ABDY, Judge of the Colchester County Court Circuit, has been lately guilty of that worst of judicial irregularities, making absurd speeches from the Bench. A garrulous judge is an abomination; a judge who talks about himself and things in general at length during court hours is a blot upon justice; but a judge who at seventy years of age holds himself up to the ridicule of the public should be allowed by the LORD CHANCELLOR to retire for a time in order that the discipline of introspection may produce some evidence to satisfy an impartial mind of his fitness to continue to administer what he believes to be the law. WE have received from a Melbourne correspondent the last Legal Profession Act and amendments, and the latest Rules of Court in reference to that subject. He writes: "As to an English barrister not coming within these amendments and applying under the Act on the ground of having an equivalent qualification, there has as yet been no definite decision; but the Judges are, on good authority, believed to hold the opinion that such could not be admitted. They have refused the application of a barrister of New South Wales, and it is supposed the Act destroys inter-colonial reciprocity. It is, however, believed that the whole subject of the amalgamation and admission will at no long distance of time be considered anew." MR. SPENCER WALPOLE is the editor of the new edition of Dr. Todd's Parliamentary Government in England, in which we are surprised to find the following statement (p. 168): "With the exception of the office of Lord Chancellor, which is political and ministerial, and of the post of Chief Justice of the Queen's Bench, which is usually conferred upon the law officers of the Crown, no such principle would be permitted to prevail in England as that seats upon the Bench should be given to political partisans only." For this wonderful assertion Yonge's Life of Lord Liverpool and Hansard's Debates are cited. Why has Mr. WALPOLE disregarded the history of the last seven years ?-during which political partisans with safe seats, or with none, have won positions on the Bench, which once on a time were reserved for professional eminence and much learning. MR. JUSTICE DAY, by the way, has been making some caustic remarks about political lawyers. He noticed the extraordinary development of briefless barristers into men of importance by the accident of election to the House of Commons. At the same time he appears to have chuckled over the notion that the earlier sittings of the House must cut into afternoon consultations, and generally play all sorts of tricks with business. We fear successful legal candidates are themselves coming to the conclusion that professional prosperity is not promoted by the parliamentary dignity There is a growing feeling upon the part of suitors that the physical presence of their counsel free from distracting interests and duties at Westminster more than compensates for the absence of parliamentary "honours." WE hear of a curious revenue point. A practice has recently sprung up in commercial circles of combining a cheque and a receipt in one document. This takes the form of a cheque upon a banker, and is to be signed on the face by the payee, and dated. The document bears a notice to the effect that the bankers will pay the sum stated on presentation through a bank, provided it be accompanied by the receipt attached thereto, duly signed and dated. It will be seen that the effect of this is to do the work of two stamps with one in all cases where the amount is for £2 and upwards. Consequently the Revenue is deprived of the stamp which is required on a legal receipt. We understand that recently the authorities have awakened to this fact, and have demanded that a second stamp be put upon the instrument. So far we have only discovered one exception to this practice, viz., when the remittance is a Government cheque drawn upon the Paymaster-General. WE notice that Mr. LANE, Q.C., the new police magistrate, has been explaining to the public the law as to "notnegotiable" postal orders. In this case a sum which was sent in postal orders was stolen. The thief took the orders to a tradesman, who gave him cash, and then passed them (they being presumably crossed) through his bank. In this way the real payee of the orders was able to discover his loss, and is entitled to recover the amount of the orders from the tradesman who cashed them. This is an admirable objectlesson as to the meaning of the words "not negotiable," viz., that the holder cannot give to another a better title than he himself has. But, as we have pointed out, this is the only case in which the addition of these words to a postal order can be of any use to the public. For the rest, they only confuse the popular mind. For the words "not negotiable do not mean that the order cannot be negotiated. And it is questionable whether the originators of the phrase in that otherwise admirable statute, the Bills of Exchange Act of 1882, quite understood what the consequences would be when they devised it. Ir is recognised as a fraud for a man to settle his own property on himself till he becomes bankrupt, and then over, and the court would declare such a settlement to be void. There In is no difference in principle between the case of a private individual and a member of a partnership in this respect. Collins v. Barker (noted ante, p. 263) an attempt was made to evade this salutary rule. A. (the father of the other three), B., C., and D. were partners under articles which provided that, in the event of the bankruptcy of any of the partners, his share in the capital should remain as a loan to the other partners during the residue of the term for which the partnership was created. A., B., and C. all became insolvent, and the trustees in their bankruptcy brought this action against D., who remained solvent. This was obviously an attempt on the part of the father and his sons to keep the money in the partnership, even though the individual partners might become bankrupt. The law will not permit this, and Mr. Justice STIRLING treated the case before him as if there had been no such clause in the partnership articles. FOR applicants for writs of certiorari to remove convictions into the High Court the case of Ex parte Reynolds, before the LORD CHIEF JUSTICE and Mr. Justice CAVE on the 19th Jan. and again on the 20th, is important as showing that the rule as to giving the justices before whom the conviction took place six days' notice in writing of the intended application will be strictly enforced. The rule which requires this is rule 33 of the Crown Office Rules, and by this rule the applicant for a writ of certiorari must show by affidavit that he has given six days' notice in writing to the justices by whom the judgment, order, or conviction complained of was made, and the object of this provision is stated in the rule to be, that the justices, or the parties concerned therein, may, if they think fit, show cause against the granting such writ. In the case before the court a notice had been given to the magistrate and counsel was present on his behalf, but, as it was not a six days' notice, the Court refused to hear the application. In such a case the difficulty cannot be got over by applying for a habeas corpus, for when on the following day a fresh application was made under the form of a writ of habeas corpus, the Court refused to hear that also, on the ground that, as no doubt a writ of certiorari was the proper remedy -if any-the court would not by granting a habeas corpus enable the applicant thereby to get out of his difficulty as to six days' notice, and that, moreover, upon an application for a habeas corpus the court cannot look at the conviction if the order is legal in form. If the order of commitment is good on the face of it, then a writ of habeas corpus is not the proper remedy for getting rid of the conviction, which must be done by certiorari, and the application for the certiorari must be made after a six days' notice in writing to the justices, and the motion should be made upon a verified copy of the conviction, which ought to be annexed to the affidavit and handed to the officer of the court before the motion is made. THE law of copyright, as is well known, has long needed amendment. So long back as 1878 a Royal Commission, of which the present LORD CHANCELLOR was a member, reported that the existing term of copyright for the life of the author and seven years after his death, or forty-two years from publication, whichever should be the longer-ought to be altered to a term of the life of the author and thirty years afterwards; that newspaper copyright should be properly recognised; that the dramatisation of novels without the leave of the novelist should be prohibited; and that the term of copyright of the magazine proprietor as against the magazine writer should be cut down from twenty-eight years to three. The Commissioners also emphatically denounced the unintelligible and complicated language of the Copyright Acts. In 1891 a comprehensive Bill, modelled on this report, which had been prepared under the auspices of the Society of Authors, was introduced in the House of Lords by Lord MONKSWELL, and allowed by the Lord Chancellor, Lord HALSBURY, to be read a second time on the curious condition that it should be no further proceeded with. As Lord HERSCHELL urged the Government of that day to take up the question and settle it, and as the American International Copyright Act has been passed since then, it would not be very surprising if a Bill to consolidate and amend the law of copyright should form one of the Government measures of the ensuing session. THE official settlement of litigation as a substitute for the settlement by the courts of law will probably soon be tried on a large scale, and in a very important subjectmatter.
