THE twenty-fifth annual general meeting of the Sunderland Incorporated Law Society was held on the 23rd ult. in the County Court, John-street. The annual report of the committee was adopted, from which it appeared that there were ninety-nine solicitors practising in Sunderland, of whom seventy-seven were members of the society. The treasurer's account showed a balance at present in hand of £124, of which it was resolved to invest £50 in the Post-office Savings Bank and to spend £30 in books for the library, which is now a valuable adjunct to the society. The election of officers for the ensuing year then took place. Mr. A. G. Boulton was unanimously elected president. Mr. Boulton passed the final examination with honours in 1872, and was admitted a solicitor in the following year. He has been twenty-one years a member of this society, during seven years of which he acted as honorary secretary and six years as honorary treasurer. ON perusal of the questions at the recent "pass" examinations candidates who had the misfortune of being postponed in October till the next Easter examination may rightly consider themselves victims of a certain amount of injustice. There is no comparison between their relative stiffness. It will be incumbent on the Council of Legal Education, if they deem it salutary to postpone men at one examination for several terms, to ensure something resembling uniformity of standard. Considering the wonderful oscillations in the past, it would be pretty safe to predict that these unfortunate men (some of whom were excluded till Trinity), after having been excluded from two or three easy examinations which they might have passed, will be readmitted on an occasion at which they will again fail, through the examination becoming suddenly twice as difficult. As regards conveyancing and real property, the questions were what is usually termed potty." It is hard to see how many could stumble over the effect of a devise "to A." before and since 1835, or "how are estates tail barred? Then the farce proceeds with such questions as, "In what cases, if any, is a deed necessary for the creation of a valid lease? and "Are covenants for title now set forth in purchase deeds? &c. But it is unnecessary to study the paper deeply, as it can be summed up by stating that it consisted chiefly of the easiest questions in real property which can possibly be set. The hardest were probably those on intestacy; although the use of Latin phraseology, e.g., propositus, does not make a question hard, still it looks imposing. The examiner in Common Law displayed more steadiness as regards maintaining uniformity in the quality of his questions. Question 3, however, on the rights of a co-surety against debtor, creditor, and other co-sureties, is one which generally appears at the Intermediate Solicitors' Examination. The law of torts did not come in for much attention, and we only notice one on conversion by bailees, and another on the facts of Stanley v. Powell, in which an unfortunate "beater," who had his eye destroyed by a glancing shot, became the hero of a leading case. There were some nice questions on the law of contract, notably Question 4, on continuing guarantees, and the point decided in Lloyds v. Harper, and another on the "liability of a transferor by delivery only." Question 1, on the liability of a common carrier, and Question 9, on liens general and particular, went over ground with which most law students are fairly familiar. Of "wagering and gaming" also they are not altogether ignorant, and this is a subject which has a terrible fascination for examiners both at the Council of Legal Education and the Incorporated Law Society, and although we have rarely noticed a "double event," still it is "odds" it appears at either the one or the other examination held in the same term. The Equity paper opened with the rule in Dearle v. Hall. Then followed some fairly easy questions on trusts." Question 4, as it involved something practical, viz., the form of a foreclosure order, would be beyond the bulk of Bar students. But, as it was followed by a question requiring an explanation of some every-day legal phrases, e.g., "equity of redemption," "marshalling," "stop-order," &c., it is evident that on the whole they had a very easy time of it. Question 6, on the circumstances under which a third mortgagee can obtain priority over a second, was easy. Of the two questions in partnership the first was long-worded, but the second could easily be disposed of by some knowledge of Cleather v. Twisden. The paper closed with two easy questions on specific performance, one of which involved practically the law laid down in Lumley v. Wagner. The examiner in Evidence, Procedure, &c., evidently wanted to air his Latin, and was not contented with a few permissible phrases such as judgment in rem., but managed to change the good old phrases "latent and patent ambiguity into "ambiguitas latens" and ambiguitas patens." It is a favourite trick of examiners when they ask an easy question to couch it in pompous phraseology, and of course Latin serves the turn very well. We also notice that sometimes the language almost gets poetical, and in Question 3 he asks "What means exist for compelling the attendance of a witness at Nisi Prius (1) when he is a free man, (2) when he is in custody?" We shall soon have our judges condemning persons to slavery. The questions in civil procedure were of a very ordinary type. As regards the law of crimes, candidates were required to draw an indictment for murder, and to dilate with examples on the amount of provocation which would reduce murder to manslaughter. We trust they did not discover such provoca. tion in the last riddle about the man with the wives B, C, D, E, which, however, was not of the same difficulty as that put by the Sadducees, and we trust they were fully armed with a knowledge of Reg. v. Willshire. CORRESPONDENCE. This department being open to free discussion on all Professional topics, the Editor does not hold himself responsible for any opinions or statements contained in it THE "ANNUAL PRACTICE."