(2) This section shall not apply where the counter-petition is one presented under section 14 of the principal Act praying that a week day other than the day stated in the petition shall be the compulsory half-holiday in a proposed Shopping District.

E it Enacted by the Governor of the State of South Australia, with the advice and consent of the Parliament thereof, as follows:

1. This Act may be cited as the "Surplus Revenue Act, 1925."

Notwithstanding anything to the contrary contained in the Appropriation of Surplus Revenue Act, 1906, or any other Act, the sum of Fifty- the extent of Fifty. three Thousand and One Pounds Six Shillings and One Penny three Thousand and standing to the credit of General Revenue in the accounts of the One Pounds Six Shillings and One Treasurer on the thirtieth day of June, one thousand nine hundred Penny. and twenty-five, is hereby appropriated towards the repayment of certain advances made by the Treasurer, which advances are more fully described in the Schedule hereto.

In the name and on behalf of His Majesty, I hereby assent to this Bill.

An Act to make provision for granting Legal

Assistance to Poor Persons.

[Assented to, December 10th, 1925.]

E it Enacted by the Governor of the State of South Australia, with the advice and consent of the Parliament thereof, as follows:

1. This Act may be cited as the "Poor Persons Legal Assistance Short title. Act, 1925."

2. Every reference in this Act to any rules or rules of court shall Interpretation. include a reference to any rules or rules of court made in substitution for the said rules or rules of court.

3. (1) Any person committed for trial for an indictable offence against the laws of South Australia may at any time before the jury is impanelled for the trial of such offence apply to a Judge for the appointment of counsel for his defence.

(2) If

(a) the offence for which the person is committed for trial is punishable with death, or is such that in the opinion of the Judge the person committed for trial should be defended by counsel; and

(b) the Judge is satisfied that the person committed for trial is without adequate means to retain counsel or summon witnesses,
