An Act to free and discharge Certain Lands from the Trust for the purposes of a Public Hospital at Loxton upon which trust the District Council of Loxton holds the said Lands and confer upon the said Council a clear and marketable Title to such Lands and to authorise the said Council to sell and dispose of such Lands and to use the net proceeds to arise from such Sale in reduction of the debt due upon the Loxton District Hospital and for other purposes.

HEREAS by Land Grant bearing date the 4th day of March Preamble. 1913 and registered in the Lands Titles Registration Office

at Adelaide Register Book Volume 949 Folio 43 His Excellency Sir Day Hort Bosanquet Governor of the State of South Australia did for the consideration therein mentioned in the name and on behalf of His Majesty grant unto Adolph Wilhelm Richard Drabsch Carl August Kaesler Heinrich Rudolph Thiele Arthur McCourt Paul Adolph Heinrich Thiele Friedrich August Hamdorf Friedrich Wilhelm Hamdorf all of Loxton farmers Hugo Theodore Eime of Loxton agent and Friedrich Drogemuller of Moorook farmer thereinafter called the grantee all those sections of land containing three roods or thereabouts situate in the Hundred of Bookpurnong County of Alfred and numbered and delineated in the public maps deposited in the Survey Office at Adelaide and in the plan in the margin of the said land grant except and reserved unto His Majesty His Heirs and Successors all gold silver copper tin and

other metals ore minerals and other substances containing metals and all gems precious stones coal and mineral oil in and upon such land and all incidental powers as provided for in "The Crown Lands Act 1903" to hold unto and to the use of the grantee and the Heirs of the grantee for ever in trust to permit and suffer the said piece of land to be used at all times for hospital purposes AND WHEREAS by Memorandum of Transfer Registered No. 972617 expressed to be made in consideration of the said land being held by the transferors as Trustees for the Loxton Hospital and it having been agreed to transfer the said land to the said District Council of Loxton for the purposes of a Public Hospital the said lands were duly transferred to the said District Council of Loxton to be held by the said District Council upon the Trust aforesaid AND WHEREAS a Hospital and conveniences in connection therewith were duly erected upon the aforesaid lands but were found to be insufficient for the requirements of the District of Loxton and a new District Hospital has been erected on other lands in the said District dedicated as a Reserve for Hospital Purposes and placed under the care control and management of the said District Council AND WHEREAS the necessary moneys to pay for the cost of construction of the said new Hospital have been raised in various ways and there is now due and owing by the said District Council of Loxton in respect thereof large sums of money AND WHEREAS the said District Council of Loxton desires to sell and dispose of the lands comprised in the hereinbefore recited Land Grant and Improvements thereon freed and discharged from the Trust aforesaid at the best price obtainable therefor but is unable to make a clear marketable Title to the said lands without the aid and authority of the Legislature of the said State

Be it therefore Enacted by the Governor of the State of South Australia with the advice and consent of the Parliament thereof as follows:

1. This Act may be cited as "The Loxton District Hospital Purposes Act 1927

2. From and after the passing of this Act the District Council of Loxton shall hold all those sections of land containing three roods or thereabouts situated in the Hundred of Bookpurnong County of Alfred Numbered and 2 and being the whole of 27 11 F the lands comprised in Land Grant dated the 4th day of March 1913 and registered in the Lands Titles Registration Office at Adelaide Register Book Volume 949 Folio 43 freed and absolutely discharged from the Trust created by such Land Grant and which Trust required the said District Council of Loxton to hold the said lands in Trust to permit and suffer the same to be used at all times for hospital purposes

3. The said District Council of Loxton may at such times or time in such manner and upon such terms and conditions as it may deem

most expedient sell and dispose of the said lands referred to in section 2 of this Act

4. The net proceeds to be obtained from the sale of such lands Proceeds of sale as aforesaid shall be applied by the said District Council of Loxton how to be applied. in and towards discharging the debt due and owing in respect of the new District Hospital erected upon section 173 Hundred of Bookpurnong County of Alfred which said last mentioned section of land exclusive of all necessary roads was by Proclamation dated the 6th day of January 1926 published in the Government Gazette on the 21st day of January 1926 dedicated as a reserve for hospital purposes and placed under the care and control and management of the said District Council of Loxton
