CHAPTER 50.

An Act to amend "The Municipal Boundaries Act."

HIS MAJESTY, by and with the advice and consent of the Legislative Assembly of Manitoba, enacts as

follows:

1. Section 33 of chapter 118 of the Revised Statutes of Manitoba, 1902, being "The Municipal Boundaries Act," is hereby repealed and the following substituted therefor:

RITCHOT.

33. The Rural Municipality of Ritchot shall comprise, on the west side of the Red River, that part of the Parish of Saint Norbert lying south of and including lot numbered sixty-nine in the inner and outer two miles, and that part of the Parish of Saint Agathe lying north of and including lot numbered five hundred and twenty-nine, and, on the east side of the Red River, townships numbered seven, eight and nine, fractional, in range numbered three east, together with that part of the Parish of St. Agathe north of and including lot numbered five hundred and thirty-two, and the Parish of Saint Norbert.

2. The said Act is hereby further amended by adding the following section immediately after section 33, as enacted by this Act:

FORT GARRY.

33A. The Rural Municipality of Fort Garry shall comprise that part of the Parish of St. Norbert, on the west side of the Red River, lying north of and including lot numbered seventy in the inner and outer two miles, and all that part of the Parish of St. Boniface west of the Red River not included in the City of Winnipeg, and all that part of the Parish of St. Vital lying west of the Red River, excepting lots numbered from forty-seven to sixty-three, inclusive of both such numbers, in the outer two miles of said Parish of St. Boniface.

3. Section 42 of the said Act is hereby repealed and the following substituted therefor:

42. The Rural Municipality of St. Vital shall comprise st. Vital lots one hundred and two (102) to one hundred and nineteen (119), both inclusive, and lots one hundred and twentyone (121) and one hundred and twenty-two (122) of the Parish of St. Boniface, sections numbered six (6) and seven (7), fractional, all in township numbered ten (10), in range numbered four (4) east; lots numbered from one hundred and forty-five (145) to two hundred and ninety (290), both inclusive (excepting thereof and therefrom lots one hundred and sixty-one and a half (1611) and one hundred and sixtytwo and a half (1621), and lots numbered from two hundred and ninety-nine (299) to three hundred and five (305), both inclusive, lots numbered from three hundred and seventeen (317) to three hundred and twenty-nine (329), inclusive of both such numbers, of the Roman Catholic Church Mission property, as shown upon a plan filed in the Winnipeg Land Titles Office as plan number four hundred and thirty-three (433), all that part of the Parish of St. Vital east of the Red River, that portion of territory lying between lot numbered seventy-five (75) of the outer two miles of the Parish of St. Boniface and the north boundary of township numbered ten (10) in range numbered four (4) east, and more particularly described as blocks A, B and C of the Roman Catholic Church Mission property, as shown on above mentioned plan numbered four hundred and thirty-three (433).

4. The Rural Municipality of Fort Garry shall be a Fort Garry rural municipality within the Eastern Judicial District.

5. The Lieutenant-Governor-in-Council may by order-in- order-incouncil:

(1) Specify the time for the holding of an election for providing for reeve and councillors of the Rural Municipalities of Fort first election. Garry and St. Vital;

(2) Divide the Rural Municipality of Fort Garry and also the Rural Municipalities of Ritchot and St. Vital into suitable wards;

(3) Declare the number of councillors who shall be elected for each ward in the Rural Municipalities of Fort Garry and St. Vital, according to the provisions of "The Municipal Act";

(4) Appoint a returning officer of the said Rural Municipalities of Fort Garry and St. Vital to act at the first elec

tion of a reeve and councillors in the said Rural Municipalities of Fort Garry and St. Vital;

(5) Specify the time for the holding of the first election of a reeve and councillors in the said Rural Municipalities of Fort Garry and St. Vital, and provide for all necessary proceedings for the proper holding of such election;

(6) Provide for the compilation of a voters' list to be used at the said elections, and prescribe and determine who shall be qualified electors and entitled to vote as such elections;

(7) Provide for all such matters and things for the proper holding of the said elections as may be deemed necessary or expedient.

6. The Lieutenant-Governor-in-Council may approve of a contract between the Rural Municipality of Fort Garry and any railway company which will insure the building street railway and operation of a street railway from a point or points in or near the City of Winnipeg, through the said Rural Municipality of Fort Garry, and for any extension or extensions of such street railway, which contract may contain such privileges as the Lieutenant-Governor-in-Council may approve of, and upon the same being so approved the same shall be valid and binding in all respects on both the said Rural Municipality of Fort Garry and the railway company entering into the said contract, and such approval shall have the same force and effect as if contained in a statute of the Legislature. Section 33 of chapter 31 of 1 George v, being "An Act to amend "The Municipal Act,'" and any amendment thereto shall not be construed so as to conflict with this section.

7. Notwithstanding sub-section (a) of section 33 of chapter 31 of 1 George v, being "An Act to amend 'The Municipal Act," and any amendment thereto, the council of the said Rural Municipality of Fort Garry shall have the right or power to enter into any agreement or contract with any person, company or corporation for the supply or furnishing of light, heat, power or water for use or with respect to the establishment, control or operation of any street railway or other public utility within the said municipality, and, upon the same being approved of by the Lieutenant-Governor-inCouncil, such agreement shall be valid and binding in all respects on both the said Rural Municipality of Fort Garry and the person, company or corporation entering into the said agreement, and such approval shall have the same force and effect as if contained in a statute of the Legislature.

8. 24B. The Rural Municipality of Lac du Bonnet shall comprise townships numbered fourteen, fifteen, sixteen, seventeen and eighteen, whole or fractional, in ranges numbered nine, ten, eleven and twelve east.

2. The foregoing described rural municipality shall be a rural municipality within the Eastern Judicial District.

3. The Lieutenant-Governor-in-Council may by order-incouncil

(a) Specify the time for the holding of an election for first election. reeve and councillors for the said Rural Municipality of Lac du Bonnet, created by this Act;

(b) Divide the municipality into wards and declare the number of councillors who shall be elected for each ward, according to the provisions of "The Municipal Act";

(c) Appoint a returning officer for the said municipality, to act at the first election of a reeve and councillors in the said municipality;

(d) Specify the date of holding the first election of a reeve and councillors in the said municipality, and provide for all necessary proceedings for the proper holding of such election;

(e)

Provide who shall be qualified and entitled to vote. at such election;
