HARDWICKE SOCIETY.

AT the meeting held on Friday, the 26th March, Mr. Raymund Allen moved: "That this House approves of the policy pursued by Her Majesty's Government with respect to the Cretan insurrection, and is of opinion that the Great Powers would be justified in resorting to any measures necessary for the enforcement of their demands upon Greece." Mr. H. W. Vaughan Williams opposed. The motion was carried.

UNITED LAW SOCIETY.

ON Monday, the 29th March, Mr. C. W. Williams in the chair, Mr. W. F. Symonds opened a debate on the motion, That the volunteer forces, on the present system, do not justify their existence." Mr. J. R. Yates opposed, and Messrs. C. Kains-Jackson, A. H. Richardson, C. Herbert Smith, N. Tebbutt, and A. M. Begg also took part in the debate. After a reply from Mr. Symonds, the usual voting took place, with the result that the motion was carried by one vote.

UNION SOCIETY OF LONDON.

THE Society met at the Inner Temple Lecture-hall on Wednesday evening, the 31st inst.; Mr. Stanley A. Latham, vice-president, in the chair. After the reading of the minutes and the disposal of private business, Mr. A. H. Withers brought forward the motion on the agenda paper, viz. : "That the reports of the Royal Commission on Irish Finances makes the reform of Irish finances immediately necessary. Speakers: for the motion, Messrs. Withers, Ball, and Jenks against, Messrs. Willson, Copeland, and Kinipple. The motion was lost. The society will meet at the Inner Temple Lecture-hall-3 (North) King's Bench Walk-on Wednesday evenings, April 7th and 28th, and the 5th May 1897, at eight o'clock, Subjects for debate:-Wednesday, April 7: "That in the cpinion of this House the state of our Indian Army demands the re enforcement of the Contagious Diseases Acts in that country"; opener, Mr. W. R. Willson. Wednesday, April 28: "That in the opinion of this House the Employers' Liability Act has proved ineffectual in operation, is opposed to the true interests of employers and workmen, and should be repealed;" opener, Mr. S. W. Clarke. Wednesday, May 5: "That the Bastardy Laws of England are unjust, and should be amended;" opener, Mr. F. W. Sherwood. On Wednesday, May 12, the annual dinner will take place. On Wednesday, May 19, the general meeting will be held. Nominations under rule X. must be sent to the hon. secretary at least fourteen days before. Wednesday, May 26, will be a ladies' night. Private business :-on April 7 the hon. secretary will move, "That at the meeting on the 26th May, in rule XXII. the words 'quarter-of-an-hour' be substituted for half-an-hour,' and the word 'five' for 'ten.'" On April 28 the election of auditors will take place. The hon. secretary will be obliged if members will enter subjects for debate in the book provided for that purpose. Members of the Oxford and Cambridge Unions, the Juridical Society of London, the Historical Society of Dublin, and the Speculative Society of Edinburgh can become members on nomination without ballot.

SOLICITORS AND THE DIAMOND JUBILEE.-I have waited for your last issue in the hope that someone whose name would have carried more weight than my own would have come forward in your columns to enter a protest against the mode selected by the council of the Incorporated Law Society for commemorating the sixtieth year of Her Majesty's reign. Unfortunately "the solicitors of England" with their usual apathy seem so far to have confined the expression of their disapproval of the council's scheme to withholding their subscriptions-for no one can pretend that the few subscribers whose names are at present announced are representative of the Profession at large. The proposal, as I understand it, is for "the solicitors of England" to commemorate in a way worthy of their Profession the sixtieth year of Her Majesty's reign. With this object I need hardly say I am heartily in accord, and had the opinion of the Profession been taken as to the mode of celebration to be adopted I should have bowed to the decision of the majority and not have troubled you with this letter. As it is, the Profession at large has not been consulted, and as far as I can ascertain does not approve of the council's choice. Speaking for myself, my chief objection to the pension scheme is that it is utterly unworthy both of the Profession and the occasion. No one denies the merit of a combination for the assistance of professional brothers in distress. It is a duty, and a duty which the existence of the Solicitors' Benevolent Society shows to have been recognised by the Profession. There are, however, times when other interests are paramount even to charity. We have the poor always with us, but not always have we an opportunity of offering to our Sovereign an express mark of our loyalty and esteem, or of adding to our small stock of corporate heirlooms a memento of that Sovereign upon which we and our successors can look with that legitimate pride which is so wanting in us solicitors as a body. My objection, however, does not rest here. The scheme selected by the council seems to me to be nothing more than a species of that homecharity known as, Taking one's money out of one pocket and putting it into the other." The gift, be it remembered, purports. to be a thankoffering from "the solicitors of England" as a class, and, this being so,

