Breach of duty by officer.

Sect. 61. (1.) Section eleven of the Ballot Act, 1872 (35 & 36 Vict. c. 33), shall apply to a returning officer or presiding officer or clerk who is guilty of any wilful misfeasance or wilful act or omission in contravention of this Act in like manner as if the same were in contravention of the Ballot Act, 1872.

NOTE.-Sect. 11 of the Ballot Act is as follows:-"Every returning officer, presiding officer, and clerk who is guilty of any wilful misfeasance or any wilful act or omission in contravention of this Act shall, in addition to any other penalty or liability to which he may be subject, forfeit to any person aggrieved by such misfeasance, act, or omission a penal sum not exceeding one hundred pounds.

"Section fifty of the Representation of the People Act, 1867, 30 & 31 Vict. c. 102 (which relates to the acting of any returning officer, or his partner or clerk, as agent for a candidate), shall apply to any returning officer or officer appointed by him in pursuance of this Act, and to his partner or clerk."

The following is the enactment referred to:-"No returning officer for any county or borough, nor his deputy, nor any partner or clerk of either of them, shall act as agent for any candidate in the management or conduct of his election as a member to serve in Parliament for such county or borough; and if any returning officer, his deputy, the partner or clerk of either of them, shall so act, he shall be guilty of a misdemeanor."

Sect. 61. (2.) Section ninety-seven of the Parliamentary Registration Act, 1843 (6 Vict. c. 18), shall apply to every registration officer who is guilty

of any wilful misfeasance or wilful act of commission or omission contrary to this Act in like manner as if the same were contrary to the Parliamentrary Registration Act, 1848.

NOTE.-Sect. 97 of the Parliamentary Registration Act, 1843, is as follows:-"Every sheriff, under sheriff, clerk of the peace, town clerk, secondary, returning officer, clerk of the crown, postmaster, overseer, or other person, or public officer, required by this Act to do any matter or thing, shall for every wilful misfeasance, or wilful act of commission or omission contrary to this Act, forfeit to any party aggrieved the penal sum of one hundred pounds, or uh less sum as the jury before whom may be tried any action to be brought for the recovery of the beforementioned sum shall consider just to be paid to such party, to be recovered by such party, with full costs of suit, by action for debt in any of her Majesty's superior courts at Westminster: Provided always, that nothing herein contained shall be construed to supersede any remedy or action against any returning officer according to any law now in force."
