Validity of former acts

(g) He shall be charged with the settlement of all
instruments issued under the seal of the province;
(h) He shall have the superintendence of asylums,
prisons, houses of correction and other places of
confinement within the province;

(i) He shall have the regulation and conduct of all liti-
gation for or against the Crown or any public depart-
ment in respect of any subjects within the authority
or jurisdiction of the Legislature;

(j) He shall be charged generally with such duties as may be at any time assigned by law or by the Lieutenant Governor in Council to the attorney general for Saskatchewan;

(k) He shall be charged inter alia with the conduct of the matters hereinafter set forth the enumeration of which, however, shall not be taken to restrict the general nature of any provision in this Act contained;

(1) The supervision of the offices of the courts of law in Saskatchewan;

(m) The examination of papers in connection with the admission and discharge of lunatics to and from asylums;

(n) Drawing special conveyances and instruments of a like nature in connection with the sale or purchase of property under The Public Works Act or otherwise. 1906, c. 7, s. 3.

4. The Lieutenant Governor in Council may appoint a deputy attorney general and such other officers, clerks and servants as are required for the proper conduct of the business of the department all of whom shall hold office during pleasure.

(2) Notwithstanding anything in any law, rule or regulation to the contrary students-at-law may be employed in the department and the service of such students under articles to the attorney general or deputy attorney general shall be accepted by the law society of Saskatchewan as sufficient for the period thereof but such students may be required by the law society to serve one year in the office of a practising barrister and solicitor before being admitted to the bar or to practice. 1906, c. 7, s. 4; 1907, c. 32, s. 13; 1909, c. 35, s. 21.

CHAPTER 9

An Act respecting the Department of the Provincial

Secretary.

SHORT TITLE.

1. This Act may be cited as "The Provincial Secretary': Short title Act." 1906, c. 8, s. 1.

ORGANISATION AND FUNCTION OF DEPARTMENT.

2. There shall be a department of the public service of Organisation Saskatchewan to be called the department of the provincial secretary over which the member of the Executive Counci! appointed by the Lieutenant Governor under the seal of the province to discharge the functions of provincial secretary for the time being shall preside. 1906, c. 8, s. 2.

3. The powers, duties and functions of the provincial Duties secretary are as follows:

(a) He has all the powers, duties and functions which
are assigned by law or custom to provincial
secretaries and registrars of the different provinces
of Canada in so far as they or any of them may
be applicable to Saskatchewan;

(b) He is the keeper of the Great Seal of Saskatchewan
and shall issue all letters patent, commissions and
other documents under the said seal and countersign
the same with the exception of those which shall be
countersigned by the clerk of the Executive Council;
and all commissions under the seal shall run in his
Majesty's name;

(c) He is the keeper of all registers and archives of
Saskatchewan. 1906, c. 8, s. 3.

4. The provincial secretary shall be the registrar of Saskat- To be chewan; and as such shall register all instruments of summons, commissions, letters patent, writs and other instruments and documents issued under the seal of the province; and his signature shall be proof of the fact that such registrar, archives, instruments of summons, commissions, letters patent, writs and other instruments and documents exist and are lawfully in his possession; and any copy signed by him of any document shall be equivalent to the original

instrument itself in any court in the province; and every document or copy of a document purporting to bear his signature shall be deemed so to do until proof of the contrary. 1906, c. 8, s. 4.

5. The Lieutenant Governor in Council may at any time appoint such other officers, clerks and servants as are requisite for the proper conduct of the business of the department all of whom shall hold office during pleasure. 1906, c. 8, s. 5.

6. The Lieutenant Governor in Council may from time to time make a tariff of fees which shall be paid for the issuing and registering of commissions, letters patent, licenses and other instruments and documents and for the delivery of certified copies thereof or of certified extracts from the registers and archives in the provincial secretary's department as hereinbefore mentioned; and the said provincial secretary shall account to the provincial treasurer for all moneys received in virtue of such or of any Act in force in Saskatchewan in such manner as may be prescribed by law or by the Lieutenant Governor in Council, as the case may be. 1906, c. 8, s. 6.

CHAPTER 10

An Act respecting the Department of Agriculture.

SHORT TITLE.

1. This Act may be cited as "The Department of Agriculture Short title Act." 1906, c. 9, s. 1.

ORGANISATION, OFFICERS, AND FUNCTIONS OF DEPARTMENT.

2. There shall be a department of the public service of Organisation Saskatchewan to be called the department of agriculture over which the member of the Executive Council appointed by the Lieutenant Governor under the seal of the province to discharge the functions of minister of agriculture for the time being Agriculture shall preside. 1906, c. 9, s. 2.

3. All that part of the administration of the Government of Province of Saskatchewan which relates to agriculture, immigration, statistics and the public health including hospitals shall be under the control of the department. 1906, c. 9, s. 3.

4. The Lieutenant Governor in Council may at any time officers and appoint such other officers, clerks or servants as may be required to carry on the business of the department all of whom shall hold office during pleasure. 1906, c. 9, s. 4.

5. It shall be the duty of the department to institute Duties of inquiries and collect facts and statistics relating to agricultural, manufacturing or other interests of Saskatchewan; and to adopt measures for circulating and disseminating the same in such manner and form as may be found to be adapted to promote the progress of the province; and to encourage immigration to Saskatchewan; and to see to the observance and execution of the provisions contained in all Acts relating to agriculture, statistics and public health., 1906, c. 9, s. 5.

6. A report of the work of the department shall be Annual prepared yearly and laid on the table of the Legislative report Assembly within fifteen days after the commencement of the next ensuing session thereof; and it shall be the duty of the department from time to time to issue such reports, circulars and other publications as the minister may deem advisable. 1906, c. 9, s. 6.

Persons required to furnish information to department

7. All officers of all agricultural societies, municipal councils, villages, local improvement districts, school boards, public institutions, incorporated companies and all public officers of the province and all medical practitioners and veterinary surgeons shall promptly answer all communications from the department; and shall from time to time collect and tabulate facts according to instructions to be furnished them from the department; and shall make diligent efforts to supply correct information on all questions submitted to them; and any such person neglecting or refusing to comply with the aforesaid provisions of this section when requested to so comply by the minister shall be guilty of an offence and on summary conviction thereof before a justice of the peace be liable to a penalty not exceeding $25. 1906, c. 9, s. 7.
