the Government Gazette declaring the railway open for traffic,
the Governor may-

(a) With the object of encouraging the cultivation and
settlement of the land compulsorily purchase any
land in parcels of not less than one thousand acres,
each parcel being the property of one person or
two or more persons, jointly or in common, and
situated within fifteen miles of any part of the line
of the railway, and which land is certified by the
Minister for Lands as suitable for closer agricul-
tural settlement;

(b) Compulsorily purchase any land situated as afore-
said for townsites:

Provided that no land shall be compulsorily purchased under paragraph (a) of this section until the Land Purchase Board has favourably reported thereon.

5. On the determination by the Governor from time to time to exercise the power conferred by the last preceding section, any land within such defined limits may be taken under the Public Works Act, 1902, and the provisions of that Act shall apply, and the amount of the purchase money shall be determined as compensation is determined under that Act:

Provided that, on the exercise of any such power, or on the acquisition by the Governor within the said period of land situated as aforesaid for any work within the meaning of the Public Works Act, 1902, no regard shall be had to any iacreased value occasioned by the railway, and the purchase money shall be assessed at the probable and reasonable price which the land, with any improvements thereon, or the estate or interest of the claimant therein, might have been expected to realise if offered for sale at the date the land was taken, and if the railway had not been constructed or authorised.

[1923. 7. All such land acquired under paragraph (a) of section four shall be dealt with under the provisions of the Agricultural Lands Purchase Act, 1909, and the purchase money may be paid out of any moneys authorised to be raised and expended by that Act, or as therein prescribed.

8. Subject as aforesaid, the Public Works Act, 1902, is incorporated herewith.

FLINDERS BAY-MARGARET RIVER RAILWAY DEVIATION (No. 1).

Description of Line of Railway.

Commencing at a point on the Flinders Bay-Margaret River Railway, in or near Sussex Location No. 1556, and proceeding thence in a generally Southerly direction for about 32 miles and terminating at a point, in or near Crown Grant No. 316, Sussex District, and junctioning at that point with the Flinders Bay-Margaret River Railway, and as more particularly delineated and coloured red on map marked P.W.D., W.A., 22880, deposited pursuant to 2 Edward VII., No. 47, Section 96. Total length about 31⁄2 miles.

AN ACT to excise a portion of Reserve A ▲ 6922, and portions of Reserve A 136.

E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:

1. This Act may be cited as the Permanent Reserves Act, Short title. 1923.

Reserve A6922.

2. That portion of Reserve A16922 at Darlington, de- Excision of part of scribed in Part 1 of the schedule hereto, is excised from the said reserve, and may be disposed of under the provisions of the Land Act, 1898, for residential purposes.

3. Those portions of Reserve A↑136 at Donnybrook, de- Excision of parts scribed in Part 2 of the schedule hereto, are excised from the said reserve, and may be disposed of for the purposes of the Education Department.

THE SCHEDULE.

PART 1.

Greenmount Lots 64, 65, and 143, and so much of Lot 142 as is bounded by lines starting at its South-East corner and extending 0° 3′ 16 chains 5 links to its North-East corner; thence 270° 6' 8 chains 20.7 links along part of its North boundary to the Eastern boundary of Road No. 490; thence 205° 14′ 1 chain 47.7 links, 187° 10′ 6 chains 71.5 links, 152° 27′ 4 chains 80.8 links, 200° 8' 2 chains 84.7 links, and 225° 40′ 1 chain 56.4 links along said boundary to the South boundary of Lot 142 aforesaid; and thence 90° 15' 9 chains 53 links along said boundary to the starting point. (78 acres 1 rood 3 perches.)

PART 2.

An area of 4 acres 1 rood 13 perches, bounded by lines starting at the West corner of Wellington Location 622 and extending 334° 17', 1,329 links, along the Eastern side of the Bunbury-Donnybrook Road; thence 89° 32′, 384.4 links, along part of the Southern boundary of Wellington Location 458; thence by lines along the left bank of the Preston River, 158° 19, 934.1 links, and 136° 12′, 456.4 links, and thence 269° 34', 469 links, along a northern boundary of aforesaid Location 622, to the starting point.

Donnybrook Lot 439, being the area bounded by lines starting at the West corner of Wellington Location 622 and extending 334° 17', 431.4 links; thence 64° 17′, 296.1 links; thence 158° 19', 198.4 links; thence 136° 12′, 456.4 links, and thence 269° 34′, 469 links, to the starting point.

AN ACT to amend the Public Institutions and Friendly
Societies Lands Improvement Act, 1892.

E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:

1. This Act may be cited as the Public Institutions and short title. Friendly Societies Lands Improvement Act Amendment Act, 1923.

Section 2.

2. Section two of the Public Institutions and Friendly Amendment of Societies Lands Improvement Act, 1892, is hereby amended, by the addition of the following words, that is to say:

"and the word 'institution' shall also include any Trade Union and Trades and Labour Council and any Association in which, or in any trustees for which, any Trades Hall or land acquired or held for the purpose of a Trades Hall is vested."

Section 3 and 5

3. Section three of the Public Institutions and Friendly Amendment of Societies Lands Improvement Act, 1892, is amended by inserting the words "an institution or" before the words "the duly appointed trustees"; and section five of the said Act is amended by inserting the words "an institution or" before the words "the trustees."
