The circumstance of an action having been brought by the assignees of a bankrupt without first obtaining the leave of the Court of Bankruptcy, pursuant to the 12 & 13 Vict. c. 106, s. 153, gives the court in which the action is brought no power to stay the proceedings on motion. Nor can the absence of such leave be pleaded as a defence to the action. Neither is it a ground of objection on the part of the defendant, that the name of the official assignee has been used without his consent. THIS was an action brought in the names of the official assignee and the trade assignees in respect of a debt alleged to be due from the defendants to the bankrupt. The defendants had been summoned under the 120th *section of the 12 & 13 Vict. c. 106, and admitted that they owed the estate 361. 188. 1d.