surely it resolves itself into a transfer from the rich pocket to the poor pocket of the class, and becomes no offering at all as far as the class is concerned. Were it proposed to place the funds collected at the absolute disposal of Her Majesty, I, for one, would hail the scheme with unqualified approval: but, as this does not appear to be the case, I am reluctantly compelled to withhold my subscription. I would, however, in conclusion, venture to suggest that, as the council have made their selection without consulting the Profession at large, they should provide an alternative scheme-say a fund, either to be placed at the disposal of the Queen, or for the acquisition of a portrait or bust of Her Majesty to be placed in the hall of the Law Institution. Low v. BOUVERIE.-Referring to your article in the LAW TIMES newspaper (the 20th March), p. 473, col. ii., in which appears the following: "In Low v. Bouverie, in which the House of Lords affirmed the decision of the Court of Appeal, the Lord Justice, in an elaborate, &c.," is it a fact that this case was carried to the House of Lords, and, if so, would you oblige me with the reference to the report (if reported) ? Queries.

29. COVENANT.-In 1852 A. B. demised leaseholds to C. D. for 999 years, C. D. giving usual covenants to pay rent and observe covenants. In 1873 C. D. died. In 1876 the executors of C. D. assigned to E. F. for residue of said term of 999 years, the usual covenant for indemnity being inserted, but E. F. (the assignee) did not execute the assignment; for what reason is not known. In 1888 E. F. died intestate, and his personal representative has now agreed to sell the property to G. H. Can the personal representative of E. F. insist on G. H. entering into a covenant to indemnify him against the rent and covenants of the lease, inasmuch as E. F. did not execute the assignment to himself in 1876, although the usual covenant for indemnity was inserted therein ? Authorities will oblige. INQUISITOR.

30. LEGACIES.-Since the Finance Act 1894 abolished the difference in the rates of the legacy and succession duty, is there any object, where legacies are directed to be paid out of a mixed fund, in directing that B. L. they shall be paid primarily out of the personal estate?

31. LAW OF DISTRESS AMENDMENT ACT.-Can any of your correspondents inform me what fees are allowed to bailiffs under this Act where the distress is withdrawn or no sale takes place and the rent distrained for exceeds £20? Also, whether any of the London County Courts have a fixed scale applicable to the above cases. W. J. STANDring.

Mr. EDMUND M'GILDOWNY HOPE FULTON, of the Indian Civil Service, has been appointed a Judge of the High Court of Judicature at Bombay, in the place of Mr. Justice Jardine, retired.

The Hon. CHARLES ARTHUR ROE, Chief Judge of the Chief Court of the Punjab, has had the dignity of Knighthood conferred upon him. Mr. ARTHUR W. TEMPLE, solicitor, of Bridport, has been appointed Clerk to the Magistrates for the Borough of Bridport.

Mr. ALLEN PETER STREET, of Newcastle-under-Lyme, has been appointed a Commissioner for Oaths. Mr. Street was admitted in Jan. 1891.

Mr. HENRY ROBERT MORGAN, of the firm of Jarvis and Morgan, of King's Lynn and Norwich, has been appointed a Commissioner to administer Oaths.

