sustains serious injuries. Has he any remedy against the corporation?" The counsel for the plaintiff were Messrs. E. Holland Hughes and S. Dean, and for the defendant corporation, Messrs. A. Lawrence Kershaw and J. R. Hodnett. The chairman, having summed up, put the question to the meeting, which resulted in the plaintiff succeeding. The voting was twenty-nine to eighteen.

Mr. FIENNES CECIL ARTHUR BARRETT-LENNARD has been appointed to be Chief Justice of Jamaica. Mr. Barrett-Lennard was called by Lincoln's Inn in 1905, and was appointed to be a judge in East Africa in 1915. In 1920 he was made a Justice of the Supreme Courts of the Straits Settlements, Federated Malay States, and Johore.

(Q. 52.) INTESTACY-WIDOW OF INTESTATE-CHILDREN OF INTESTATE. To be effective this should be carried out by the deed, by which the real and personal property would be conveyed and assigned to the widow to hold during her widowhood. The ordinary form of voluntary settlement could be adapted, and it would have to be stamped with ad valorem duty under sect. 74 of the Finance (1909-10) Act 1910. JOHN BOYD.

(Q. 53.) CONVEYANCE CHARGE-TITLE.-It depends upon the nature of the charge. The following are authorities in point : Re Henson (99 L. T. Rep. 336; (1908) 2 Ch. 356); Re Cary and Lott (84 L. T. Rep. 859; (1901) 2 Ch. 463); Colyer v. Finch (5 H. L. Cas. 905; 26 L. Jour. 65); Chamberlain v. Chamberlain (1 Ch. Cas. 257). JOHN BOYD.

This subject is discussed in Key and Elphinstone's Conveyancing Precedents, 10th edit., vol. 1, p. 1124. The learned editors say that if the charge is in the words of the Act it is pretty clear that C. can sell free from the charge, because if the purchaser had to see that the purchase money was applied in payment of the charge he would have to see to the administration of the estate. (Q. 54.) LAW OF PROPERTY ACT-POSITIVE COVENANTS.—Presumably sect. 79 of this Act does not alter the law of Austberry v. Corporation of Oldham (53 L. T. Rep. 543; 29 Ch. Div. 750). But this might have been made clearer : (see Guide to the New Property Statutes by the Editors of Law Notes, p. 149). This section only applies to covenants made after the 1st Jan. 1926 (Law of Property Act 1925, s. 79, sub-s. 3). G. O. S.

ANSWERS

(Q. 47.) ADMINISTRATRIX RENT DISTRAINT. - The landlord can distrain for a year's rent (or less) after it becomes due (Agriculture Holdings Act 1923, s. 34). No leave is necessary, the Rent Restrictions Acts not applying. If the rent is not by agreement payable in advance I see no way of securing future rent. JOHN BOYD.

It is difficult to see why an application to the court is necessary, unless the rateable value of the premises brings them within the Rent Acts: (Act of 1920, s. 6). The Courts (Emergency Powers) Acts under which an application to the court would be necessary expired on the 31st Aug. 1922: (War Emergency Laws (Continuance) Act 1920, s. 1, First Schedule). This of course assumes that the premises are situate in England. G. O. S.

(Q. 50.) TRUSTEE ACT 1925-ADMINISTRATION OF ESTATES ACT 1925. The husband can give a valid receipt for the purchase money of the land by virtue of sect. 27 (2) of the Law of Property Act 1925, as this section, after stating that the purchaser is not to be concerned with the trusts of the proceeds of sale, which are to be paid to two or more trustees, states that sub-sect. 2 of the section does not affect the right of a sole personal representative as such to give valid receipts for or direct the application of the proceeds of sale or other capital money aforesaid, &c. Sect. 33 of the Administration of Estates Act 1925 is only applicable on the death of a person intestate. H. H.

It is submitted that the husband can give a receipt for the purchase money under sect. 27, sub-sect. 2, of the Law of Property Act 1925. He sells the land as personal representative for payment of debts and death duties, and not as trustee in accordance with the terms of the will G. O. S.

