Bankruptcy Act, 1869, release a surety if the

was opened by Mr. Stock, but as, in consequence
of the late hour, it was then impossible to have
a good debate, the society adjourned. The officers
for the session are as follows:-Treasurer: Mr.
Arthur Fell, B. A. Secretary: Mr. Cecil A. Betts.
Committee: Messrs. C. Swinfen Eady, LL.B.,

BRADFORD LAW STUDENTS' SOCIETY. THE first meeting of this society for the new session was held at the Grand Jury Room of the Court House, Bradford, on Wednesday, 20th Oct., J. W. Bilborough, Esq., solicitor, in the chair. The subject for discussion was as follows: "Is the Land Titles and Transfer Act, 1875, a

active member of the Articled Clerks' Society, | for discussion, No. 567, legal, "Does the accept-
in the days of Messrs. Drummond, Baxter,
and Fraser; he had also served on the Davis
Prize Committee. He thanked Mr. Charley
for so kindly referring to his efforts in regard to
the Legal Practitioners' Society. As to the Act,
he was above all things delighted to find students
of that branch of the profession to which he
should always consider it a great honour and pri-
vilege to belong, entering so fully and so
earnestly into a consideration of the reforms ac-
complished by such Acts. It augured well for the
future of solicitors, who, he hoped, would elevate
themselves into a position of even greater worth
and honour. One word more, let him entreat
them not to go rushing off to counsel at every
turn and on the smallest pretext. He could
assure them that counsel thought none the better
of them for thus discrediting their own capabili-
ties. He hoped that solicitors would feel them-
selves fully competent to prepare their own plead-
ings, which were greatly simplified under the
Acts. It appeared to him that in all cases in
signing judgment under the Acts, costs would have
to be taxed, which he considered a great drawback.
Mr. Ford concluded by assuring the meeting
that while he had given a careful consideration to
the Acts themselves, he had felt considerable
difficulty in understanding them, and he was
guilty of no exaggeration when he said that Mr.
Charley's valuable paper had thrown light on
many points which had proved a stumbling block
to him; he was therefore especially pleased in
having the opportunity of seconding the motion,
which having been put from the chair was carried
by acclamation.

Mr. Charley briefly responded, thanking those present for the compliments paid him; he thanked the chairman also for his presidency on the occasion and recognised the labours of the Hon. Secretary of their society. He jokingly expressed the hope that they would not take Mr. Ford's advice as to consulting counsel.

A vote of thanks to the chairman terminated the proceedings, which were listened to with marked interest and attention throughout.

BIRMINGHAM LAW STUDENTS'
SOCIETY.

AT a meeting of this society, held on Tuesday
evening, Mr. Alfred Canning in the chair, the
following question was discussed. "Is the case of
Jee v. Audley (reported 1 Cox, 324) well decided?
Mr. David led in the affirmative, and was sup-
ported by Messrs. Cresswell and Browett, Mr.
Whitehouse replied in the negative, and was
followed by Messrs. Cochrane and Withers.
The voting was in favour of the affirmative. A
vote of thanks to the chairman concluded the
meeting.

PLYMOUTH, STONEHOUSE, AND DEVON-
PORT LAW STUDENTS' SOCIETY.
A MEETING of this society was held at the
Athenæum, on Friday, 22nd Oct., W. Adams,
Esq., in the chair. After the election of members
and other business had been transacted, a debate
was opened on the following moot point :-" When
an application to take shares in a limited company
has been sent by post, ought the contract to
take shares to be considered complete from the
moment the letter announcing the allotment is
put into the post, whether it reach the allottee or
not?" (Townsend's case, L. Rep. 13 Eq. 148;
British, &c., Company v. Colson, L. Rep. Exch.
108: Harris's case, 7 Ch. App. 587; Walls's case,
L. Rep. 15 Eq. 18).

Mr. C. Matthews led in the affirmative, seconded by Mr. E. Symonds, and opposed by Messrs. W. Oliver and H. M. Prideaux. In addition to the above, the hon. secretary (Mr. E. F. Fox) and Mr. J. Loye spoke; and after the Chairman had summed up it was decided (1) by the unanimous vote of the meeting, "That the contract became by law binding on the allottes directly the letter was posted:" (2) by 5-4, "That it was proper that it should be so."

LAW STUDENTS' DEBATING SOCIETY. THIS Society met for the first time after the Long Vacation on Tuesday last at the Law Institution, Chancery Lane, Mr. Indermaur in the chair, Several new members were proposed, and the report of the Dinner Committee was received and adopted. The principal business of the evening was the discussion of two motions brought forward by the secretary in the following terms. 1. "That in the opinion of this society it is desirable that rules clearly and concisely setting forth the practice of the society during debate should be prepared." 2. "That a special committee of seven members be now appointed to prepare such rules." After considerable discussion both resolutions were carried, the number of the members of the special committee being fixed at three instead of seven as proposed. The question

good measure, and worthy of support in the
interests of the general public?" The speakers
in the affirmative were Messrs. Barlow and Vint,
and in the negative Messrs. Saville, Hines, and
Wright. The chairman having summed up the
arguments on each side, the votes were in favour
of the negative. A vote of thanks was accorded

to the chairman.

