Short title.

Validation of

Road Board.

No. 14 of 1923.

AN ACT to validate certain Rates, and the appropriation of certain Loan Rates, made and levied by the Claremont and Perth Road Boards respectively.

[Assented to 22nd February, 1923.]

E it enacted by the King's Most Excellent Majesty, by

Band with the advice and consent of the Legislative

Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:

1. This Act may be cited as the Claremont and Perth Road Districts Rates Act, 1923.

2. All rates (including uniform and local rates) made and Rates of Claremont levied or purporting to have been made and levied by the Claremont Road Board for the financial years ending 30th day of June, 1921, and 30th day of June, 1922, respectively, shall be deemed to have been lawfully made and levied; and all things necessary to be done in and towards the authorising, making, and levying of such rates shall be deemed to have been duly performed, notwithstanding any failure to comply with any of the provisions of the Road Districts Act, 1919, relating thereto; and the said rates, so far as the Board had power to make and levy the same if the said provision had been duly complied with, may be recovered by the Board accordingly, as if the provisions of the said Act had been in all respects duly complied with.

Validation of appropriation by Perth Road Board of certain loan rates.

3. (1.) Notwithstanding anything contained in the Roads Act, 1911, and the Road Districts Act, 1919, the appropriation and expenditure by the Perth Road Board of the sum of £9,005 9s. (being the excess of the proceeds of loan rates from the

1st day of May, 1912, to the 30th day of June, 1922, in respect of loans numbered 1 to 10, inclusive, after providing for the payment of interest and the formation of a sinking fund), for general purposes, or for any of the purposes of the Board, instead of the payment of interest and sinking fund, is hereby validated, authorised, and confirmed.

(2.) No action or other legal proceedings whatsoever shall be instituted in any court of law for or on account of the appropriation and expenditure of the said sum of £9,005 9s., or any part thereof, for or on account of the general or other purposes of the Perth Road Board, against Perth Road Board or any person who is or has been a member of such Board, or in the employment of the Board.

AN ACT to amend the Road Districts Act, 1919.

[Assented to 22nd February, 1923.]

E it enacted by the King's Most Excellent Majesty, by

Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:

1. This Act may be cited as the Road Districts Act Short title, Amendment Act, 1923, and shall be read as one with the Road Districts Act, 1919, hereinafter referred to as the principal Act.

2. Section two hundred and thirty-three of the principal Amendment of Act is amended, as follows:

land is held for pastoral purposes only, the rate may, in the discretion of the Board, be reduced to not less than one halfpenny in the pound.

(2.) By inserting, at the commencement of subsection (3), the words "Subject as aforesaid."

3. All copies of the principal Act to be hereafter printed by the Government Printer shall be printed as amended by this Act, under the superintendence of the Clerk of the Parliaments, and a reference to this Act shall be made in the margin.

MINER'S PHTHISIS.

AN ACT relating to Miner's Phthisis.

[Assented to 22nd February, 1923.]

E it enacted by the King's Most Excellent Majesty, by

Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:

1. This Act may be cited as the Miner's Phthisis Act, 1922, and shall come into operation on a date to be fixed by proclamation.

2. In this Act "employer" means any person (including a body corporate) by whom or on whose behalf any other person is employed to work on, in, or about a mine, and the term includes an agent or manager of an employer.

"Mine" and "mining" have the same meaning as in the Mining Act, 1904.

"Minister" means the Minister for Mines, or other responsible Minister of the Crown charged for the time being with the administration of this Act.

3. The Minister may employ such Government medi- Appointment of cal officers and medical practitioners as he may think fit for the purposes of this Act, and shall issue to every such officer or practitioner so appointed a certificate in writing of his appointment.

4. (1.) It shall be the duty of every person occupied or employed in mining operations on, in, or about any mine to submit himself, from time to time, to a medical officer or medical practitioner so appointed, for examination for symptoms of miner's phthisis or tuberculosis, whenever required so to do by any such medical officer or practitioner.

(2.) Any person occupied or employed on, in, or about a mine who fails, when required as aforesaid, to submit himself to any medical examination for the purposes of this Act, at the time and place stated in the requisition, shall be guilty of an offence.

Penalty: Fifty pounds.

(3.) After every medical examination or re-examination of any person under this section, if such person is found not to be suffering from tuberculosis, he shall be supplied with a certificate in the prescribed form, which, until revoked, shall entitle him either to continue working or to commence work in mining operations on, in, or about any mine.

(a) furnish to a medical officer or medical practitioner

for Mines, a list of all persons employed on, in, or
about the mine of the employer whenever required
in writing so to do; and

(b) afford to all persons so employed by him all reason-
able facilities for such persons to submit them-
selves, without loss of pay, to medical examination
under this Act; and

(c) permit any medical officer or medical practitioner appointed as aforesaid, to have access to the mine of the employer for the purposes of and in the execution of his duties under this Act.

Penalty: Fifty pounds.

6. Any employer, and any person employed on, in, or about Penalty for a mine, who resists, hinders, or obstructs a medical officer or

obstruction of officers.
