The committee this day met at 10 a. m., Hon. Adolph J. Sabath (chairman) presiding.

The CHAIRMAN. The committee will please be in order. Mr. Tupy, what have you to present to the committee this morning?

Mr. TUPY. Mr. Chairman, we are ready to proceed with the Straus Bros. Investment Co. and the Metropolitan Trust Co. case, which will be presented by Mr. J. Kentner Elliott for the committee.

The CHAIRMAN. You may proceed.

Mr. ELLIOTT. Mr. Tupy, will you take the stand?

TESTIMONY OF J. L. TUPY

Mr. ELLIOTT. Will you state your name, please?

Mr. Tupy. J. L. Tupy, chief investigator of the congressional

committee.

Mr. ELLIOTT. And as such, have you been in charge of the subpenaing of witnesses with reference to the Straus Bros. Investment Co. and the Metropolitan Trust?

Mr. TUPY. Yes, sir.

Mr. ELLIOTT. Will you tell us for the record what success you have had in serving subpenas on Barnett Rossett; either of two men by the name of Frankel or a man by the name of Herman Straus?

Mr. TUPY. Herman A. Straus?

Mr. ELLIOTT. Herman A. Straus.

Mr. TUPY. Since about 10 days ago we have had process servers trying to locate these men both in their offices and in their homes. Process servers have sat up until 11 and 12 o'clock before their residences, and in all cases these gentlemen have evaded us and we cannot find them. One time we are told they are out of town and another time we are told that they are in town, but we cannot find them.

Mr. O'MALLEY. Is there any way for the process servers of this committee to verify from members of the family where they actually

are?

Mr. TUPY. The members of the family tell us that they are out of town. In their offices some of the clerks tell us that they are in town. We do not know which is true.