-In my appreciation of the "Annual Practice," and of the ability of its editors, I yield to no one, but I view with dismay the ever-increasing bulk of the first volume. I beg to suggest the transfer to Vol. II. of the Table of Cases, which occupies about 200 pages of Vol. I. If this were done, the thickness of Vol. I. would be materially diminished, and I do not think that the utility of the work, as a book of ready reference, would be seriously impaired. In ninety-nine cases out of one hundred one consults the "Annual Practice by the aid of the index only, or by direct reference to the orders and rules. I make this suggestion through your columns in preference to making it privately to the courteous editors, not because I am apprehensive that, were I to write them on the subject, my letter would not receive all the 17. BUILDING SOCIETY INCOME TAX.-Is a terminating society worked on the ballot and sale system liable to income tax under Schedule E. in respect of the purchase money for appropriations, such purchase money being secured with the advance on mortgage in the usual way and being carried as repaid into the general fund of the society for the purpose of appropriations to other members? Such purchase money or premiums are not distributed as profit until the termination of the society and until that period is contingent or prospective profit only and as such inserted in the annual balance-sheet of the society. If liable to tax, is the society entitled to deduct working expenses? Up to last year the Inland Revenue anthorities do not appear to have assessed these societies. LEX. 18. FORGERY OR OBTAINING MONEY BY FALSE PRETENCES.-A man draws a cheque upon a bank where he has no account and succeeds in obtaining cash for it. WHEREAS by virtue of certain Orders dated respectively the 31st March 1890, the 31st Dec. 1890, and the 30th July 1896, the Board of Trade have appointed Edwin Leadam Hough, Harold de Vaux Brougham, and Alfred Henry Wildy to be Official Receivers for the Bankruptcy District of the High Court, and the Board of Trade have directed that, as regards all bankruptcy proceedings in the High Court, the estates of debtors, and the duties of official receivers in relation thereto, shall be distributed amongst and performed by the said Edwin Leadam Hough, Harold de Vaux Brougham, and Alfred Henry Wildy, as in the said Orders part cularly mentioned. And whereas it is desired to alter and adjust the distribution of the said debtors' estates and the duties in relation thereto amongst the said official receivers of the High Court. Mr. CHARLES ARCHER GRIMWADE, solicitor, the eldest son of Mr. Charles James Grimwade, solicitor, Hadleigh, died on the 13th inst., at the early age of twenty-seven. Mr. Grimwade was admitted a solicitor in 1892. Mr. JAMES CUDDON, chairman of the Law Union and Crown Fire and Life Insurance Company of London, who was one of the founders as well as one of the original directors of the Law Union Insurance Company, died on the 23rd ult., in his eighty-first year. Mr. Cuddon was the eldest son of Mr. James Cuddon, of Norwich, and belonged to an old Roman Catholic family. On the death of Sir William Foster in 1874, Mr. Cuddon was elected chairman of the Law Union Insurance Company, and when the Crown Life Insurance Company was afterwards amalgamated with it he was unanimously elected chairman by his former and new colleagues upon the united board. Mr. Cuddon was called to the Bar at the Middle Temple in 1862, but retired from practice about thirteen years ago. He was one of the witnesses before the committee of inquiry, appointed, on the motion of Mr. Newdigate, as to the inspection of monasteries and convents. Amongst lawyers, Mr. Cuddon's name will be most familiar on account of the work which he wrote on copyhold tenure, and his extensive experience in manorial customs. Mr. JOHN V. OWEN, solicitor, died at his residence, 19, Delanceystreet, Camden Town, on Monday, the 21st ult. The deceased was in his thirty-third year, and was admitted in 1888. Mr. JOSEPH LOWTHER HUNTER, a member of the firm of A. C. Hillman and Hunter, solicitors, of Eastbourne, died on the 11th ult. He was a son of the late William Sisson Hunter, of Edlington. In January last year he was taken into partnership by Mr. A. C. Hillman. He was thirty-seven years of age, and was admitted in 1891. Mr. F. HEARLE COCK, solicitor, of the firm of Messrs. Hearle Cock and Parkin, of Truro, died in the office of Mr. E. Boase, solicitor, of Penzance, on the 22nd ult. Mr. Hearle-Cock, who was about sixty-five years of age, leaves a widow and one daughter; Mr. F. Parkin, his partner, was a nephew. Deceased, a native of Tregony, near Truro, was admitted a solicitor in 1851. In 1865 he succeeded the late Mr. Henry Sewell Stokes as town clerk of Truro and clerk to the city justices. He resigned the former post in 1887, but continued to act as magistrates' clerk up to the time of his death. THE promotion of Mr. Justice CHITTY to the Court of Appeal is a well-merited recognition of the valuable services rendered by him as a judge of the Chancery Division. That Mr. Justice CHITTY was educated at Eton and was in the eleven there, that he took a first in classics at Oxford, was a Fellow of Exeter College, and twice rowed stroke in the boat, that he has always been equally distinguished both in bodily and intellectual attainments, that he is the embodiment of courage, courtesy, and common sense, are well known to all. But that he is also one of the most exact and learned lawyers of his day, that he has a rapid mastery of the material points in a case, that he has a delicate appreciation of the meaning of words and a rare felicity of expression, are known perhaps only to the initiated. If he has ever given utterance from the Bench to extra-judicial sentiments and what judge has not?-assuredly he has talked good sense. His long familiarity with the practice of the Chancery Division rendered him an unusually good judge in chambers, and, without detraction, it may be said that his loss in that direction will be a serious one. His presence in the Court of Appeal will add strength to that tribunal, and we doubt no that Lord Justice CHITTY will take rank as one of the ablest equity lawyers of his day and generation.
