MR. HAYES. Q. What is your business?

[blocks in formation]

Q. In what business are you now engaged?
A. I am acting as coal expert for the rail-
road companies.

Q. What railroad companies?

A. The Central Pacific and the Southern
Pacific.

Q. How long have you been engaged as such?
A. With them for about three years, I think,
in the neighborhood of three years.

Q. Prior to that what was your business?
A. Mining.

Q. How were you engaged in it?

A. Well, I was engaged in all kinds of min-
ing, silver and gold, prior to that time, and I
had been superintendent of mines myself. I

was superintendent of the Amador mine at one time, and the Ione.

Q. The Ione was a coal mine?

A. Yes, sir.

Q.

When were you superintendent of the Ione coal mine?

A. I left there, I think, four years ago, about that time.

Q. And about three years ago you entered the employ of the railroad companies?

A. I think it was about three years ago.

Q. During the intervening year, in whose employ, if any person's, were you?

A. No person's, particularly.

Q. You are now in the employ of the Central Pacific and Southern Pacific?

A. I am.

Q. Did you in the year 1876 know Mrs. Moyle?

A. I don't remember; I might know her if I knew the circumstances.

Q. It is a lady who had a claim against the St. Louis Life Insurance Company. I will hand you this letter in your own handwriting, which may bring it back to you possibly. [Showing letter to witness.]

A. Yes, sir: I remember that at that time I was Superintendent of the Amador mine.

Q. I will ask you now, this letter having been shown to you, if you recollect the fact of

that lady having at that time a claim against this Life Insurance Company?

A. I think she had at that time. Her husband was killed in the Amador mine, and his life was insured, I believe.

Q. Do you know who she had endeavoring to collect the amount of that policy for her? A. I do not.

[blocks in formation]

Q. I will ask you if that letter is in his handwriting?

[Another letter shown to witness.]

A. Yes, sir; that is Mr. Davis' handwriting, I think.

Q. Having looked at those two letters, I will ask you if you can now recollect whether General Colton undertook the collection of that policy for Mrs. Moyle, or to aid her in the collection of it?

A. I don't know positively. I have forgotten all about the circumstances connected with that transaction.

Q. You say in this letter to Mr. Colton, written by yourself, "I have seen Mrs. Moyle,

and herewith enclose her letter to Mr. Head." Can you recollect to what that refers?
