54 (inclusive) relate to copyhold; and the provisions for barring estates tail and remainders and enlarging base fees in freehold lands, are made to apply to copyhold, with this difference, that the process is to be effected, as to legal estates, by surrender in the Lord's Court, and, as to equitable estates, either by surrender or deed, vide supra. 126. Upon the construction of sections 33 and 48, see 3 Myl. & K. 245. 247. 249. 250.

Sections 55 to 69 relate to Bankrupts and apply also to lands in Ireland. By the first of these clauses the present Bankrupt act, so far as relates to estates tail, is repealed, and by the subsequent clauses the Commissioners of bankrupt are empowered (by deed to be enrolled in Chancery within six months after its execution) to bar estates tail and remainders, and create base fees; and also to enlarge base fees in freehold and copyhold lands, and to dispose of them to purchasers for the benefit of the creditors: these sections also contain provisions respecting the consent of protectors of estates tail and base fees vested in bankrupts, vide supra, p. 125.

Section 70 repeals the stat. 7 Geo. 4. c. 45., and sections 71 & 72 relate to money to be laid out in lands to be entailed, vide supra, 128. and 465-467. Sections 73 to 76 (inclusive) relate to the enrolment of deeds. In reference to sect. 71. see 3 Rus. & Myl. 249.

The fourth set of enactments, sections 77 to 90 (inclusive), relate to conveyances by married women, and comprise provisions for their separate examination, and the acknowledgement of the deeds in which they concur. In reference to sections 81. 82.83. See 3 Bing. N. S. 304. to section 84. See 1 Bing. N. S. 265.

Sect. 91. empowers the Court of Common Pleas to dispense with the concurrence of the husband where he is lunatic, or otherwise incapable of executing the deed, or where his

(28th August, 1833) an act for remedefects of title in lands allotted dying a defect in titles to lands, &c. allotted, sold, divided, or under inclosure exchanged under acts of inclosure, in consequence of the award not having been enrolled, or not having been enrolled within the time limited by the several acts; and for authorizing the appointment of new commissioners in certain cases, where the same shall have been omitted. 4 & 5 Will. 4. c. 22. (16th June, 1834) an act to amend the statute 11 Geo. 2. c. 19. respecting the apportionment of rents, annuities, and other periodical payments. It is noticed, supra, p. 274.

4 & 5 Will. 4. c. 23. (27th June, 1834) this statute amends the law relating to the escheat and forfeiture of real and personal estate held in trust. Where a trustee or mortgagee dies

without heir, the Court of Chancery, by s. 2., is empowered to appoint a person to convey in the manner provided by the 11 Geo. 4, and 1 Will. 4. c. 60. Section 3 enacts, that real or personal estate vested in a trustee or mortgagee shall not escheat, or be forfeited by reason of the attainder of such trustee or mortgagee.

5 & 6 Will. 4. c. 69. (9th September, 1835.) An act for facilitating the conveyance of workhouses and other property of parishes and of incorporations or unions of parishes. The act (s. 2.) gives power to the overseers and guardians of the poor to sell, exchange, let, or otherwise dispose of any parish lands and property, and to apply the money in the purchase building, or providing of a workhouse or otherwise, for the permanent advantage of the parish as the poor law commissioners may approve.
