CHAPTER 161.

An Act respecting Co-operative Credit.

IS MAJESTY, by and with the advice and consent of the Legislative Assembly of the Province of Alberta, enacts as follows:

Short Title.

1. This Act may be cited as "The Alberta Co-operative Credit Act." [1917, c. 11, s. 1.]

2. In this Act, unless the context otherwise requires,-
(a) "Extra-municipal area" shall mean all that part
of the Province which is not included in a muni-
cipality;

(b) "Lender" shall mean any chartered bank, financial
corporation authorized to do business in the
Province, firm or person loaning money to sub-
scribers through a co-operative credit society;
(c) "Municipality" shall mean a city, town, village, or
municipal district.

Organization.

3. The Lieutenant Governor in Council may authorize the organization of co-operative credit societies in the Province for the purposes and with the powers hereinafter set out. [1917, c. 11, s. 3.]

4. (1) The organization of such societies may be initiated by a petition which may consist of one or more parts in form A in the schedule hereto, or to the like effect, signed by not less than fifteen farmers or persons engaged, or agreeing to engage within one year, in farming operations of the kinds hereinafter referred to, who subscribe for stock in the proposed society at par value to the amount of not less than one thousand five hundred dollars, upon which not less than twenty per cent. has been paid in cash and the balance secured by the subscriber's promissory note payable to the society, according to the tenor thereof, with interest at six per cent. per annum.

(2) The petition shall be addressed to the Provincial Treasurer and shall set out

(a) the names of the petitioners, their respective addresses and occupations, the lands owned or

occupied by each or intended to be used for the
purpose of this Act and the amount agreed to be
subscribed by each of them to the capital of the
proposed society, which amount shall be not
less than one hundred dollars;

(b) that the petitioners are desirous of organizing a
co-operative credit society within the Province
for the purposes and with the powers conferred
by this Act;

(c) the location of the chief place of business of the
society, and if outside the limits of a city, town
or village stating section, township and range;
(d) the name of the proposed society;

(e) the amount of the capital stock and the number
of shares into which such stock is divided and the
amount paid in cash on account of each sub-
scription;

(f) the names of four of the subscribers who shall
be provisional directors of the society;

(g) the name of a person whom the petitioners nominate to act as secretary-treasurer of the society until the organization has been completedand the petition or each part thereof shall be accompanied by a statutory declaration of one of the petitioners verifying the facts set out in such petition and the signatures thereto.

(3) Twenty per cent. of the par value of the stock sub- Payments by scribed for by an original subscriber shall be paid in cash prior to the first day of January next but one following the date of the incorporation of the society and a further sum of twenty per cent. of the value of the said stock shall be paid prior to the first day of January next following such last mentioned first day of January and so in each successive year until the full value of the said stock has been paid to the society.

5. (1) A society incorporated hereunder may consist Residence of wholly either of members resident—

(a) in a municipality or municipalities; or

(b) in the extra-municipal area,

or may consist of members some of whom reside in a municipality or municipalities and the others in the extra-municipal area.

(2) Notwithstanding any other provisions of this Act, Minimum any resident of the extra-municipal area becoming a member for resident of of any such society shall subscribe for stock to the amount area of one hundred and fifty dollars.