LAW STUDENTS' DEBATING SOCIETY.-The usual weekly meeting of the society was held at the Law Institution, Chancery-lane, on Tuesday, the 30th March; chairman, Mr. Augustus Anderson. The subject for debate was: 859. "That the public press in this country wields an influence greater than is desirable." Mr. J. D. A. Johnson opened in the affirmative, and Mr. Arnold Jolly in the negative. The following members also spoke Messrs. Foden Pattison, Archibald Hair, Arthur E. Clarke, P. I. Buckland, C. F. N. Boulton, Hamilton Fox, Haseldine Jones, Alfred Dods, E. S. W. Isaac, Walter Barrett, E. A. Alexander, and R. C

Atkinson. The motion was lost by four votes.-The subject for debate at the next meeting of the society, on Tuesday, the 6th inst., is, "That the case of Hawke v. Dunn was wrongly decided.

DEWSBURY, WAKEFIELD, AND DISTRICT.-The annual dinner was held at the Royal Hotel, Dewsbury, on Tuesday evening, the 23rd March; Mr. C. A. Ridgway, solicitor, in the chair, and Mr. T. LEGAL OBITUARY.

He was

Mr. WALPOLE EYRE GREENWELL, solicitor, of St. Marylebone, died at his residence, 57, Upper Berkeley-street, W., on Saturday, the 13th ult., in his seventy-eighth year. He was the only son of the late James Hugo Greenwell (also solicitor of St. Marylebone), and was educated at Eton College. He served his articles with his father's firm, Messrs. Greenwell and Lloyd, and was admitted a solicitor in Trinity Term 1845. appointed vestry clerk of the parish of St. Marylebone in 1851 (an office also held by his father), and resigned this office in 1885. He was afterwards appointed clerk to the Land and Income Tax Commissioners for St. Marylebone. In addition to these posts, he filled at the time of his death many other important public offices. He was solicitor to the Vestry, Board of Guardians, Bath Commissioners, and Burial Board; clerk to the Justices of the Peace for St. Marylebone, which position he has held for forty-five years. Mr. Greenwell was a great authority on all matters connected with municipal law, and at the time of his death was president of the Local Government Officers' Association. In public life he had made his name widely known, and his ability and courtesy had gained for him the respect and esteem of many who hold distinguished positions in municipal life.

The Law and the Lawyers.

THE Easter Vacation Regulations are a little complicated. No court will sit. The judge will sit in chambers on the 22nd inst. At other times his Lordship can be approached by post or personally, "in which latter case the applicant should proceed to Sutton by the London, Brighton, and South Coast Railway, and thence by cab to Woodmansterne." It is not to be assumed that the adoption of any other route or mode of locomotion will render invalid or ineffective any order made by the learned judge at Woodmansterne.

LAWYERS Writing in the lay press have been calling upon the CHANCELLOR to "hurry up" in filling the vacancy on the Bench of the Queen's Bench Division. Surely hurrying up in such a matter is very foolish. Judges can and do remain away months indisposed without substitutes being found, and a little deliberation before making a judge is fully justified. A judge is a man invested with vast influence upon human life and happiness. He may do infinite good or incalculable mischief. To select the best man is a task requiring judgment and discrimination.

We have rather enjoyed the interval, as showing the wonderful grounds upon which some people apparently in the Profession think promotion to the Bench may be based One nominee has a safe seat, and is a party hack; one has sat as a Commissioner of Assize; a third has been unheard of in the courts for years; a fourth, and he only of the four, enjoys a large practice. THE Bar Council has prepared its annual statement. organisation it has been hard at work for more than twelve months. The prominent feature of its constant sittings is the assiduity with which very busy men attend. When it was formed it was said, You will never get the best men to give attention to it. Experience proves precisely the reverse. Singularly enough, the candidate who received the most votes has rarely attended. But, on the whole, the number of members present at council meetings and frequent and numerous committee meetings has been very remarkable.

HAS the Bar Council realised expectations in all other respects? Certainly not. Professional interests have been keenly safeguarded. But nothing appears in the annual statement to indicate that the Council can take a large view of its responsibilities. The profit and convenience of members of the Bar-conserve those and then consider the suitor. No vested interest, it would appear, is to be touched, however beneficial the result to the administration of justice. We candidly admit that it was hardly to be expected that a council largely composed of prosperous barristers would all at once see the expediency of consulting public interests first and their own afterwards, because a professional trade union cannot quickly disabuse itself of the belief that in some way
