FOURTH GRADE CATTLE.

All bulls, bullocks and heifers estimated to yield less than 48 per cent., and all cows estimated to yield less than 42 per cent., and all inferior cattle, shall be placed in the Fourth Grade and shall be sold in accordance with directions issued from time to time by or under the authority of the Food Controller at prices not exceeding in the case of bulls, bullocks, and heifers, the maximum price of 55s. per cwt., and in the case of cows the maximum price of 45s. per cwt.

For the purposes of these provisions, "inferior cattle" shall mean cattle which on a percentage basis would be placed in a superior grade, but which are not on grounds of quality or condition proper to be placed in such grade.

No cattle in the Fourth Grade will be covered by the Central Live Stock Insurance Scheme.

VARIATION OF SCHEDULED PRICES.

If, in the opinion of a person grading a beast, it is likely to yield an unusually small or large proportion of bone, the above prices may (except in the case of Fourth Grade cattle) be varied by 1s., 2s. or 35., more or less, but in no case shall the price for the First Grades be more than is. per cwt. in excess of the maximum prices in force for the time being.

PART 2.

DEAD WEIGHT PRICES.

(a) Class A Beasts.

(The price in each case is per lb. of the certified weight of the

dressed carcase.)

For the purposes of this part of the Schedule, "Class A Beasts shall mean beasts which, in the opinion of the Government Slaughterhouse Agent or other person authorised in that behalf by the Food Controller, would, in the case of a sale by live weight, be graded as belonging to the 1st, 2nd, or 3rd Grades mentioned in the First Part of this Schedule.

(b) Class B Beasts.

The sum applicable for Class B beasts shall, until further notice, be the price realised on sale by the Government Slaughterhouse Agent less such sum as the Food Controller may from time to time by notice determine. Until further notice the sum to be deducted shall be 23d. per lb.

For the purposes of this part of the Schedule. " Class B Beasts shall mean all beasts fit for slaughter other than Class A Beasts.

If one or more of the quarters of beef derived from the carcase of a Class B beast are, in the opinion of the Government Slaughterhouse Agent or other authorised person, fit to be classified as Class A meat, such quarter or quarters shall be classified accordingly, and the maximum price applicable in the case of Class A beasts shall apply to such quarter or quarters, but the offal derived from such carcase shall be deemed to be offal derived from a Class B beast.

The determination of a Government Slaughterhouse Agent, or other person authorised by the Food Controller, shall be conclusive upon the question whether the beast is a Class A or a Class B beast.

SECOND SCHEDULE.

MAXIMUM PRICES FOR SHEEP.

Prices for Class A Sheep.

NOTE. In the case of sales by fair value, the prices are per lb. of the estimated weight of the dressed carcase; in the case of sales by dead weight, the prices are per lb. of the certified weight of the dressed carcase.

The sum applicable on sales of Class B sheep by fair value shall, during the period from the 1st October, 1919, to the 3rd July, 1920,

For the purposes of this Schedule, "Class A sheep " shall mean sheep which in the opinion of the Grading Committee, Government Slaughterhouse Agent, or other person authorised in that behalf by the Food Controller will yield ordinary sound marketable mutton.

"Class B sheep" shall mean all sheep fit for slaughter other than Class A sheep. The determination of the Government Slaughterhouse Agent, or other person authorised in that behalf by the Food Controller, shall be conclusive upon the question whether a sheep is a Class A or a Class B sheep.

THE MILK (WINTER PRICES) Order, 1919.

General Licence.

Until further notice milk cans, milk churns or milk bottles may be used free from the restrictions imposed by Clause 12 of the above Order.

THE FOOD CONTROL COMMITTEES (REGULATION OF RETAIL PRICES) ORDER, 1919, DATED IST OCTOBER, 1919, MADE BY THE FOOD CONTROLLER UNDER THE DEFENCE OF THE REALM REGULATIONS. In exercise of the powers conferred upon him by the Defence of the Realm Regulations and of all other powers enabling him in that behalf, the Food Controller hereby orders that except under the authority of the Food Controller the following regulations shall be observed by all

persons concerned :—

1.-(a) A Food Control Committee may by resolution adopt a scheme under this Order for the regulation of prices chargeable on sales by retail within their district of any article of food to which this Order applies. The scheme shall come into operation at the expiration of three days after the consent in writing of the Divisional Food Commissioner for the division within which the district of the Committee is situate or of any person authorised in that behalf by the Food Controller has been obtained.

