CHAPTER 152.

An Act respecting Agreements for the Sale of
Farm Machinery.

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of Alberta, enacts as follows:

1. This Act may be cited as "The Farm Machinery Act." [1913(1), c. 15, s. 1.]

Interpretation.

2. "Farm machinery" in this Act shall include every implement and machine purchased by a farmer for use upon a farm, and every engine, threshing machine, steam plow, binder and mower. [1913(1), c. 15, s. 2.]

Void Covenants, etc.

3. No covenant, proviso, stipulation or condition in any agreement (whether under seal, written or oral) shall be binding upon the purchaser of farm machinery, if a court or judge decides or declares that such covenant, proviso, stipulation or condition is, under all the facts and circumstances of the case, unreasonable.

4.-(1) Notwithstanding anything contained in any agreement to the contrary, the vendor shall be responsible for all representations made by his agent or agents during the negotiations of sale.

(2) All persons conducting negotiations on behalf of the vendor which terminate in an actual sale shall be deemed to be agents of the vendor. [1913(1), c. 15, s. 4.]

Warranties.

5. (1) Notwithstanding anything in any agreement contained to the contrary all farm machinery shall be sold as warranted and guaranteed to be made of good material, to be properly constructed both as to design and workmanship, to be in good working order, to perform satisfactorily the work for which it is intended, to be free from latent and other defects and to be in every way so designed and constructed as with proper care and use to ensure reasonable durability. (2) Notwithstanding anything contained in any contract Spare parts or agreement, there shall be implied in any contract or agreement for the sale of farm machinery (whether under seal, written or oral) a warranty to the effect that all repairparts in adequate quantities for the said machinery are kept by the vendor and will be so kept for a period of ten years from the date of the said agreement, and may be obtained at the place of business of that agent of the vendor who is nearest to the purchaser or at some other well advertised point in the Province:

Provided that the keeping by the manufacturers or general provincial distributors thereof of a stock of the necessary repairs for farm machinery as aforesaid on hand at two places of business in the Province at least one hundred and fifty miles apart, shall be deemed to be a compliance by a vendor with the terms of the contract or agreement as set out in this section. CHAPTER 153.

An Act respecting the Purchase and Sale of Eggs.

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of Alberta, enacts as follows:

Short Title.

1. This Act may be cited as "The Sale of Eggs Act."

Interpretation.

2. In this Act, unless the context otherwise requires,-
(a) "Inspector" shall mean any official appointed by
the Minister of Agriculture for the purpose of
inspecting eggs;

(b) "First handler" shall mean a person, firm, cor-
poration or association purchasing eggs direct
from the producer;

(c) "Minister" shall mean the Minister of Agriculture; (d) "Unwholesome eggs" shall mean eggs known as "yolks stuck to the shell," "heavy blood rings," "partially hatched," "mouldy eggs," "black spots," "black rots," "mixed rots, " "addled eggs," and otherwise unwholesome eggs, unless they have been broken in the shell and then denatured so as to render the same unfit for human food.

General Provisions.

3. No person, firm, or company in the Province of Alberta shall buy, sell or have in possession for sale, unwholesome eggs. [1919, c. 28, s. 2.]

4. All first handlers, whether country merchants, hucksters, city merchants, or produce dealers shall candle all eggs received by them, and shall reject all unwholesome eggs. [1919, c. 28, s. 3.]

5. All eggs placed in cold storage for a period exceeding sixty days must be candled as provided in section 4 of this Act, and must be packed in new dry cases provided with new fillers and flats. [1919, c. 28, s. 4.]

6. The Minister may from time to time appoint such inspectors and other officers as may be required to carry out the provisions of this Act, and may fix their remuneration and define their duties. [1919, c. 28, s. 5.]

7. Every inspector appointed under this Act shall have Powers of full power to enter any premises where eggs are sold or offered for sale, and to inspect all eggs on hand.

8. Every person violating any of the provisions of this Penalties Act shall be guilty of an offence and shall on summary conviction be liable to a penalty of not more than one hundred dollars and costs:

Provided that no person shall be convicted of the purchase, sale or possession for sale of unwholesome eggs, unless such eggs form more than a one-hundredth part of a total number of eggs purchased, sold, or possessed for sale at any one time. [1919, c. 28, ss. 7, 2.]

CHAPTER 154.

An Act to Prevent the Profanation of the Lord's

Day.

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of Alberta, enacts as follows:

Penalty

1. This Act may be cited as "The Lord's Day Act of Alberta."

Prohibition of Labour and Amusement.

2. No merchant, tradesman, artificer, mechanic, workman, labourer or other person whatsoever shall on the Lord's Day sell or publicly show forth or expose or offer for sale or purchase any goods, chattels or other personal property or any real estate whatsoever, or do or exercise any worldly labour, business or trade of his ordinary calling; travelling or conveying travellers or His Majesty's mails, selling drugs and medicines and other works of necessity and works of charity only excepted. 3. No person on that day shall play at billiards or pool in any public room or run races on horseback or in vehicles of any sort or discharge fire arms or engage in any game or games in any public place or engage in hunting or in the pursuit of game; except that any traveller, family or other person in a state of actual want may engage in hunting or kill game to satisfy his or their immediate wants.

4. All sales and purchases and all contracts and agreements for sale or purchase of any real or personal property whatsoever made by any person or persons on the Lord's Day shall be utterly null and void. [C.O. 1898, c. 91, s. 3.]

Penalties.

5. Any person violating any of the provisions of this Act shall be guilty of an offence and upon summary conviction thereof be liable to a fine not exceeding one hundred dollars and costs of prosecution. [C.O. 1898, c. 91, s. 4.]