Holland-road, Kensington, on the 11th inst., in
the thirty-sixth year of his age, was the only son
of George Evett, Esq., of Kensington, by Charlotte
Elizabeth, daughter of Stuart Sutherland, Esq.
He was born at Chelsea in the year 1810, and was
educated at the Kensington Proprietary School,
whence he proceeded to Pembroke College, Cam-
bridge, where he graduated in 1863, taking honours
as a wrangler, and in the second class in the clas-
sical tripos. Mr. Evett, who was admitted a
selicitor in Michaelmas Term 1869, lived and died
unmarried. His remains are interred in Bromp-
ton cemetery.

A. A. SHAPLAND, ESQ.

the 18th ult., in the thirty-eighth year of his age,
was the second son of John Terrell Shapland,
Esq., solicitor, of South Molton, Devon, by Char-
lotte, daughter of the late William Francis, Esq.,
of Winstode, near Crediton, Devon. He was
born at South Molton in the year 1838, and having
been educated at a private school, was admitted a
solicitor in 1866. He was appointed in 1869 a
commissioner in the Courts of Queen's Bench,
Common Pleas, and Exchequer. Mr. Shapland
was for some time the agent of the Conservative
Association for the Sutton district of Mid-Surrey.
He was also solicitor to the East London Medical
Defence Association, a member of the Incorpo-
rated Law Society, and the Solicitors' Benevolent
Association. He married, in 1865, Anne Rushton,
daughter of the late Wm. Jackson, Esq., of the
Ordnance Department, by whom he has left three
children. His wife met with her death about two
years since by being thrown from her carriage.

dersfield, who died on the 22nd Sept., at his resi-
dence in that town, in the sixty-fourth year of his
age, was born at Pontefract in the year 1811, and
was educated at the Grammar School of that town,
where he obtained an open scholarship to Oxford
University; he, however, did not go there. In
1823 he entered the office of Messrs. Battye and
Hesp, of Huddersfield, in the capacity of clerk,
and after having served the firm for some years,
Mr. Freeman was articled to Mr. William Battye,
of Bristol. On the completion of his "articles"
he returned to Huddersfield, and in 1837, having
been duly admitted a solicitor in Michaelmas Term
of that year, he commenced practice on his own
account. In 1840 he entered into partnership
with Mr. Thomas Brook, and ten years afterwards
they were joined by Mr. Joseph Batley, now town
clerk of Huddersfield. Mr. Charles Edward Free.
the youngest son of the deceased gentleman,
joined the firm in 1869. "In the early period of

man,

his practice as an attorney," says a local contem. porary, "Mr. Freeman engaged in business which called forth his powers as an advocate, and the experience he thus gained was never lost, but put to good use at subsequent periods of his career, Though not brilliant as a speaker or a pleader, he showed those before whom he appeared that he made himself master of his cases, and his transparent conscientiousness, combined with an earnest persuasive manner, often stood him in good stead against the more vehement rhetoric of some of his legal antagonists." Mr. Freeman was subsequently appointed solicitor to the Manchester and Leeds section of the London and North-Western Company's line. In that capacity he was connected with most of the railway improvements between Manchester and Leeds, his last work being the promotion of the Bill for the legalisation of the water supply by the railway company from the Huddersfield Canal. The deceased gentleman, who was a staunch Conservative, always took a part in the electoral contests of both the West Riding and borough of Hudders field, and he was also for some time agent and advocate for the Conservative Registration Association for the West Riding of Yorkshire, and afterwards to the association for the southern division. Besides assiduously devoting himself to the business of his profession, Mr. Freeman was actively useful in connection with many public institutions, and was for some time chairman of the Huddersfield Improvement Commis. sioners. INSURANCE AND GENERAL AVERAGE,

IN ENGLAND AND AMERICA;

[blocks in formation]

"The principles and practice of ' general average' are included in this able summary."-Standard.

"The writer shows the necessity of assimilating the laws of all countries as regards Insurance and Average, and supports his views by introducing references to the laws of France and Germany.

"The book is divided into 505 sections, each complete in itself; and these numbered paragraphs are divided and arranged under the separate headings.

"The subject matter of the book, in every instance, is printed in large type, and the clauses followed by smaller letters of reference. This makes the work convenient for consultation; and the law cases being appended to every paragraph, with quotations from the laws of foreign countries, its conciseness in the mode of explanation tends to render the author's reasonings intelligible much more readily than they would otherwise have been if overlaid by laborious dissertations upon the causes and

effects of decisions on disputed points. . . . . Mr. CRUMP
enhances the value of his book by naming the authorities from
whence he derives his information. As a specimen of the general
method he adopts, we quote the heading of paragraph 241, on
'Circumstances which Justify Deviation." These are, "1st, by
usage; 2nd, by license in the policy; 3rd, when made to save
life (but not property); 4th, when forced upon the Assured by
vis major; 5th, when the control of the ship is taken out of the
hands of the Assured; 6th, in extraordinary emergencies to
repair; 7th, when necessary to avoid disaster; and 8th, in
repelling hostile attacks." If it is desired to know upon what
rule of law these deviations can be justified, explanations are
given in correlative order. We should be glad to give other
extracts to demonstrate the utility of the volume, but one may
suffice on Desertion.'
Mr. CRUMP, we may observe,

in this treatise on the Law of Average and Insurance, has sup-
plied a ready armoury of reference."-Shipping and Mercantile
Gazette, April 16.
