bankruptcy of a husband, after a deed of separation and maintenance, there ceases to be in existence any agreement for his providing for the discharge of his common-law obligations, and therefore the commonlaw rights of the wife again come into being.

Justices and Search Warrants

A CASE recently heard at the Wiltshire Assizes draws attention to the fact that the rights of justices of the peace to issue search warrants are strictly limited, both at common law and by statute, and also to the fact that justices of the peace who act with no jurisdiction or plainly exceed their jurisdiction have no protection either under the Justices' Protection Act 1848 or under the Public Authorities' Protection Act 1893. In the case in question the justice had acted in absolute good faith. At common law there is no right for a justice of the peace to issue a search warrant save in the case where stolen goods are alleged to be within his jurisdiction, but a good many statutes have conferred this right. But apart from express statutory powers, with the exception we have already stated, no right exists for a search warrant to be issued. Apparently the warrant in the case before Mr. Justice Acton purported to be issued under the Protection of Animals Act, but no statutory authority is given for issuing a search warrant in such a matter, and this was admitted. The action was brought also against the police officer who executed the warrant, but unsuccessfully, for a police officer, in executing warrants, merely acts pursuant to the order therein contained, and both in cases of arrest and also of search a warrant is sufficient justification for his action.

Wife's Costs in Divorce

IN Durnford v. Baker (132 L. T. Rep. 35), which was an action at common law, the plaintiff's claim was for a bill of costs in divorce proceedings instituted by the wife. The plaintiff solicitor sought to recover these against the husband, and it was held by the Court of Appeal, affirming the decision of Mr. Justice Rowlatt, that, though the defendant's wife had presumptive authority to pledge her husband's credit, yet, as she had not disclosed to the plaintiff the fact that she had committed adultery herself, the plaintiff was not entitled to recover from the defendant, the husband, the wife's costs. In their judgments in the Court of Appeal both Lord Justice Scrutton and Lord Justice Atkin reserved the question as to the right of a solicitor acting for a wife who is defending a suit to recover his costs against the husband. The point directly arose last week in a case before Mr. Justice Sankey-Arnold and Weaver v. Amari-and the learned judge having found that the solicitor conducted the litigation properly, had fairly investigated the charges, and had reasonable foundation for the defence, the point arose whether the wife in these circumstances could bind her husband to pay her solicitor's costs of divorce proceedings in which a divorce was granted against her. The learned judge held that a wife in these circumstances was not entitled to pledge her husband's credit and to bind him to pay her solicitor's costs. It must be borne in mind that these decisions turn on the common-law liability of the husband, and the wife and her solicitors can

always invoke the peculiar jurisdiction of the Probate, Divorce, and Admiralty Division and obtain an order for security for the wife's costs. But in actions at common law the question is really one of agency and concerns the right of the wife to bind her husband for necessaries. Generally speaking, a wife living with her husband can bind him by a contract for necessaries, but where the wife is living apart from the husband and has committed adultery she cannot so bind him.

Trade Associations and "Stop Lists"

It may well be that it is necessary in certain trades for associations to be formed to protect the trade or industry, and naturally those who join those associations are bound by the rules to which they have subscribed. But equally, when the association seeks to enforce those rules upon the individuals who form the association, care must be taken that their provisions are strictly complied with. Under the rules of the Motor Trade Association, individual members who break the rules can be put upon the "stop list," and in such a case other members are forbidden to deal with them. The plaintiffs in a recent case before Mr. Justice Avory were members of the association and had broken its rules, but were informed that if they paid a certain sum to the indemnity fund of the association and signed an undertaking the matter might be ended. Having paid a portion of the money and having become aware of the illegality, they brought an action to recover damages, and the learned judge pointed out to the jury that if two or more persons agree to obtain from another person money to which they have no legal right by threats which are calculated to deprive a reasonable man of his voluntary power of action and obtain the money by such threats, damages can be recovered. Nearly two years ago in the Court of Criminal Appeal in Rev. Denyer, it was held that where the defendant, who was a servant and stop-list superintendent of the association, wrote to a garage proprietor, who was not a member of the association, stating that the association offered an alternative to him to inclusion in the stop list, namely, the payment of a certain sum and the publication of an undertaking to observe protected prices, the defendant was rightly convicted of uttering a letter demanding money with menaces contrary to the Larceny Act, and that it was immaterial that his motive in writing the letter was the protection of the trade interests. And no doubt in such a case, if a civil action were brought, any money so paid could be recovered.

COMPENSATION for goodwill is dealt with by sects. 4, 5, and 6, and should any tenant be successful in obtaining any compensation under this heading he will be accounted a particularly fortunate person. The whole subject is so hedged round with exceptions and restrictions that we shall be very much surprised if any benefit apparently given to tenants does not prove in practice to be nearly valueless. Whereas, under the earlier sections, provided certain conditions precedent are complied with, a tenant stands some chance of being remunerated for improvements carried out on his holding, in the case of
