THE approval with which the First and Second Editions of the "Practice of the Incumbered Estates Court" were received has led to the publication of the present Volume, which may, substantially, be taken as a Third Edition of the former treatise. The work has, however, been entirely re-written. The Landed Estates Court is based upon the Incumbered Estates Court, and nearly all the Sections of the Code which established the late tribunal are re-enacted in the present Statute, and the new Rules and Practice are, in their main features, similar to the old, so that we have now reduced to settled law the principles and practice of what originally was a temporary Political experiment. But little has been aimed at in this Treatise beyond a clear and simple exposition of the Jurisdiction of the Court, and of the machinery by means of which it is to be worked. |
