In criminal cases the fact that the jury are unaware of previous convictions, save where the accused is being tried as an habitual criminal, ensures the prisoner a fair trial for the offence with which he is charged. Actual misconduct on the part of a jury is exceedingly rare, but where, by premature intervention, it is made clear to the presiding judge that their verdict cannot be impartial, he can always act so as to ensure that justice shall be done.

THE report of the Commissioners of Prisons and the Directors of Convict Prisons for the year 1926 which has just been published shows that during that period the number of receptions of prisoners under sentence was 56,211, an increase as compared with the previous year of 1474 as compared with a decrease last year of 882. It is unsatisfactory to note that the number of persons received into prison under the rules for debtor prisoners was 10,683, but this figure was largely composed of those committed under wife maintenance and affiliation orders, the figure being 6035, and only 2346 were committed by County Courts. Another unsatisfactory feature is the number of lads received into prison on conviction between the ages of sixteen and twenty-one (exclusive of Borstal cases), the figure being 2464 as against 2064 last year. There were 178 receptions of girls under sentence of imprisonment as compared with 199 the previous year. About 50 per cent. of both sexes had no previous conviction. The totals, however, are a considerable improvement over those for 1921, when 3643 lads and 670 girls were received into prison. During the last four years the number of lads committed to Borstal detention has been steadily increasing, and the report points out that the need for a new Borstal institution has now become acute. The numbers in the existing institutions have become so large that it is very difficult to maintain the personal touch that is essential for the training and to find suitable occupation for all the lads. The Home Secretary in a statement on the report stresses the necessity for a new institution. We quite agree with him that for a large proportion of the lads sent to prison the outlook is poor, especially for those committed more than once, while the Borstal institutions, on the contrary, with their courses of vigorous training and discipline, offer hopeful possibilities of changing the lads' outlook and giving them a new start. The Home Secretary also drew attention to the question of short sentences. No doubt in some cases a short term of imprisonment is the only sentence practicable, but it cannot be disputed that the ideal to be aimed at is first to avoid imprisonment whenever some alternative course such as probation or fine is possible, and secondly, if more lenient treatment is inappropriate to the offence, or has already been tried and proved futile, then a sharp term of imprisonment is the only action. possible.

Workmen's Compensation

THE statistics of compensation and of proceedings under the Workmen's Compensation Acts and the Employers' Liability Act 1880 during 1926 have just been issued by the Home Office. Naturally,

owing to the coal stoppage the number of cases in which compensation was paid were very much reduced, falling from 476,085 in 1925 to 370,908 in 1926. This figure is governed by the mining industry, for the cases in 1925, being 214,405, fell to 131,231 in 1926. The total number of cases under the Workmen's Compensation Acts which were taken into court in Great Britain in 1926 was 6311. Many of these, however, were applications for dealing with allowances already granted, and many were settled out of court or otherwise disposed of, so that the total number of original claims for compensation finally settled with the cognisance of the courts was only 2947. The decision in 2194 cases, or 74.4 per cent., was in favour of the applicant. There were 27,775 cases in which memoranda of agreements and informal arbitrations were registered in the courts. The number of cases under the Workmen's Compensation Acts in Great Britain carried to the Courts of Appeal was 109. In addition, there were eleven appeals from these courts to the House of Lords. The total number of cases under the Em

ployers' Liability Act 1880 taken into court in the whole of Great Britain was forty-two, as compared with 583 in 1907, when the Act of 1906 came into full operation. Subject to minor fluctuations the figures have steadily diminished and clearly show that the remedy provided by the older Act has been falling into disuse. The following table shows the extent of proceedings in the courts in Great Britain under the Workmen's Compensation and Employers' Liability Acts since the year 1919 :

ON the 25th March next the Landlord and Tenant Act 1927 will come into operation. During its During its progress through Parliament the original draft Bill has been altered and amended to a very large extent, so that the measure now placed upon the Statute Book differs very widely from the form in which it was originally introduced. From time to time during the past year we have drawn our readers' attention to most of the disputable questions that have arisen, and now that the final form of the enactment has been settled and has passed into law, we propose to place before them the main provisions of the Act, which introduce many considerable and important changes into the law of landlord and tenant.

The statute is divided into three parts, the first of which deals with compensation for improvements and goodwill on the termination of tenancies of business premises; the second with general amendments of the law of landlord and tenant; and the third, described as general," contains the provisions as to the tribunal, the service of notices, the interpretation clause and other matters.
