Melbourne Harbor Trust Act 1890 and Section Twenty of the Marine Act 1890.

E it enacted by the King's Most Excellent Majesty by and with the advice and consent of the Legisative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1. This Act may be cited as the Wharfage and Harbors Rates Act 1904.

2. In section one hundred and ten of the Melbourne Harbor Trust Act 1890, the words "and goods arriving coastwise from any place within Victoria" are hereby repealed.

3. In section one hundred and eleven of the Melbourne Harbor 111 of No. 1119. Trust Act 1890, for the words "the amounts contained in the Seventh Schedule to this Act" there shall be substituted the words "in any case the amount of five shillings per ton calculated by weight or measurement at the option of the Commissioners."

4. In section twenty of the Marine Act 1890 the words " and goods arriving coastwise from any place within Victoria" are hereby repealed.

E it enacted by the King's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):—

1. This Act may be cited as the Juries Act 1904, and shall be read and construed as one with the Juries Act 1890, and the said Act and any Act amending the same and this Act may be cited together as the Juries Acts.

2. On proof on oath or affidavit to the satisfaction of the Judge of any court before which any person is summoned as a juror that such person ought to be excused from attendance by reason of any matter See 39 & 40 Vict. of special urgency or importance, such Judge may if he thinks fit discharge in open Court such person from further attendance on such court or excuse such person from attendance for any period during the sittings of such court.

Justices may be exempt from

serving as jurors.

3. Justices of the Peace shall be exempt from serving as jurors if and whenever they so desire. Provided that on the application of any Justice of the Peace personal or by writing a Revision Court shall omit his name from the list then being revised.

E it enacted by the King's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):—

1. This Act may for all purposes be cited as the Wild Dogs (Con- Short title and tinuation) Act 1904, and shall be deemed to have come into force on the last day of July One thousand nine hundred and four.

2. The Wild Dogs Act 1901 (except section nine thereof) shall be Continuation of and the same is hereby revived and shall continue in full force and effect until Parliament otherwise determines.

DECLARING OF BOROUGHS ACT 1904.

E it enacted by the King's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1. This Act may be cited as the Declaring of Boroughs Act 1904, Short title and and shall be read as one Act with the Local Government Act 1903 No. 1893. (hereinafter called the Principal Act) and such Acts and any Acts amending the same may be cited as the Local Government Acts.

2. In addition to the powers conferred by section sixteen of the addition to s. 16 Principal Act the Governor in Council may also from time to time of No. 1893. make orders exercising the power conferred in the following paragraph which shall be inserted in the said section immediately following paragraph (13):

(14) To declare any shire in Victoria not exceeding in area nine square miles and having no point in such area distant more than six miles from any other point therein, and containing a population of inhabitant householders of not less than five hundred and containing rateable property capable of yielding upon a rate not exceeding One shilling in the pound on the annual value thereof estimated under the provisions of this Act a sum of Three hundred pounds, a borough. Provided that it shall be lawful for the Governor in Council to declare the Shire of Camberwell and Boroondara a borough notwithstanding that its area exceeds nine square miles, and that in such area there are points distant more than six miles from other points therein.

3. In sub-section one of section thirty-four of the Principal Act after the word "declaring" there shall be inserted the words " any shire a borough or" and after the words " called a" there shall be inserted the word "borough."

4. The following paragraph shall be inserted at the end of subsection one of section thirty-six of the Principal Act; and

(j) To declare any shire capable of being constituted a borough under the provisions of the Local Government Acts a borough with the common seal of such shire.

5. Where under the Principal Act or any Act thereby repealed any order has prior to the passing of this Act been made by the Governor in Council declaring any shire a borough such Order in Council and all acts deeds matters and things made done or suffered thereunder or by virtue or in consequence thereof or depending upon the same for their force effect and validity shall as from the date when the order was published in the Government Gazette have the same force effect and validity as if the provisions of this Act had been in force at such date and as if such order had been made pursuant to such provisions.

2. (1) In sub-section (1) of section three of the Vermin Destruc- Amendment of tion Act 1899 for the words " brush and scalp of such fox or foxes there shall be substituted the words "skin of every such fox with the brush and scalp attached thereto and without any letter perforated therein."

(2) In sub-section (2) of such section for the words "brush and scalp" there shall be substituted the words "skin with the brush and scalp attached thereto."

3. The secretary or other authorized officer of a municipality after Municipal officer receiving from any person the skin of a fox with the brush and scalp skins before attached thereto shall legibly stamp or mark such skin as nearly as selling. possible in the middle thereof with five or more small holes perforated therein representing the letter V; and after being so perforated such skin with the brush and scalp shall belong to and may be sold by such municipality.

4. At the end of section four of the Vermin Destruction Act 1899 Addition to there shall be added the following sub-section :-

(3) The sum payable by the Governor in Council shall not exceed one-half of the difference between the amount paid by the council of the municipality by way of bonus or reward and the amount received by such council for the sale of skins in each year.

1. This Act may be cited as the Dairying Companies Act 1904, Nos 1649, 1673, and shall be read as one with the Dairying Companies Act 1900 the Dairying Companies Act 1900 (No. 2) the Dairying Companies Act 1903 and the Dairying Companies Act 1903 (No. 2).
