BOND of Indemnity (or for quiet enjoyment) from a Vendor to a Purchaser (of Leasehold Premises) where several of the Title Deeds (but how many could not be ascertained) were lost or mislaid.

KNOW all men, &c.

WHEREAS the above bounden A. B. hath sold and conveyed unto the said C. D. a certain messuage or tenement and premises with the appurtenances, situate and being at in the county of as the same are particularly described in a certain indenture of assignment bearing even date with the above-written obligation, and made between the said A. B. of the one part, and the said C. D. of the other part; AND WHEREAS the title deeds between the time of the purchase of the said premises by one E. F. to the time of the sale thereof by one G. H. have been 'lost or mislaid, wherefore the said A. B. hath agreed to enter into the above-written obligation with such condition for making void the same as is hereinafter contained: Now THEREFORE THE CONDITION of the above-written obligation is such, that if the above-named C. D. his executors, administrators, and assigns, shall and do from time to time and at all times hereafter, during the continuance of the term by the said hereinbefore in part recited indenture assigned, peaceably and quietly hold, possess, and enjoy the said messuage or tenement and premises in the same indenture of assignment described, and thereby assigned to and for their own proper use and benefit, without any suit, hindrance, molestation, disturbance, or lawful claim whatsoever, of or by the said A. B. his executors, or administrators, or any other person or persons whomsoever lawfully claiming or to claim by, from, under, or in trust

for him, them, or any or either of them, or from, through, under, or by virtue of the deeds or writings so lost or mislaid as aforesaid, or any or either of them, or in case the said C. D. his executors, administrators, or assigns, shall at any time during the said term be evicted from or dispossessed of the said premises so assigned to him as aforesaid, or any part thereof, by or by reason of any person or persons claiming under or by virtue of the said title deeds and writings so lost or mislaid as aforesaid, or by reason of the said title deeds and writings having been so lost or mislaid, or otherwise in relation thereto; THEN if he the said A. B. his heirs, executors, or administrators shall and do save, defend, keep harmless, and indemnified the said C. D. his executors, administrators, and assigns, and his and their goods and chattels, lands and tenements, of, from, and against all loss, costs, charges, damages, and expenses which he or they, or his or their executors, administrators, or assigns, shall bear, pay, suffer, sustain, expend, or be put unto for or by reason or means of such eviction or dispossession as aforesaid, or for or by reason or means, or on account of such claim as aforesaid, or of the said deeds and writings being so lost or mislaid as aforesaid, or on account of any matter or thing in any wise relating thereto; THEN the above-written obligation to be void, otherwise to be and remain in full force and virtue.

THIS INDENTURE, made the

the year of the reign, &c. and in the year of our Lord 18-, between A. B. of &c. of the 1st part, C. B. the wife of the said A. B. of the 2nd part, and E F. of &c. of the 3rd part. WHEREAS various differences having unhappily arisen between them the said A. B, and C. B. his wife, to the interruption of their repose, they the said A. B. and C. B. his wife have mutually agreed to live sepa rate and apart from cach other, and he the said A. B. hath proposed and agreed to allow and pay the said C. B. his wife, out of his own proper monies, during their joint natural lives and their separation, for her support and maintenance, one annuity or yearly sum of £ clear of all taxes, charges, and deductions whatsoever, payable to her in such manner as is hereinafter mentioned (subject nevertheless to the proviso hereinafter contained respecting the payment of the said annuity.) Now THIS INDENTURE WITNESSETH, that the said A. B. in pursuance of his aforesaid proposal and agreement, doth hereby for himself, his

executors, and administrators, and for every of them, cove nant, promise, and agree to and with the said E. F. his executors, administrators, and assigns, in manner and form following, (that is to say) that it shall and may be lawful to and for the said C. B. his wife, and that he the said A. B. shall and will permit and suffer her the said C. B. from time to time, and at all times from henceforth during her natural life, to live separate and apart from him, and to reside and be in such place and places, and family and families, and with such relations, friends, and other persons as she the said C. B. from time to time, at her will and pleasure (notwithstanding her present coverture, and as if she was a feme sole and unmarried) shall think fit; and that he the said A. B. shall not nor will at any time or times hereafter, sue her the said C. B, in the eccle. siastical court, or any other court, for living separate and apart from him, or any other person or persons whatsoever for receiving, harbouring, or entertaining her; nor shall or will, without the consent of the said C. B. visit her or knowingly come into any house or place where she shall or may dwell, reside, or be, or send or cause to be sent any letter or message to her, nor shall or will at any time hereafter claim or demand any of the monies, rings, jewels, plate, clothes, linen, woollen, or household goods, which the said C. B. now hath in her custody, power, or possession, or which she shall or may hereafter buy and purchase, or which shall be devised or given to her, or she shall otherwise acquire, and that she shall and may enjoy and absolutely dispose of the same as if she was a feme sole and unmarried; AND FURTHER, that he the said A. B. his executors, or administrators, or some or one of them, shall and will well and truly pay unto the said C. B. his

B. in manner as aforesaid, she the said C. B. doth hereby agree to accept and take in full satisfaction for her support and maintenance and all alimony whatsoever during her Coverture; PROVIDED ALWAYS, and it is hereby expressly agreed and declared by and between all the parties bereunto, and the true intent and meaning of them and of these presents is, and are, that in case he the said A. B. his <executors or administrators, shall at any time hereafter be obliged to, and shall actually pay any debt or debts which she the said C. B. his wife shall at any time hereafter, during her present coverture, contract with any person or persons whomsoever, that then and in such case it shall and may be lawful to and for the said A. B. his executors and administrators, to deduct, retain, and reimburse to him and themselves out of the said annuity or ycarly sum of so hereby made payable to her £ the said C.
