testimony of other surveyors as to their use of the map in making their own surveys, was admissible for the purpose of showing the general accuracy of the map, although none of them had surveyed the particular tracts in dispute.

4. Other maps made in 1820 and 1823 by the same surveyor, and signed by him, showing in detail certain of the lots in the vicinity of those in dispute, were admissible as showing the accuracy of the unsigned map.

5. It was no objection that the map and field notes were not produced from proper custody, when it appeared that such custody had a legitimate origin; no question being raised as to their genuineness.

6. In an action for the recovery of land, where there was no actual occupation or possession by defendants, evidence that they had paid the taxes on the ground for over twenty years was inadmissible to show adverse possession.-Albany Law Journal.

HEIRS-AT-LAW AND NEXT OF KIN. CLARKSON (Frank). Any persons claiming to be entitled to a legacy of £200 bequeathed by the will of Eleanor White, of 2, Oriel-villas, Cheltenham (who died Aug. 15. 1887), to the widow of her nephew, Frank Clarkson, or, if she should predecease the testatrix, to her son Frank Clarkson, to come in, by Feb. 1, and prove their claims at the chambers of Mr. Justice North. WHITBURN (David), who was a son of Priscilla Whitburn, of Englefield, Berks, died at Buffalo, U.S. of America, in 1852. His widow and children, or, if any or either of them are dead, all persons claiming by representation or otherwise to share in the sum of £193 19s. 2d. standing in the names of the trustees of the will of Thomas Price, to come in, by March 10, and prove their claims at the chambers of Mr. Justice Kekewich. March 11, at the said chambers, at twelve o'clock, is the time appointed for hearing and adjudicatiug upon such claims.

COMMERCIAL FAILURES AND BILLS OF SALE.-According to Stubbs' Weekly Gazette, the number of failures in England and Wales gazetted during the week ending the 19th Dec. was 153. The number in the corresponding week of last year was 192, showing a decrease of 39. The number of bills of sale in England and Wales registered at the Queen's Bench for the week ending the 19th Dec. was 185. The number in the corresponding week of last year was 180.

HARDWICKE SOCIETY.

A MEETING of this society was held on the 18th inst. in the Inner Temple Lecture Hall, 3, King's Bench-walk, Temple, the president, Mr. F. W. Sherwood, being in the chair. The subject for debate was : That in the interests of the public it is desirable that the principle of compulsory retiremant, after a given number of years' service, should be applied to the Judicial Bench in this country, due regard being had to the rights of individuals." The debate was opened by Mr. Candy, Q.C., of the Inner Temple. The opener said that no reference was made or intended to be made to the existing members of the Bench of this country, and he included in that statement the County Court Bench. The principle of compulsory retirement which he advocated was recognised in all other branches of the public service, and there ought to be some good and sufficient reason why that particular branch of the public service should be an exception to the general rule. The whole system of the Profession of the Bar was based on the assumption that perpetual motion was going on from the bottom to the top, and that as men went up from below so judges went off from the Bench. His motion, if carried into practical effect, would create a state of things which he took to be ideal that there would never be a Bench consisting entirely of judges of long standing, and that there would never be a Bench on which a majority of the judges were, so to speak, unfledged. It was in the interest of the public that what he proposed should be carried out, because it was to the public interest that everything should be done to encourage men of education and position to come to the Bar. The system of voluntary retirement had been found in practice not to answer.-Mr. Noble opposed the motion, and Mr. Copeland spoke in favour of it, suggesting that the Lord Chancellor should have Mr. power to prolong a judge in his office for five years if desirable. Guthrie, in an amusing speech, said that Mr. Candy had insisted, as he always did, on the interests of the public, but that motion was a plea for the unsuccessful members of the Bar. If it had been proposed to make some of the men who were making very large incomes at the Bar retire, the proposition would receive the assent of the House.-Several other speakers took part in the debate, and the motion was eventually carried.

SOLICITORS' MANAGING CLERKS' ASSOCIATION. THIS association, numbering between three and four hundred of the managing clerks of London, held their fourth annual dinner in the King's Hall of the Holborn Restaurant, on Thursday, the 17th inst. The president (Mr. F. Trehawke Davies) occupied the chair. It was a novel sight to see a solicitor's clerk presiding over such a gathering, supported by four of Her Majesty's judges, an array of eminent Queen's Counsel, barristers, solicitors, masters, and chief clerks. Among those present were the Right Hon. Sir F. H. Jeune, Mr. Justice Kekewich, Mr. Justice Romer, Mr. Justice Lawrance, Mr. Cozens-Hardy, Q.C., M.P., Sir W. W. Karslake, Q.C., Mr. C. M. Warmington, Q.C., Mr. Joseph Walton, Q.C., and Messrs. L. L. Pemberton, Arnold Trinder, Edward Shearme, E. Lionel Clarke, F. Ward, J. L. Martin, H. B. White, F. P. Armstrong, Rev. G. E. Stodart, Ronald Peake, Thos. Beven, A. W. Rewden, R. Hornell, L. Batten, B. Aspinall, E. S. Roscoe, F. R. M. Phillips, E. W. Martelli, E. C. Macnaghten, Chas. Burney, Selwyn Image, Boydell Houghton, and J. Macdonell.

