BROOME HILL RACECOURSE.

No. 20 of 1922.

AN ACT to authorise the Sale of the Land comprised in Reserve 4568, and set apart for the purpose of a Racecourse at Broome Hill, and the application of the Proceeds of the Sale towards the purchase and improvement of other Land vested in the Broome Hill Road Board.

E it enacted by the King's Most Excellent Majesty, by

Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:

1. This Act may be cited as the Broome Hill Racecourse short title. Act, 1922.

2. Kojonup Location 4770, being the land comprised in Reserve 4568 and leased under section forty-two of the Land Act, 1898, to trustees for the Broome Hill Race Club, may be granted to the trustees for an estate in fee simple, and the trustees are hereby empowered to sell the said land and transfer the same to the purchaser for an estate in fee simple freed and discharged from all trusts affecting the said land.

3. The trustees shall hold the proceeds of such sale in Application of pur trust to apply such proceeds in or towards the purchase and improvement of other lands to be approved by the Minister for Lands, which lands shall be transferred to the Broome Hill Road Board, and held for the purposes of a racecourse, show and recreation grounds, and other similar purposes.

AN ACT to apply out of the Consolidated Revenue Fund the sum of Six Hundred and Fifty Thousand Pounds, and from Moneys to Credit of the Government Property Sales Fund Fifteen Thousand Pounds, and from Moneys to Credit of the Land Improvement Loan Fund Three Thousand Pounds to the Service of the Year ending 30th June, 1923.

E, Your Majesty's Most Dutiful and Loyal Subjects, the Members of the Legislative Assembly of Western Australia in Parliament assembled, towards making good the supply which we have cheerfully granted to Your Majesty in this Session of Parliament, have resolved to grant unto Your Majesty the sum hereinafter mentioned, and do, therefore, most humbly beseech Your Majesty that it may be enacted: And be it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:

1. There shall and may be issued and applied for or towards making good the supply granted to His Majesty for the service of the year from 1st July, 1922, to 30th June, 1923, the Sum of Six Hundred and Fifty Thousand Pounds out of the Consolidated Revenue Fund, and from Moneys to Credit of the Government Property Sales Fund Fifteen Thousand Pounds; and from Moneys to Credit of the Land Improvement Loan Fund Three Thousand Pounds; and the Treasurer of Western Australia is hereby authorised and empowered to issue and apply the Moneys authorised to be issued and applied.

AN ACT to authorise a further extension of the Wyalcatchem-Mount Marshall Railway.

E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:

1. This Act may be cited as the Wyalcatchem-Mount Short title. Marshall Railway (Extension No. 2) Act, 1922.

2. It shall be lawful to construct and maintain a railway Authority to with all necessary, proper, and usual works and conveniences construct. in connection therewith, along the line described in the Schedule to this Act.

3. Notwithstanding anything contained in the Public Deviation. Works Act, 1902, it shall be lawful for the Minister for Works to deviate from the line as described in such Schedule to the extent of one mile on either side thereof.

4. At any time after the passing of this Act, and until the expiration of twelve months from the publication of notice in the Government Gazette declaring the railway open for traffic, the Governor may

(a) With the object of encouraging the cultivation and settlement of the land, compulsorily purchase any land in parcels of not less than one thousand acres, each parcel being the property of one person or two or more persons, jointly or in common, and situated within fifteen miles of any part of the line of the railway, and which land is certified by the Minister for Lands as suitable for closer agricultural settlement;

(b) Compulsorily purchase any land situated as aforesaid for townsites:

Provided that no land shall be compulsorily purchased under paragraph (a) of this section until the Land Purchase Board has favourably reported thereon.

5. On the determination by the Governor from time to time to exercise the power conferred by the last preceding section, any land within such defined limits may be taken under the Public Works Act, 1902, and the provisions of that Act shall apply, and the amount of the purchase money shall be determined as compensation is determined under that Act:

Provided that, on the exercise of any such power, or on the acquisition by the Governor within the said period of land situated as aforesaid for any work within the meaning of the Public Works Act, 1902, no regard shall be had to any increased value occasioned by the railway, and the purchase money shall be assessed at the probable and reasonable price which the land, with any improvements thereon, or the estate or interest of the claimant therein, might have been expected to realise if offered for sale at the date the land was taken, and if the railway had not been constructed or authorised.

6. Before the purchase money is paid for any land compulsorily purchased under the authority of this Act, the Governor may require the claimant to execute a surrender, conveyance, or transfer of the land to the Crown, or as the Governor may direct, free from all encumbrances.

7. All such lands acquired under paragraph (a) of section four shall be dealt with under the provisions of the Agricul

SCHEDULE.

WYALCATCHEM-MOUNT MARSHALL RAILWAY EXTENSION No. 2.

Description of line of Railway.

Commencing at a point on the Wyalcatchem-Mount Marshall Railway Extension, near the Eastern boundary of Avon Location 14103, about 25 miles from Bencubbin Station and proceeding thence in a generally Eastern direction for about 7 miles to a point on or within one mile of Avon Location 15390, as more particularly delineated and coloured red on map marked P.W.D., W.A., 21778, deposited pursuant to 2 Edward VII, No. 47, Section 96.

Total length, about 7 miles.

GERALDTON RACECOURSE.

No. 23 of 1922.

AN ACT to enable Victoria Location 1229 to be granted in fee simple to the Trustees of the Victoria District Turf Club in lieu of an existing lease, with power to sell, subject to the proceeds being applied to the improvement of Reserves 18098 and 16855, and to authorise a lease of portion of Reserve A16855 to the said Trustees.