(Q. 51.) OVERHEAD WIRES.-The presumption-which, however, may be rebutted-is that the soil of the street belongs to the adjoining property owners on each side up to the middle, the public merely having the right (dedicated by the owners) to pass over it. But local authorities have generally statutory powers to cause the removal of any projections into the street from buildings or otherwise (see the Towns Improvement Clauses Act 1847, s. 69, but it would appear to be necessary to show that the projection obstructed the passage along the street). The local authority should be asked what powers they have. JOHN BOYD.

The answer to this query depends upon whether the local authority have adopted Part II. of the Public Health Act 1925. Under sect. 25 of that Act no wires or other apparatus can be erected without the consent of the local authority. As to the mode of adoption see sect. 5. Apart from that Act I do not think a local authority can prevent the erection of aerials, but they may be. able to prevent the erection of electric light wires. See the Electricity (Supply) Acts 1919 and 1922. G. O. S.

THE NEW CONVEYANCING JOINT TENANCY.-Since writing last week I have had the privilege of reading Sir Benjamin Cherry's second lecture and his answers to the various queries put to him. These not only show the extra trouble and expense to which a surviving joint tenant will be put in order to make a title, as compared with the existing state of affairs, but, if I may be allowed to say so, they illustrate the absurdity of the new situation. Sir Benjamin states in answer to Mr. Milliken's question (b), that if one tenant in common, A., releases his interest to his co-trustee and co-beneficial owner, B, the release will show that B. is absolutely entitled, and presumably he can afterwards make a good title alone. The very fact that one trustee conveys or releases to his co-trustee is open to objection apart from the fact that an equitable interest seems to be brought on the title. The answer to Mr. Milliken's next question (if I rightly understand it) is that if A. bequeaths his interest to B. and then dies, B. cannot make a good title by himself as surviving trustee, and the bequest should not be brought on the title, but B. can convey the land to himself and show by recitals that the trust has ceased. How he can do this to a purchaser's satisfaction without bringing the will on the title I am at a loss to understand. Moreover, who would accept such a recital unless it was twenty years old? I now turn to the answer to Mr. Howey's question and find that I was right in my contention last week that a surviving joint tenant cannot sell alone, but must appoint another trustee to act with him in order to give a valid receipt. The position, therefore, appears to be this: A surviving joint tenant can vest the land in himself absolutely and beneficially, but if he wishes to sell it he must first appoint another trustee ! OBITUARY

Mr. JOSEPH FARMER MILNE, solicitor, died on the 7th inst., at Southport, at the age of seventy-nine years. He was admitted in 1868, and practised in Manchester, where he was a member of the firm of Messrs. Hinde, Milne, and Bury. Mr. Milne was on the council of the Law Society for many years. He was also a member

of the Solicitors' Benevolent Association and of the Manchester Law Association.

Professor Dr. JOSEPHUS JITTA, the eminent international jurist, died recently at The Hague, at the age of seventy-one years. He was President of the Netherlands Committee for International Civil Law and presided at the meetings of the International Law Association a few years ago when they were held at The Hague. Professor Jitta was also a member of the University of Amsterdam and a member of the Council of State.

Mr. HENRY STRAUS QUIXANO HENRIQUES, K.C.. died in London on the 12th inst., at the age of fifty-nine. Mr. Henriques was the eldest son of the late Mr. E. M. Henriques, of Manchester, and was educated at Manchester Grammar School and Worcester College, Oxford. He obtained the Vinerian University Scholarship in 1891. Mr. Henriques was called by the Inner Temple in 1892 and took silk in 1921. He was much interested in legal learning, was one of the committee of the Grotius Society and of the International Law Association. Mr. Henriques was also the author of several

works dealing with the Law and the Jews. He will long be remembered for his kindness and generosity in the social work he carried on in the East End of London.

Mr. JOHN JACOB DIXON, Solicitor, died on the 13th inst. at the age of eighty-two years. Mr. Dixon was admitted in 1867, and was a member of the firm of Messrs. J. J. Dixon and Son, of Northwich, in which town he practised for fifty years.