The Chairman, in proposing "The Health of the Queen," said that he had ventured to send to Her Majesty, on behalf of the association, their congratulations on the fact that she had reigned longer than any monarch in this country, and he had received the following reply:-" Windsor Castle, 17th Dec. 1896.-Sir, I am commanded by the Queen to beg that you will be good enough to convey to the meeting of the Solicitors' Managing Clerks' Association Her Majesty's best thanks for the kind expression of their congratulations and assurances of loyalty which were contained in your letter to me of yesterday. I have the honour to be, Sir, your obedient servant, ARTHUR Bigge.”

Sir Francis Jeune, who proposed the toast of the evening, said that when the managing clerks, standing as they did midway between the great body of clerks of the Legal Profession and the solicitors, felt that they formed a sufficiently distinct body to be justified in making an association for the protection of their common interests and for their mutual advantage an association that would not encroach, on the one hand, on the United Law Clerks' Society, which was a benefit society, nor, on the other hand, on the Law Institution, which had about it elements of education and of discipline-hardly anyone could have expected that within

three years this association would number more than three hundred members, would have established more than the foundation of an excellent law library, would have obtained for itself a settled home, and would have put its finances in an exemplary condition. It was the duty of every member of the Legal Profession, in all its branches, to support this society, because it was to the Legal Profession alone that the managing clerks could look for an adequate recognition of their services. Solicitors especially would gladly welcome an association which did so much for the advancement and improvement of those upon whose labours they must to so large an extent depend. Barristers also appreciated the services of the managing clerks. Speaking from his own experience as a judge, he had every reason to appreciate the work of the managing clerks by whom was conducted so much of the interlocutory business in important cases. As to the Chancery Division, he did not profess to know all that went on in those mysterious penetralia. But he knew that in those chambers large sums were paid into court, of which a small part was misspent some years ago in the erection of the Courts of Justice, and of which other parts ware distributed among as many claimants as could be found, with costs on a scale which proved the inherent superiority of equity over the common law. He might say that it was the managing clerks who accumulated and distributed the honey of that hive without consuming any of it themselves.

The Chairman responded to the toast, pointing out that probably for the first time in history a lawyer's clerk was in a position of dividing four of Her Majesty's judges, and, at the same time, of bringing them together. He said that much of the success of the association was due to its officers; and he paid a high compliment to Mr. Joseph Wright, the treasurer, Mr. Alfred Turner, the secretary, and Mr. Offer, the librarian.

Mr. Edward Cairns, vice-president of the society, proposed the health of "The Judges," to which Mr. Justice Kekewich and Mr. Justice Lawrance responded.

The other toasts were "The Bar and the Legal Profession," "Our Guests and Visitors," "The Officers," and "The Chairman."

Miss Mary Chatterton played a selection of harp solos during the dinner, and after the dinner there were some excellent songs and recitations. The meeting closed about half-past eleven-everybody appearing to have thoroughly enjoyed themselves.

STUDENTS' SOCIETIES.

BURNLEY AND DISTRICT.-On Thursday, the 17th inst., the sixth ordinary meeting of the members of this society was held in Cronkshaw's hotel. Mr. T. H. Roberts, solicitor, presided, and there were also present, Messrs. R. Baldwin, J. C. Pollard, T. E. Rodgers, Richard Whittingham (solicitors), and Messrs. T. Backhouse, J. Bracewell, H. Ogden, J. K. Pickup (secretary), R. M. Prescott (town clerk, Nelson), A. Riley, F. Roberts, A. Shaw, and Walter F. Sutcliffe (articled clerks). The subject for discussion was as follows: 66 A. sells a quantity of cotton cloth, used by Orientals for making into shirts, to B., a merchant in Manchester. A. delivers the cloth, and it is examined by B., who accepts the same, and pays for it. At that time the cloth appeared to be all right. B. sells the cloth to C., who carries on business as a merchant in London and Egypt C. ships the cloth to Egypt. In consequence of some mistake in the chemical composition of the size used by A. in finishing the cloth, the effect of the heat of Egypt upon the cloth is that it becomes rotten and useless. Has C. any remedy against B. or A., and, if against B., has he (B.) any remedy against A. ?" Mr. J. C. Pollard argued in the affirmative, read sect. 14, sub-sect. 1, of the Sale of Goods Act 1893, and quoted Jones v. Just, Turner v. Mucklow, Randall v. Newson, and Jones v. Bright. He contended that the cloth was manufactured for a specific purpose, and by law must be reasonably fit for that purpose, and that on the authority of Randall v. Newson there was no exception in the case of latent undiscoverable defects. He was supported in his arguments by Messrs. R. R. Baldwin, H. Ogden, J. K. Pickup, F. Roberts, and W. F. Sutcliffe, Mr. R. M. Prescott (town clerk, Nelson) argued that no action could be successful against B. which was brought by C., or against A. when brought by B. He cited Jones v. Padgett and Drummond v. Van Ingen in support of his contentions. Mr. A. Riley also spoke for the negative.

