(2.) As to the Public Health Act, 1848. By "The Public
Health Supplemental Act for Aldershot, 1857," it was
enacted as follows:-

This award was made and published on the 20th January 1857 by Nathan Wetherell, Esq., of Lincoln's Inn, Barrister at Law, an assistant Inclosure Commissioner, duly appointed under the Act. The plan (marked D7), illustrating the award, is in the custody of the Chief Draftsman, War Office.

On the 9th July 1847, "The Midland Great Western Railway 10 & 11 Vict.,
of Ireland (Athlone to Galway) Act, 1847," was passed, which c. 176, sec. 13.
enacted that the company therein mentioned should construct,
to the satisfaction of the Principal Officers of Her Majesty's
Ordnance, proper bridges, two in number, and giving a clear
roadway each of not less than 30 feet independent of the foot-
way, which is to be 7 feet, and to be carried over the railway,
if required by the Board of Ordnance, or if carried under the
railway by their consent, with not less headway than 16 feet,
with proper retaining walls to the same, for the purpose of
providing access to the property of the said Board of Ordnance
which would be severed by the said railway at Athlone and
Galway respectively.

On the 29th July 1850, "The Midland Great Western
Railway of Ireland (Deviations and Amendment) Act, 1850,"
was passed, which contained these sections relating to War
Department Property :-

Whereas the said Railway Company are desirous of con- 13 & 14 Vict., structing a new road as an approach to their railway terminus c. 88, sec. 8. on the Roscommon side of the River Shannon which will interfere with the property now vested in the said Principal Officers of Her Majesty's Ordnance, and not only destroy the barrack drainage, but also the present boundary wall and all buildings attached theroto: be it therefore enacted, that the said railway company shall construct and make the new road to the full and entire satisfaction of the said Principal Officers, and in accordance to the design already agreed to by the said company and the Commanding Royal Engineer in Ireland, so as that the entire length and breadth of the said road shall be plainly seen and commanded from the north-east tower of the Castle Barrack, Athlone, and also that the said company shall reconstruct, complete, and finish the said barrack boundary wall according to the plans and to the entire satisfaction of the said Principal Officers, and shall also construct to the satisfaction of the said Principal Officers, and such Officers or Officer as shall be authorised by them to oversee or to approve and inspect the same, a main conduit or sewer along the said barrack boundary, finishing and connecting the same with that conduit or sewer recently built and made by the Board of Public Works on the south side of the bridge over the River Shannon, and shall also provide for the said sewer a sluice gate and communication into the river for the purpose of flushing the same at will and pleasure.

And be it enacted, that in making the said line of railway Ibid, sec. 9. constructing through the glacis of the Tête de Pont and lands adjcining at Railway through Ord- Athlone, being property of or vested in the Principal Officers of Her Majesty's Ordnance, the said railway company shall construct and complete and finish the excavations and works. connected with their line where it passes through the Ordnance property to the satisfaction of the Master-General and Board of Ordnance, and also construct and complete in like manner such

railway company shall not erect or permit to be erected any
buildings or other obstructions within the same extent without
the consent in writing of the Master-General and Board of
Ordnance.

Ayr.

On the 21st July 1879, "The Ayr Harbour Amendment Act, 1879" (42 and 43 Vict., c. 140) received the Royal Assent, and enacts as follows:

make slip dock and other works.

Subject to the provisions of this Act, the trustees may make and maintain, in the lines and according to the levels shown on Trust oli the deposited plans and sections, the works hereinafter specified, and all proper approaches and other works and conveniences in connection therewith respectively, and may enter upon, take, and use such of the lands delineated on the said plans and described in the deposited book of reference (except as hereinafter provided) as may be required for and in connection with those works and for the other purposes of the harbour. The works herein before referred to and authorized by this Act

are

(1.) A slip dock, extending from the southern bank of the
river Ayr, at a point about 50 yards northward from
the lifeboat house at the harbour, to a point about 90
yards northwestward from Cromwell Cottage, with a
drawbridge or swingbridge across the same near the
lifeboat house, and ways, rails, an engine-house,
hydraulic or other machinery, and appurtenances;
(2.) A road of access and wharf along and adjoining the
north quay of the harbour and the quay on the
eastern side of the entrance to the said wet dock,
commencing at or near the junction of York Street
with North Harbour Street, and terminating at or
near the entrance gates of the said wet dock; and
(3.) A drawbridge or swingbridge across the entrance to
the said wet dock at or near the dock gates thereof:
Provided always, that the trustees shall not, without the
previous consent in writing of Her Majesty's Principal Secretary
of State for the War Department for the time being, enter upon,
take, or use any part of the lands numbered on the deposited
plans and book of reference 9,1 in the parish of Ayr, until they
shall have provided for the public service, upon a site to be
reclaimed by the trustees about 40 yards seaward from the
present site, or upon such other convenient site as may be
agreed upon between the said Secretary of State, the trustees,
and the provost, magistrates, and council of the royal burgh of

Exemption of

Ayr, a new battery, enclosed by a fence or wall, together with
a powder magazine and shothouse, equal in dimensions, con-
struction, and convenience to those now existing on the said
lands, and to be held and used by and on behalf of the said
Secretary of State upon the same conditions as he now holds
the said existing buildings.

Burntisland Low Water Pier.

The "Edinburgh, Perth, and Dundee Railway (Consolidation) Act, 1851," contains an exemption, by the 146th Section, in favour (inter alia) of the War Department.

Nothing in this Act contained shall extend to charge with 14 & 15 Viet certain vessels rates or duties, or to regulate or subject to any control, any c. 55 (1. & P.) in the service vessel belonging to or employed in the service of Her Majesty, or Majesty, &c. any of the officers or persons employed in the service of the Ordnance, or their baggage, or any Naval, Victualling, or Ordnance Stores, or other stores or goods for the service of or being the property of Her Majesty, or any troops landed upon or delivered or disembarked from any of the said piers, wharfs, quays, harbours, locks, cuts, docks, and other works, or their baggage; but all such vessels, officers, or persons as aforesaid shall have the free use of the said piers, wharts, quays, harbours, locks, cuts, docks, and other works, without any charge or rate being made for using the same. Provided always, that if any person claim and take the benefit of any such exemption as aforesaid, without being entitled thereto, he shall, for every such offence, be liable to a penalty not exceeding Ten Pounds."

The 32 Geo. II., c. 30, renders the lands taken by the Crown liable to the payment of land tax, and all parish rates in proportion with other lands and premises in the parish, and makes the storekeepers the occupiers for rating purposes.1