(b) A Divisional Food Commissioner or any person authorised as aforesaid may by notice direct that a scheme shall apply in any district or districts, and the scheme shall come into operation in such district or districts in the manner provided in the scheme.

2. (a) The Food Controller may from time to time prescribe the articles to which this Order shall apply.

(b) Until further notice this Order shall apply to—

Fruit, other than canned fruit and cooked fruit;

Nuts;

Vegetables, other than canned and cooked vegetables;
Shell fish, cooked or uncooked;

All other fish, whether fresh, smoked, cured, or frozen, except
canned or cooked fish;

provided that nothing in this Order or any scheme made hereunder shall apply to any sale in respect of which a maximum price is for the time being applicable under any Order of the Food Controller.

3. The scheme may with respect to any article contain provisions(a) for fixing the maximum price that may be charged by any person on any sale by retail, including provisions for fixing the same by reference to the cost price of the article with the addition of a percentage of the cost price or of a fixed sum, or for regulating in any other manner the maximum price;

(b) the manner in which the cost price of the article may be determined for the purposes of the scheme, and the terms and conditions on the basis of which the maximum price or cost price is fixed;

(c) the keeping and production of records and the exhibiting of notices of prices, and the disclosure of information by any person or persons, including persons dealing in the article by wholesale;

and generally the scheme may contain such other provisions as may be approved by the Divisional Food Commissioner or any person authorised as aforesaid, for the purposes of the scheme.

4. The Divisional Food Commissioner or any person authorised as aforesaid may from time to time give directions for securing the full operation of any scheme made under this Order, and for prescribing anything that under this Order or the scheme is to be prescribed.

5. A person shall not sell or offer or expose for sale by retail any article at a price in excess of the maximum price for the time being applicable under the scheme.

6. A person shall not in connection with any sale or disposition or proposed sale or disposition of any article enter or offer to enter into any artificial or fictitious transaction or make or demand any unreasonable charge, and a person shall not enter into any transaction intended or calculated or likely to increase unreasonably or improperly the cost of the article to the retailer, or deal in any article by whole

sale or retail otherwise than in accordance with the ordinary custom of the trade, or in any manner intended or calculated or likely to increase the number of dealings in the article reasonably necessary for the proper distribution of the article.

7. Where the scheme provides for the exhibiting of notices of the price of any article, a person shall not buy or offer to buy such article at a price in excess of the price exhibited by the seller.

8. Nothing in this Order shall affect sales for consumption on the premises of the seller.

9. It shall be the duty of all persons to comply with any such scheme and directions, and failure to comply therewith shall be a summary offence against the Defence of the Realm Regulations.

10. A Food Control Committee may at any time, with the consent of the Divisional Food Commissioner or any person authorised as aforesaid, vary or revoke any scheme adopted under this Order, and every scheme shall be subject to review by the Food Controller or the Divisional Food Commissioner or any person authorised as aforesaid, and shall be varied or revoked as he may direct.

11. For the purposes of this Order

(a) the expression "Food Control Committee "

means any Food Control Committee or Joint Food Control Committee constituted under any Order of the Food Controller.

(b) the expression "sale by retail" shall include any sale other than a sale for the purpose of re-sale, and any sale to a person for the purposes of a catering business carried on by him.

(c) the expression "Divisional Food Commissioner " means with respect to any district or other area the Divisional Food Commissioner for the Division in which the district or area is situate.

12. Infringements of this Order are summary offences against the Defence of the Realm Regulations.

13. (a) This Order may be cited as The Food Control Committees (Regulation of Retail Prices) Order, 1919.

(b) This Order shall apply only to Great Britain, and shall come into force on the 2nd October, 1919.