After both leaders had replied, the Chairman summed up the various speeches, and, on putting the questions to the meeting, it was decided by a majority of six that an action would be successful in both cases. LLANELLY. The first annual dinner of the Llanelly Law Students' Society was held on Wednesday, the 16th inst., at the Thomas Arms Hotel, there being a large and distinguished company present. Mr. Thomas J. Williams, president of the society, occupied the chair, and submitted the usual loyal toasts. The other toasts included "The Houses of Parliament," "The Legal Profession," "The Llanelly Law Students' Society," "The Magistrates," "The Local Authorities," "The Visitors," and "The Press." Among the speakers were Messrs. C. H. Glascodine, W. Buckley Roderick, D. Rees Edmunds, Ernest Trubshaw, J.P., D. Williams Rees, David Francis, J. Allen Williams, J. Beavan Phillips, J.P., David Evans (High Sheriff), W. Howell, D. Samuel, W. Stuart, W. Bramwell Jones, Lewis Bishop, and W. R. James.

MANCHESTER.-There was a crowded attendance of members at the meeting of this society on Tuesday, the 15th inst., when a joint debate with the Bradford Law Students' Association took place. The president of the Manchester society, his honour Judge Parry, occupied the chair, and the subject for discussion "That the case of Dickinson v. Dodds (L. R. 2, Ch. D., 463) should be overruled" gave scope for some keen debating. Mr. E. W. Perkins (Bradford) opened in the affirmative, and Mr. F. S. Oppenheim replied in the negative. Messrs. Hammond, M'Ginnis, Sharpe, Bolton, Barraclough, and Turnbull of Bradford, and Messrs. C. R. Allen, Z. M. Lord, C. H. Pickstone, F. Hindle, P. Hibbert, F. W. Watson, E. C. Pearson, H. Bury, and W. Booth of Manchester took part in the discussion. The Chairman summed up in favour of the negative, and the meeting came to a decision on these lines by a majority of seventeen. After the meeting the Bradford delegates were entertained at a dinner and smoking concert.

NEWCASTLE-UPON-TYNE.-The seventh general meeting of this Society was held in the Law Library on Wednesday the 9th Dec., at 7 p.m.; Mr. A. Boothroyd in the chair. The minutes of the previous meeting were read and confirmed, and Mr. G. F. Bell was duly elected a member. The subject for debate was "That the case of Langridge v. Levy ought to be overruled." The affirmative was opened by Messrs. W. M. Pybus, jun. and W. J. Brandling, while Messrs F. D. Bruce and F. W. Lisle opposed. On the debate being declared open the following members spoke: Messrs. Booth, Oliver, Parrington, and Chapman. Mr. Pybus having replied, the Chairman summed up the arguments on both sides and put the question to the meeting, when it was decided by a large majority that the decision should stand. Members present twenty.-The eighth general meeting of the society was held on Wednesday, the 16th Dec., 1896; Mr. H. S. Mundahl, barrister-at-law, in the chair. The subject of debate was the "Law Notes Moot for December as follows: "Mr. Kodak, takes without permission, a snapshot of a lady and a gentleman in a boat, under some trees. The gentleman has his arm round the lady's waist. This photograph Mr. Kodak is in the habit of showing to his bachelor friends who visit him at his chambers. Major Sprightley has for some time past been very suspicious of a certain Mr. Brown, who, he considers, is too attentive to Mrs. Sprightley. A Mr. Smith, in company with Major Sprightley, calls at Mr. Kodak's chambers one evening, and Major Sprightley is introduced to Mr. Kodak. Eventually Mr. Kodak shows his collection of snapshots, including that of the lady and gentleman in a boat. Major Sprightley recognises his wife and Mr. Brown, and Mrs. Sprightley, when charged, has to admit that she has carried on a foolish, but innocent, flirtation with Mr. Brown. Major Sprightley declines to cohabit any longer with his wife. Has Mrs. Sprightley a right of action against Mr. Kodak "? Messrs. E. C. Sanders and J. W. Parrington opened in the affirmative, and Messrs. B. Townshend and S. D. Cole took the negative side. The following members also spoke :-Messrs. Senhouse, Brown, Chapman, Lemon, Hadaway, and Brandling, and Mr. Sanders replied on the arguments. The Chairman summed up the debate and reviewed the law on the point very clearly, and put the question to the meeting, when it was decided by a majority of six that Mrs. Sprightley had a right of action against Mr. Kodak; but on a further motion being put as to whether she could recover damages from him, it was unanimously decided that she could not recover any damages. There were eighteen members present.
